1 SOUTH BOUND BROOK BOROUGH COUNCIL REGULAR MEETING MINUTES Minutes of the Regular Meeting of the Mayor and Borough Council held on at Council Chambers, 12 Main St., South Bound Brook, NJ The meeting was called to order at 7:30 PM with a reading of the Open Public Meetings Law Statement by Council President Dennis Quinlan, the Pledge of Allegiance and an Invocation by the Borough Clerk. Roll Call: Mayor Tamas Ormosi Council President Dennis Quinlan Councilperson Caryl Shoffner Councilperson August Carlton Councilperson Bruce Blumenthal Councilperson Anthony Timpano (Absent) Arrived 7:44 PM (Absent) Attending: Borough Attorney: Frank Taddeo Borough Engineer: Thomas Herits Chief of Police: William King Letters and Communications: - Letter from the South Bound Brook Republican Committee submitting three names for consideration to fill the vacant Council seat. Approval of the Minutes: - Motion by Councilperson Quinlan for approval of the July Meeting Minutes, seconded by Councilperson Carlton, discussion. All in favor, all ayes. Council Reports: Finance/Historical Committee (Councilperson Quinlan): - Claims Voucher Resolution Payment of the Bills Motion by Councilperson Quinlan for approval of Claims Voucher Resolution in the amount of $302,734.46, seconded by Councilperson Shoffner, discussion. 2 - Borough Clerk asked the Council members to review the Financial Plan from the Auditors. No action is needed. - Councilperson Quinlan reported on meeting with the D&R Canal Commission. Councilperson Shoffner asked if there was any discussion about a boat launch at Barber Blvd. Personnel/Recreation/Board of Health (Councilperson Carlton): - Met with Councilperson Quinlan and the Judge concerning the Deputy Court Administrator position. - Attended Recreation Committee (Sports) Meeting Soccer is in full bloom. Will be meeting with Social Committee at the end of the month. Public Safety Police Department/Rescue Squad (Councilperson Timpano): - Rescue Squad No Monthly Report submitted. - Police Department Monthly Report for July 543 total dockets, 21 Squad calls, 9 Fire Dept. calls, 34 arrests. Overtime for July $13, (97.5 hrs.); Court Related Overtime $2, (34.4 hrs.); YTD OT $55,910.07; Court Related YTD OT $12, (210 hrs.). - Received a letter from the Chief King requesting replacement of a 2008 patrol car with 115,000 miles and in need repairs. After discussing this item a Motion was made by Councilperson Timpano to authorize the leasing of a 2016 patrol car for the South Bound Brook Police Department, seconded by Councilperson Carlton, discussion. Councilperson Shoffner asked about the status of the lease for the Public Works truck. This will be discussed at another time. Roll call vote taken, all ayes. Mayor arrives (7:44 PM). Public Safety Fire Department (Councilperson Shoffner): - Fire Department Monthly Report for July submitted: Alarms answered, 7; total man hrs. answering alarms, 36.7; total man hrs. maintenance of trucks and equipment, 15; total man hrs. Department Training, 132; total man hrs. Board of Engineers Meeting, 12; total man hrs. Captain s Administrative duties, 32. Total man hrs. for July Fire Company came to the Park Program also participated in South Bound Brook s National Night Out observance. - The siren repairs are close to completion. The wires on the siren on Maple Avenue shorted out and repairs on that should be made soon. - Fire Inspector the State is threatening to take over if a Fire Inspector is not appointed by the Borough. Borough Clerk suggested hiring a temporary Fire Official. After discussing this issue a Motion was made by Councilperson Quinlan to hire Tim Coyle for the position of temporary Fire Official at a salary Page 2

3 of $32.00 per hour for 60 days, seconded by Councilperson Carlton, discussion. Councilperson Shoffner asked if the Fire Department will be able to make recommendations. Answer, yes. Roll call vote taken, all ayes. - The exhaust system is waiting for a part before it can be operational. - Community has reached out and asked for mutual aid. - 4 people are ready for Firefighter #1. - A bus has been donated for extrication training. Mayor s Report: - Proclamation - Read Proclamation supporting the Drive Sober or Get Pulled Over 2015 Statewide Crackdown from Aug. 21, 2015 through Sept. 7, Spoke about walking on Main Street in the mornings and thinks Public Works is doing a good job keeping Main Street looking good. Borough Attorney Report: - Nothing to report. Chief of Police Report: - Preparing for the Carnival the last week of August. Borough Engineer Report: - 27 Barber Blvd. Fire Department able to do some training before the demolition. - Sewer charges are down this quarter. - DOT applications are due October 16 th. Need to decide which projects to submit for consideration. Borough Clerk Report: - Tax Bills were mailed July 22 nd. Grace period needs to be extended. Motion by Councilperson Quinlan to extend the grace period, for payment of taxes, to August 25, 2015, seconded by Councilperson Carlton, discussion. All in favor, all ayes. - Coded Systems gave an estimate of $14, for codification of Borough Ordinances. It will be electronically done along with printed books. Further discussion and Energency Resolution will be done at the September Meeting. - As discussed, three names were submitted for the vacancy on Council. Kathryn Kelly was chosen to fill the unexpired term. Motion by Councilperson Quinlan to appoint Kathryn Kelly to fill the unexpired term, seconded by Councilperson Timpano, discussion. Roll call vote taken, all ayes. Ms. Kelly is sworn in by the Borough Clerk and takes her seat at the Council Table. Page 3

