Snyder Kudos to the Committee To Retain The Sitting Judges and our poll volunteers. I wish to especially acknowledge the extraordinary efforts of Bill Davis, Chair, David Merkin, Treasurer, Jeremy Rachlin, Tracy Phillips and Caitlin Grant, Volunteer Coordinators, as well as Mimi Magyar, Bruce Marcus, Sydney Patterson, and a host of others. The committee, with the support of over 350 volunteers, many of whom are BAMC members, manned the polls at the primary, early voting and the critical day of the general election. Your commitment to the election preserved the important process of maintaining the integrity of the process of selecting judges. The extensive and time consuming service of the committee and our volunteers is greatly appreciated and positively reflects on our efforts as an Association to best serve the residents of Montgomery County. noblesse oblige (great Privilege creates great responsibility) We are all greatly privileged to be members of the Maryland Bar and acknowledge our responsibility to improve the administration of justice for all. Although we receive many membership benefits, this is not the only reason to be a BAMC member or sponsor. Did you ever wonder how the revenues from fundraising projects support and serve the community? In addition to numerous charitable organizations, including but not limited to, the Maryland Special Olympics, Habitat for Humanity, Shepherd s Table and Family Justice Center, these funds support the development of important new programs such as the Drug Court. Approximately 12 years ago, the Honorable Nelson Rupp along with Pam Harris, our Court Administrator at the time, attended a series of conferences with the Department of Justice in an attempt to establish a Montgomery County Drug Court program. 3 current update circuit court notes Peace orders and Protective orders extensions Pursuant to the October 1, 2014 amendments to courts and Judicial Proceedings article and family law article 4-507, when a Motion to Extend a Peace or Protective Order is timely filed with the Circuit Court, a hearing will be set within 30 days. If the hearing is set after the original expiration date of the final order, the Court will automatically issue an order keeping the terms of the current order in full force and effect until the hearing on the motion. guardianship show cause hearings/time change As part of the ongoing Family DCM Review process, beginning the week of october 27, 2014, all Show Cause Hearings in Guardianship cases will be set on thursday at 1:30 pm with the Civil Motions Judge. A Scheduling Order will be issued for any contested Guardianship case with a trial time estimate of more than ½ day. 4 President s message, cont d (Continued from page 1) County State s Attorney s Office, Paul DeWolfe and Mary Siegfried, of the Public Defender s Office, the Department of Health and Human Services, and the Department of Parole and Probation. The Montgomery County Police, Bruce Sherman and Darren Popkin, of the Sheriff s Department and Art Wallenstein and Stefan LoBoglio, of the Prerelease Center all played an active role in implementing this program. As you can imagine coordinating these agencies was no small task! Ten years ago, the first Drug Court participant was admitted (sentenced) to the program. The requirements of this program are strict. Each participant must, on a weekly basis, receive 2-3 treatment/therapy sessions, maintain regular contact with their case worker, attend 3-4 AA/NA meetings, submit to 2-3 random urinalysis, live in approved sober housing, remain gainfully employed and attend weekly Drug Court hearings at night. Montgomery County is one of the few jurisdictions that holds night court. Judges Rupp and Quirk preside over the weekly night sessions in addition to their regular assignments. These sessions are held with the participation of the State's Attorney, Public Defender, Sheriff and Court Administration. bamc members Drug Court participants include those who have suffered from the most severe of addictions with a 100% recidivist rate and have often described themselves as a "Hot Mess". Their lives have spiraled out of control with little hope of regaining their sobriety let alone keeping a job or envisioning any meaningful future. Realizing that we cannot simply build more prisons, this program attempts to remedy the source of the problem i.e., the loss of control and self respect. The reality of drug/alcohol treatment and rehabilitation is that no one succeeds until they accept full responsibility for their own sobriety. The original and still current Drug Court Case Manager Bunny Boswell has been key to the program's success, along with other Drug Court Case Managers. Ms. Bunny, as she is affectionately known, is part Marine Corp Drill Sergeant and part Mother Superior. She speaks with many of the participants daily and quickly disposes of any excuses or rationalizations that could interfere with full compliance. If you have never attended a Drug Court graduation, it can best be described as an uplifting revival meeting where the most supportive and vocal attendees are the past graduates. At a recent graduation, the