Continental breakfast will be provided and sponsored by Renew Data Corp. 10:00-11:00 Session 1 Collection and Forensics Digital evidence plays an ever more central role in the litigation life cycle. As people have moved toward electronic means of documentation and communication, much of what was traditionally found in paper files such as notes, correspondence, financial accounting, memoranda and the like are now in one or more file formats on a computer or server. Not a case goes by these days where a significant portion of the pertinent information is located in a QuickBooks file, Excel spreadsheet, message, etc. Key evidence increasingly resides on more than a user s hard drive or file server, requiring the capture and analysis of evidence from enterprise productivity servers, network logs, or proprietary databases. Users are becoming more sophisticated, as well as their efforts to circumvent security policies or encrypt, delete, or destroy digital evidence. This panel will discuss the dangers of self collection, tools that are available for collection, collecting files in a forensically sound manner versus a forensic image, and when a forensic collection is needed. 2 11:15-12:15 Session 2 Metrics In the world of alternative fee arrangements e-discovery metrics are one of the keys to predicting costs. Metrics are also key to projecting turnaround times in electronic discovery and can reduce the number of fire drills. Join us for a discussion regarding the world of e-discovery metrics. We ll answer questions such as: How do you know what metrics to capture? Once you know what to capture, how do you capture them in a meaningful way? This break will be sponsored by Blackletter Discovery. 2:15-3:15 Session 4 Man vs. Machine: The Promise of Computer Assisted Document Review It s an inescapable fact that the most of the information of interest in modern litigation is created and stored on computers. For this reason, it s no surprise that computers are called upon to collect, process, filter, and search this data and that the ediscovery market continues to grow, both in terms of revenue and available tools. The explosive growth in the sheer volume of data has also impacted the document review process to the point where, in many cases, it has become a significant financial burden and staffing challenge. It seems only natural that we re now seeing computers called upon to assist in this phase of information assessment. Increasing numbers of vendors are touting tools designed to ease the burden of review under monikers of predictive coding, artificial intelligence, autocoding and computer assisted review. The goal of this session is to provide a brief overview of the current state of machine assisted review and what tasks the technology can and cannot perform in its present incarnations. In addition,
3 we hope to provide a thought-provoking discussion of the technical, legal, and ethical issues to be considered when automating increasingly subjective portions of the matter workflow. 5 Speaker Biographies Scott Ardisson is the President of bit-x-bit, and the lead consultant and forensic examiner for the company. He is a Certified Computer Examiner and a member of the International Society of Forensic Computer Examiners. With over ten years of experience in the security industry, Mr. Ardisson spent six years with the U.S. Department of Transportation (DOT) Infrastructure Protection and Operations Division, where he served as a technical project leader for various Homeland Defense efforts including the Northern Border Inspection System (NORBIS) for the Immigration and Naturalization Service and the U.S. Capitol Physical Security Upgrade Program Vehicle Entry Point Screening System. Julie Brown currently manages the Litigation Technology Department at Vorys, Sater, Seymour and Pease LLP. She is on the EDRM Advisory Committee, a leader on the EDRM Evergreen Identification project and a Sedona working group member. She is on the ILTA Litigation Support Steering Committee and is the Litigation Support City Rep for Columbus, OH. She has a paralegal degree and over 20 years of experience working in law firms and a Fortune 500 litigation department. Brett Burney is Principal of Burney Consultants LLC, and focuses his time on bridging the chasm between the legal and technology frontiers of electronic discovery. Prior to establishing Burney Consultants LLC, Brett spent over 5 years at the law firm of Thompson Hine LLP where he worked with litigation teams in building document databases, counseling on electronic discovery issues, and supporting them at trial. Brett graduated from the University of Dayton School of Law in 2000 and quickly became active in the world of legal technology. 