3 II. ALLEGATION(S) The ceiling is falling in from water damage that occurred when the roof leaked over the winter. A large picture window in the back of the house looks like the frame is cracked. The bathroom is missing half the ceiling and is moldy from the water damage. The basement has three inches of water. Violation Established? Yes III. INVESTIGATION: On 5/14/20914, I made an unannounced inspection at the child care home of Jerrica Warner. Ms. Warner was home, and no child care children were present. Ms. Warner and I talked about the roof damage that occurred last February when there was a snow and ice buildup that caused the leak in the living room ceiling and kitchen subfloor. She said that the roof had been patched and the living room ceiling was no longer leaking, but the subfloor in the kitchen continued to be a problem. Ms. Warner stated that there had been some disagreements with the 2

4 home owner regarding who was responsible for the repairs, and she was going to be moving on or about 6/15/2014. She said she was working hard to keep the child care use space clean and hazard free until then. We toured the house and Ms. Warner showed me where water has been leaking from the roof down between the interior and exterior wall into the kitchen subfloor causing the vinyl tiles to buckle. She had taped over any seams that were starting to come undone to prevent children from tripping on a loose tile. We looked at the living room ceiling which appeared the same as it did when I saw it in February There was a spot of missing plaster for about two-feet along a seam near the stairs to the basement. The ceiling was dry to the touch and it didn t appear that any additional plaster or ceiling structure was in danger of falling on children. We had to move a couch to get to the picture window in the living room. The window frame was wet to the touch and rotted for about six inches along the bottom of the lower left corner. I pushed on the window and it appeared to be firmly in place and in no danger of falling either in or out. Ms. Warner and I also checked the basement (not an approved child care use space). I could see a small amount of wetness on some lower trim and the bottom of one door, but the floor was clean and dry on the day of the inspection. I inspected both bathrooms and saw no sign of ceiling damage in either bathroom. Overall, the house was clean and there was no smell of mold or mildew. APPLICABLE RULE R Home maintenance and safety. (1) The structure, premises, and furnishings of a child care home shall be in good repair and maintained in a clean, safe, and comfortable condition. ANALYSIS: CONCLUSION: The kitchen sub-floor was buckling, the living room ceiling had damaged plaster and the lower left corner of the picture window had wet and rotted wood. VIOLATION ESTABLISHED 3