speaker was a young man who Judge Rupp had incarcerated four times when he failed to fully comply with his weekly requirements. As part of his emotional speech, he hugged and publicly thanked both Judge Rupp and co-chair Judge Quirk for saving his life. What was truly extraordinary was that, after obtaining his sobriety thru the program, this young man had on two separate occasions come to the rescue and saved the lives of helpless people. He realized that by saving himself he was able to be there to save others. There can be no doubt that this program works and actually has the ability to changes lives for the better. Of those who have completed Drug Court, 20% reoffend as compared to the 100% recidivist rate preprogram. BAMC members Glen Cooper and Bob Maclay helped set up the Drug Court 501(c) 3 program to help fund the GED program run by Drug Court and provide other assistance. The Bar Foundation provides funding to support the Drug Court program. Judge William Simmons now has his own version of the program in the District Court and is experiencing similar success. We all owe a great deal to our members who recognized the need and have tirelessly given their time and support to others. We should be proud that through these and a myriad of other programs the members of our bar association continue to fulfill our responsibilities to the citizens of Montgomery County. Under the previous reimbursement structure the court could only make a very limited number of appointments in a single fiscal year. Under the new structure the court will have the ability to make more appointments in these sensitive matters. circuit court renovations Phase II construction continues in the Circuit Court North Tower. Our new Jury Assembly area on the 2nd floor will be opening December 8, 2014, and the Courtroom Clerks relocated their offices to the 2nd floor on November 10, Construction on the Terrace Level has been re-sequenced; therefore, the corridor connecting the Circuit Court to the EOB will remain closed until further notice. Once a re-opening date is determined, we will notify everyone. Until that time, all access between the Circuit Court and the EOB will be through the EOB Lobby located on the Monroe Street side of the Circuit Court. Progress is also being made on the Children s Waiting Room. Kids spot is expected to open early next year and will be a kid-friendly waiting area for children whose families have business with the Circuit Court for Montgomery County. Children between the ages of 2 and 12 will be welcomed at Kids Spot, free of charge, as long as their guardian is in the Circuit Court Building. John W. Sometime after Christmas Day we plan to watch the film Unbroken, which was produced and directed by Angelina Jolie, at the Bethesda Row Cinema Landmark Theatres. In November of 2012 our group read and discussed this book. If you would like to join us for this evening at the movies, please let me know. We tend to think of the holidays as a time when we can cut down the amount of work we accomplish. Whether you are solo, run a firm, or work in a firm, write down the projects or tasks you want to complete before the holidays and set a schedule to get them done. If you have staff, ask them to do the same and turn them in to you. Don t let the holidays be an excuse for not getting important work done. 2. Tell your staff, co-workers, friends and family how much you value them in words. Whatever you do in terms of gifts is dwarfed by words of praise. Telling someone how much you value them makes you feel good about you and them. 3. Make your plans for the holiday early. Not waiting until the last minute reduces stress. Check to see if your plans include having fun. Your emotional health is important for you, your family and your office. 4. Make a list of things you are going to do to take care of yourself during the holidays. That can include exercise, yoga, meditation, timeouts from difficult situations with family and activities you enjoy. 5. Meet with your accountant and learn what you can do by December 31 to minimize your tax burden and to make sure you have no penalties when you file. 6. 10 legal ethics article ethical considerations concerning confidentiality clauses in settlement agreements Rule 7.2 of the Maryland Lawyers Rules of Professional Conduct and its comments make clear that the public s need to know about the availability of legal services can be fulfilled, in part, through advertising, so long as the advertising is neither misleading nor overreaching. See, comment 1 to Rule 7.2. Law firms, large and small, consistent with this Rule, actively promote the services they have undertaken and will agree to undertake; law firm websites frequently provide information about cases which have been handled and resolved which is intended to invite the attention of those seeking legal assistance. Lawyer blogs continue to proliferate as communication through social media has become the norm. Tension arises, however, between lawyers rights to promote the services they provide to those seeking legal assistance and the resolution of existing client disputes. This tension comes to the fore