6 Rich Cohen is the president of RenewData. Mr. Cohen leads RenewData's external activities and client advisory service functions. He brings more than 30 years of management and legal experience to RenewData. Prior to joining RenewData, Cohen served as Senior VP & Managing Director of Legal Services for a large legal services organization. Cohen holds a Bachelor degree from the State University of New York at Buffalo and a Juris Doctor from the University of Akron, School of Law. He is a member of the American and Ohio State Bar Association. Eric T. Crespolini Esq. is Vice President of ediscovery Technologies and part of the Protect subject matter expert team for Autonomy. Mr. Crespolini brings over a decade of experience building and leading teams in delivering ediscovery expertise to leading enterprises, information technology management and consulting, implementing enterprise-wide financial and project control systems, data warehousing, electronic collection, disaster planning, and operational process development. Prior to joining Autonomy, Mr. Crespolini held senior management positions at Clearwell Systems, Xerox, and Innovative System Design. Mr. Crespolini earned his JD from Rutgers University, a BS in Actuarial Science from St. John s University, and holds an MBA in Corporate Finance. C. Matthew Curtin is the founder of the computer expert firm Interhack. His practice helps attorneys and executives understand and make use of computer technology and relevant data. He works extensively in litigation and IT crisis management throughout the country, often called as an expert witness in criminal, civil, and administrative matters. He is the author of two books and a Lecturer in the Department of Computer Science and Engineering at The Ohio State University. JoAnn Fair has been with Wendy's International, Inc. for more than eight years, where she supports two law departments. She serves as the "technical guru" for the departments' software applications and liaison to corporate IT for litigation matters. Prior to Wendy's, JoAnn was a technical manager for a start-up
7 software company, managed an office and technical staff for a local ISP and was a calm, reassuring voice at a 911 call center (not unlike a corporate law department). Charles Intriago is the President of the Intriago Group. In February 2010, the Intriago Group formed the Association of Certified E-Discovery Specialists (ACEDS), which serves a worldwide membership. It issues the Certified E- Discovery Specialist certification. Earlier in his career, Mr. Intriago served as Chief Counsel to the Legal and Monetary Affairs Subcommittee of the US House of Representatives, which oversaw the operations of the US Department of Justice, Treasury Department, Federal Reserve, FDIC, SEC and other agencies. He also served as Assistant US Attorney in Miami prosecuting fraud, public corruption and drug conspiracies and as Special Counsel on Organized Crime of Florida, where he wrote the Florida Statewide Grand Jury Act. Mr. Intriago, who has substantial litigation experience in federal and state courts, was also an equity partner at McDermott Will & Emery, specializing in litigation and business law. He earned his law degree at the University of Florida, where he was Editor-in-Chief of the law review, and his Bachelor of Arts degree at Florida State University. Don McCann currently serves as a Litigation Support Analyst at Baker & Hostetler, LLP in Cleveland, Ohio. Prior to joining Baker, he co-founded Imaging Technologies, Inc., a Cleveland-based litigation service bureau. He has served as a speaker on a variety of topics in litigation support and ediscovery to law firms and other professional organizations. Prior to working in the legal industry, Don earned a Ph.D. in clinical psychology and was a practicing therapist. Nicole Randall is the Litigation Support Manager in the firm s Litigation and Information Systems Departments. Ms. Randall joined the firm in January 2001 as an attorney practicing in the Litigation Department. In 2005 she transitioned into her current role as Litigation Support Manager and now concentrates on supporting and consulting with attorneys, paralegals, staff and clients on E Discovery, document management, litigation support applications, discovery and trial technology.
8 Justin Redpath is an e-discovery Analysis & Technology Support Analyst for K&L Gates, LLP. Prior to joining K&L Gates in July of 2011, Justin was an Electronic Discovery Specialist at Cohen & Grigsby, P.C, where he implemented firm policy relating to the use of technology in the practice of law across multiple practice areas, including oversight of electronic litigation support operations, development of recommended practices / standardized protocols, and the design of application-specific training programs. Justin also serves as ILTA's Pittsburgh Litigation Support City Representative. J. William (Bill) Speros (bsperos@speros.net) is an attorney consulting in evidence management. Bill consults to corporate counsel and their firms regarding technologies and techniques to manage evidence, staff and vendors. Oftentimes Bill serves as "whispering" expert at meet-and-confers, depositions, and burdenrelated hearings. Bill has consulted (4000+ hours) to the trustee of the Bernie Madoff estates, the largest Ponzi scheme in history. Prior to opening his consultancy in 1989, Bill and his wife backpacked around-the-world.
