2 OUR GUEST SPEAKERS Carol A. Hyde, Esq. Carol currently serves as the Managing Partner of Iseman, Cunningham, Riester & Hyde, LLP. She practices primarily in the areas of health care law and business transactions. She has counseled a variety of health carerelated clients, including hospitals, nursing homes, diagnostic and treatment centers, drug and alcohol treatment centers, hospices, independent practice associations, third-party administrators, and private physicians and practitioners with respect to a full range of issues such as corporate and regulatory compliance, reimbursement, negotiation of contracts, employment and employee benefits, and real estate matters. Carol has substantial experience in the development of health care facilities and their financing. She also represents not-for-profit organizations and closely held businesses outside the health care field. Carol has lectured on a wide range of topics, including contracting with physicians, the "Stark" law and fraud and abuse, confidentiality of medical records, advance directives, tax-exempt organizations, violence in the workplace, powers of attorney, and charitable giving for various organizations, including the New York State Bar Association, the Hospital Education and Research Fund of the Healthcare Association of New York State, The Community Foundation for the Capital Region, and the New York State Ambulatory Health Care Association. Carol holds a juris doctor degree from Albany Law School. She is a member of the American Health Lawyers Association, the New York State Bar Association, and the Albany County Bar Association. Marcia B. Smith, Esq. Marcia is a partner at Iseman, Cunningham, Riester & Hyde, LLP. She joined ICRH in 1998 and practices primarily in the health care area. She handles regulatory and transactional matters for a wide range of clients, including health care systems, hospitals, physicians, and insurers. Marcia has significant experience in the areas of not-for-profit corporation law, corporate compliance, tax-exempt financing, Medicare and Medicaid billing, and tax exemption. She assists health care providers in structuring joint ventures, business transactions, and acquisitions that comply with the evolving health care regulatory environment. Marcia is an officer of the Health Law Section of the New York State Bar Association. She is a contributor to the Health Law Section's blog, Supraspinatus, and is the co-author of the blog Health Care Integration Advisors, Marcia has lectured to health care providers on numerous topics, including fraud and abuse, not-for-profit regulation, and HIPAA. She is also a member of the American Health Lawyers Association and the Albany County Bar Association. Before earning her juris doctor degree from Albany Law School, Marcia served as an officer in the United States Navy. She then worked as a research associate at a federally funded research and development center and as a program analyst for the U.S. Department of Energy. Michael W. Deyo, Esq. Mike is an associate with Iseman, Cunningham, Riester & Hyde, LLP. Mike practices primarily in the areas of litigation and health care, with particular emphasis in the field of electronic discovery (ediscovery). Mike also draws upon his information technology (IT) background in counseling clients on matters involving IT security and data privacy compliance, computer forensics, electronic records management, and ediscovery planning and program development. Mike is currently an adjunct faculty member of the Albany Law School and the Western New England College of Law, where he teaches ediscovery courses. He has lectured on the topic of ediscovery for numerous 2
3 organizations, including various New York State agencies; the Association of the Bar of the City of New York; the New York County Lawyers' Association; the bar associations for the counties of Albany, Westchester, Nassau and Oneida; and the North Carolina State Bar Association. Mike was also a featured instructor at the New York State Cyber Security Conference in 2003, 2004 and 2007, and a lecturer at the New York City Law Enforcement Bridge Project in 2002 and the High Technology Crime Investigation Association annual conference. Before entering law school, Mike worked as an information security and computer forensics specialist with a national consulting firm. In this role Mike performed and managed IT security assessments, security policy and procedure development, risk and compliance assessments, forensic investigations, and data privacy assessments for major corporate and government clients, including Fortune 500 and Federal agency clients. After law school, and before joining ICRH, Mike continued to serve in the same firm as Director of the ediscovery and Computer Forensics practice. In this role Mike managed all aspects of the firm's ediscovery consulting operations. Mike is a member of the New York State Bar Association (Committee on Electronic Discovery, Commercial and Federal Litigation Section), the Albany County Bar Association, the Economic Crime Investigation Institute, and the International Association of Privacy Professionals. Mike received his law degree from Albany Law School. JUNE CRAWFORD, RN, BSOM Manager (jcrawford@bonadio.com) June is a Manager in the Healthcare Compliance Solutions Division at The Bonadio Group. She is a Registered Professional Nurse with more than 25 years of supervisory experience in acute and long-term care settings, and home health care. For fifteen years, June held the positions of Director of Nursing Services, Director of Residential Services, and Director of Continuous Improvement with a large not-for-profit agency in the field of Mental Retardation and Developmental Disabilities. In addition to her clinical background, June holds a Bachelor of Science Degree in Organizational Management. She has extensive experience in organizational management including strategic planning, regulatory compliance, Medicaid compliance, wage and salary review, administrative investigations, performance management, team building, continuous quality improvement, incident management, budget management, corporate compliance, HIPAA implementation, and policy development. June s expertise in the health and human service sectors has provided her with the ability to transfer that knowledge and experience to providers of Medicaid-funded programs in the areas of developmental disabilities, behavioral health, clinics, home health, long term care, and schoolbased services. June has received certification in MDS, OMRDD Abuse, Death and Administrative Investigations and serves as a member of the NYS OMIG Advisory Committee and NYS Surrogate Decision Making Committee. She is a member of NYS Association of Community and Residential Administrators (NYSACRA), New York State Rehabilitation Association (NYSRA), and Healthcare Financial Management Association (HFMA), is active in hospice, and serves as a Board Member of several non-profit organizations. 3