when lawyers seek to provide information to the public in order to promote their experience to other prospective clients. This tug-pull has manifested itself in the increasing use of confidentiality clauses in settlement agreements as parties for various reasons desire to keep aspects of settlement agreements out of the public eye. In the context of lawyer advertising, confidentiality clauses in settlement agreements are generally viewed as ethical so long as they do not restrict a lawyer s right to practice. Rule 5.6 (b) of the MLRPC entitled Restrictions on the Right to Practice provides, in pertinent part, that a lawyer shall not participate in offering or making an agreement in which a restriction on the lawyer s right to practice is part of any settlement of a client controversy. (Emphasis supplied) Accordingly, when confidentiality clauses are considered for use in settlement agreements ethical concerns present themselves. Ethical considerations which may arise relate to, inter alia, how restrictive any such agreement is and the nature of the information sought to be protected. An example of the type of clause that may violate Rule 5.6 (b) could be an offer by counsel, as a term of the settlement agreement, that would require opposing counsel to refrain from disclosing information concerning the lawsuit that is already public, including the identities of counsel, if the effect of such an offer would be to restrict counsel s right to practice law including the right to advertise within the bounds of MLRPC 7.2. Another example of improper language in a confidentiality clause could be an offer which seeks the imposition of an absolute ban on future representation by counsel in claims involving the opposing party. (See comment 4 to MLRPC concerning notice per Rule 7.3 to members of a class in class action litigation.) Other rules of professional conduct that may be implicated with respect to confidentiality clauses seeking to limit a lawyer s right to practice are Rule 1.1 ( Competence ), Rule 1.3 ( Diligence ) and Rule 5.4(c) ( Professional Independence of a Lawyer ). There are several reasons why a client may desire the protections afforded by a confidentiality clause. Among these considerations is the strong public policy in favor of settling disputes, with confidentiality as to the terms of the settlement recognized as a valuable tool in effectuating many settlements. Each side has its own incentive for including such clauses. Defendants may not want the fact of settlement or the amount to become public knowledge in order to minimize the risks of disclosure to other potential claimants. A plaintiff may desire to keep private how much or how little consideration was received as well as other terms of the agreement. In summary, allowing the parties to settle disputes privately and to maintain confidentiality on their own terms promotes dispute resolution with recognition of the uncertainty and expense of litigation and without any admission of liability. On the other hand, ethical and public policy arguments against certain provisions in confidentiality clauses in settlement agreements are also well-recognized. First, confidentiality promotes the continuation of wrongful conduct thereby stifling protection of the public. In addition, secrecy may be perceived as or in fact may protect repeat offenders and thereby exposing the public to harm thereby creating the perception that the legal system fails to promote justice. Indeed, some states have statutes specifically prohibiting the concealment of various public hazards and latent defects. See, e.g. FLA. STAT (2014); CAL. CIV. CODE (2014). Other arguments which weigh against the enforcement of certain provisions of confidentiality clauses relate to the threat they may pose to the overall integrity of the judicial system. One such concern is the social desirability of preserving the public s access to experienced lawyers. If access to information about cases is restricted by a broad confidentiality clause, potential claimants could be denied access to the identities of experienced lawyers in an area of practice concentration. There is a school of thought that confidentiality does not promote settlement, a concern since the majority of cases are settled short of trial. See Ronald L. Burdge, Bad for Clients, Bad for Lawyers, Bad for Justice, GP SOLO, Nov./Dec. 2012, at 25, By logical extension, yet another reason against fostering broad confidentiality clauses is that lawyers are unreasonably restricted in determining the settlement potential of a case if they are unable to compare their cases to other similar cases. Violation a confidentiality clause could have serious consequences, potentially causing a settlement agreement to become void, resulting in a forfeiture of the settlement payment or in the payment of liquidated damages. Further, a violation of the confidentiality clause could put the attorney at risk professionally. Accordingly, caution should be used when drafting or reviewing settlement agreements containing confidentiality clauses. This writer has not found any published opinions in Maryland on this point. However, numerous other jurisdictions have addressed the issue of ethical considerations which confidentiality clauses raise. The District of Columbia Bar Legal Ethics Committee has opined that settling parties are prohibited from agreeing to 10 The Bar Association of Montgomery County, MD Newsletter December, 2014