4 - Letter received from Herb Lauterwald concerning a sewer hookup on Edgewood Terrace. There is no indication of where the hookup will be. This will be put on the September Agenda. - Regular meeting schedule will resume in September. Agenda Meeting is September 1 st and Regular Meeting is September 8 th. Motion by Councilperson Quinlan to open the meeting to the public, seconded by Councilperson Carlton, all in favor, all ayes. Marianne Manley Prospect Street - Spoke about Family Dollar. She wanted to know why the building is up for sale. Borough Clerk explained that the developer owns the building and Family Dollar is leasing it. So the developer can sell the property knowing that Family Dollar has a 15 year lease. Bill Schubert Von Steuben Lane - Spoke about overnight parking on Borough Streets. He said that it is becoming a real problem and would like the Council to consider bringing back No Overnight Parking on Borough Streets. The Council will have the Police Committee take a look into this and make recommendations to the Council. - Spoke about Canal boat rides and how that would impact parking on Barber Blvd. Councilperson Timpano asked if he could address Ms. Manley s question about the Family Dollar building. He said that the building is sold with Family Dollar leasing for 15 years with options for another 30 years. Family Dollar does not own the building. Patrick Smith - Inquired about an inspection for a water heater. Said he never got a call back. Mrs. Fischer took his name and number and will contact him with a time and date for an inspection. Motion by Councilperson Carlton to close the meeting to the public, seconded by Councilperson Timpano, all in favor, all ayes. Agenda: Ordinance Bond Ordinance (Second Reading): Motion by Councilperson Quinlan for approval of Ordinance an ORDINANCE FOR VARIOUS CAPITAL IMPROVEMENTS AND RELATED EXPENSES IN AND FOR THE BOROUGH OF SOUTH BOUND BROOK AND APPROPRIATING $700, THEREFORE AND PROVIDING FOR THE ISSUANCE OF $665, IN BONDS OR NOTES OF THE BOROUGH OF SOUTH BOUND BROOK TO FINANCE THE SAME, seconded by Councilperson Shoffner. 5 Motion by Councilperson Quinlan to open the meeting for public hearing on this Ordinance, seconded by Councilperson Timpano, all in favor, all ayes. Kathy Conner asked for the list of Capital Improvements. Councilperson Quinlan read her the specific items. Motion by Councilperson Quinlan to close the public hearing, seconded by Councilperson Carlton, all in favor, all ayes. Discussion. There was no further discussion. Roll call vote taken, 4 ayes and 1 abstention (Councilperson Kelly). County ID System Agreement: Motion by Councilperson Timpano for adoption of a Memorandum of Understanding among the County of Somerset and the Borough of South Bound Brook concerning the credentialing (issuing ID cards) for First Responders, seconded by Councilperson Quinlan, all in favor, all ayes. At this time the Mayor spoke about charging foreclosed properties a registration fee. We would then have a listing of foreclosed properties in town. Towns are charging up to $1, for listing the foreclosed properties. Borough Attorney will look for a sample ordinance. Retirement: Borough Clerk Donald Kazar read his letter of retirement, effective Oct. 2, He thanked the Mayor and Council, past and present, for being able to serve them and the residents of South Bound Brook. He will move on, try new things and spend more time with his family. He has served the town for 30 years. Council President Quinlan regretfully accepted his letter of retirement and thanked him for all he has done for the Borough. Mayor thanked Donald for his years of service to the Borough. Motion by Councilperson Carlton to open the meeting to the public, seconded by Councilperson Timpano, all in favor, all ayes. Kathy Conner Louis Avenue - Thanked Donald for his years of service to the Borough and wished him well. She also asked if a list of foreclosures is done would it be available to the public. Mayor said yes. Jo-Anne Schubert Von Steuben Lane - Thanked Donald for the years of service and friendship. Bill Schubert Von Steuben Lane - Spoke about their grass agreement. Page 5

6 Motion by Councilperson Quinlan to close the meeting to the public, seconded by Councilperson Timpano, all in favor, all ayes. Executive Session Resolution: Borough Clerk read the Executive Session Resolution and a Motion was made by Councilperson Shoffner to go to Executive Session to discuss pending litigation, seconded by Councilperson Timpano, all in favor, all ayes. (9:05 PM) Motion by Councilperson Quinlan to return to Regular Session, seconded by Councilperson Carlton, all in favor, all ayes. (9:30 PM) No action is required.