11 legal ethics article keep confidential that information which is already in the public domain. See D.C. Ethics Op. 335 (2006). Other jurisdictions have concluded that any confidentiality clause that restricts a lawyer from practicing by interfering with his or her ability to inform potential clients of the lawyer s relevant expertise and experience is a violation of the equivalent of MLRPC 5.6 (b). See, e.g., Prof'l Ethics of the Florida Bar Op (2005); NHBA Ethics Comm., Op /6 (2009). The breadth of confidentiality clauses varies significantly, ranging from simply protecting the amount of the settlement to prohibitions on counsel representing other current or future clients. Because this issue has not been addressed in a reported decision in Maryland this analysis should be used for informational purposes and to promote awareness of ethical considerations which affect the use of confidentiality clauses. With this caveat in mind, however, tips to consider in drafting confidentiality clauses in settlement agreements so as to avoid potential ethical violations include the following: First, make it clear that both the terms of the agreement and the agreement itself are strictly confidential. It may also be desirable to make clear that the underlying dispute and any negotiations leading to the settlement are confidential. Bear in mind that the clause should avoid any effort to keep confidential information that is already in the public domain. It may also be noted in the agreement that any breach of the confidentiality clause may be deemed a material breach of the settlement agreement and that in the event of a breach, the defaulting party may be required to pay liquidated damages of a sum certain. The agreement can also identify any exclusions to disclosure such as providing information to professionals such as attorneys or accountants or by court order or other lawful process. One of the real joys this holiday season is the opportunity to say thank you and wish you the very best. It is never too late to get involved, and there are ample opportunities. Our community residents really need you! Your call to volunteer will make a difference to those without resources. We are also seeking attorneys for collaboration with Catholic Charities, whereby a MD-barred attorney will assist in the family law portion of a Special Immigrant Juvenile Status case, usually via the establishment of a custody or guardianship. The Pro Bono Program provides two ways for county residents to receive free legal services in civil cases at a legal advice clinic or through the client intake line for referral to an attorney volunteer for direct representation. The legal advice clinics operate in four locations across the county (SEE BOX BELOW) and provide residents the opportunity to walk-in and meet with an attorney volunteer without scheduling an appointment. Eligible clients present their legal problems to an attorney and receive free immediate legal advice and/or referral to a non-profit or government social service agency that may be helpful. The client intake line operates out of the main office where the staff screens calls from potential clients. The Pro Bono Program staff conducts all screenings over the phone only. Cases referred to attorney volunteers include family law, debt collection, bankruptcy, limited employment, limited immigration, wills and power of attorney. The Pro Bono Program currently is participating in three projects. First, we participate in the Judicare Project. Contested custody and complex family law cases are referred at a reduced fee to experienced family law attorneys. Attorneys can seek reimbursement of $80 per hour with a cap of 20 hours per case. The Pro Bono Program requires that the attorney must accept a pro bono case for each case accepted under the Judicare Project. Second, we have a working agreement with the collaboration Project of maryland for family law case referrals that include modifications. Third, we refer eligible clients with debt buyer cases to attorney volunteers for direct representation under the consumer Protection Project. Our family law training sessions known as the rita rosenkrantz family law training are currently available via webcast by any attorney who wants a refresher or would like to expand into this practice area. This extensive and in-depth six hour family law training is a must see!! The outstanding compilation of family law materials is available for FREE to any MDbarred attorneys in good standing who agree to take a pro bono case at the time of the training. Attorneys participating in the training have the opportunity to immediately join a mentoring group hosted by an experienced family law attorney. The mentoring group meetings are your opportunity to ask questions about your case and learn from the attorneys participating in the group.
