The corrective action plan is due 15 days from the date of this letter and must include the following: How compliance with each rule will be achieved. Who is directly responsible for implementing the corrective action for each violation. Specific time frames for each violation as to when the correction will be completed or implemented. How continuing compliance will be maintained once compliance is achieved. The signature of the responsible party and a date. Upon receipt of an acceptable corrective action plan, a regular license will be issued. If you fail to submit an acceptable corrective action plan, disciplinary action will result. DESCRIPTION OF FINDINGS & CONCLUSIONS This renewal inspection involved a review of all applicable child care home administrative rules and statutes. Verification of compliance included direct observations of the physical environment and the program, discussions with staff, and a review of the home s records, including staff records and children s records. 2

5 Staff records include background checks, medical clearance information, and training information. Children s records include child information cards and child in care statements/receipts. During the inspection, the child care home was found to be in compliance with all applicable rules and statutes except for the following violations: R Caregiver Responsibilities. (1) A caregiver shall be responsible for all of the following provisions: (e) Maintain a record of the dates of caregiver absences. These records shall be maintained for a minimum of 4 years. Mrs. Baazov does not maintain a record of the dates of her absences from the child care home. R Caregiver Responsibilities. (1) A caregiver shall be responsible for all of the following provisions: (f) Have a written and signed agreement with a responsible person who is 18 years of age or older to provide care and supervision for children during an emergency situation. Mrs. Baazov does not have a written and signed agreement with a person 18 years of age or older to provide care and supervision for children during an emergency situation. R Caregiver responsibilities. (8) The caregiver shall do both of the following: (b) Conspicuously post on the premises a notice stating that smoking is prohibited on the premises during child care hours. There was not a no smoking sign posted. R Assistant caregivers. (1) An assistant caregiver shall meet all of the following requirements: (c) Have proof of valid infant/child/adult CPR, first aid, and blood-borne pathogen training within 90 days of hire. 3

6 Mrs. Baazov indicated that she uses her husband and daughter on occasion as a backup caregiver. All caregivers except for emergency caregivers must meet all assistant caregiver rules. Two of the three assistant caregivers did not have proof of valid infant/child/and adult CPR, first aid, or blood-borne pathogens. R Records of caregiving staff and child care home family; record maintenance. (1) The caregiver shall maintain a file for the caregiver and each assistant caregiver including all of the following: (b) A statement signed by a licensed physician or his or her designee and which attests to the individual's mental and physical health. (i) For the caregiver, within 1 year before issuance of the certificate of registration or initial license and at the time of subsequent renewals. (ii) For the assistant caregivers, within 1 year prior to caring for children and at the time of subsequent renewals. Two out of three assistant caregivers did not have a signed physician s statement on file. R Records of caregiving staff and child care home family; record maintenance. (1) The caregiver shall maintain a file for the caregiver and each assistant caregiver including all of the following: (d) Training records, as defined in R (5). Two of three assistant caregivers did not have training records on file. R Records of caregiving staff and child care home family; record maintenance. (1) The caregiver shall maintain a file for the caregiver and each assistant caregiver including all of the following: (e) A statement signed by each assistant caregiver that he or she has not been convicted of either of the following: (i) Child abuse or child neglect. (ii) A felony involving harm or threatened harm to an individual within the 10 years immediately preceding the date of hire. 4

7 Two of three assistant caregivers did not have the above-required signed statements on file. R Records of caregiving staff and child care home family; record maintenance. (2) Child care home family members 14 years of age or older shall have written evidence of freedom from communicable TB. Two household members over 14 years of age did not have written evidence of freedom from communicable TB. R Children's records. (2) Records in subrule (1) of this rule shall be reviewed and updated annually or when information changes. Child in care statements and child information cards were not updated annually as required. R Supervision. (1) The caregiver shall assure appropriate care and supervision of children at all times. Upon my arrival at the child care home, Mrs. Baazov had 8 child care children present. She indicated that her daughter and husband were home and that her daughter was acting as an assistant caregiver. Neither her husband nor her daughter was providing supervision for children when I arrived. I provided technical assistance on this rule at the time of the inspection. Any time more than six children are present, an assistant caregiver must be providing direct care and supervision of children. R Discipline and child handling. (2) Developmentally appropriate positive methods of discipline which encourage self-control, self-direction, self-esteem, and cooperation shall be used. 5

8 Mrs. Baazov s written discipline policy included the use of time out but did not specify for what ages of children time out is used. She verbally indicated that time out is used for children ages two and over. Time out is not considered developmentally appropriate for children until they are three years old. Technical assistance materials were enclosed with this report. R Indoor space; play equipment and materials. (4) The caregiver shall not use any equipment, materials, and furnishings recalled or identified by the U.S. Consumer Product Safety Commission ( as being hazardous. As required by 2000 PA 219, MCL , the caregiver shall conspicuously post in the child care home an updated copy of the list of unsafe children's products that is provided by the department. The list of recalled items was not posted. R Diapering and toilet learning. (2) The designated changing area shall comply with all of the following: (d) Have a nonabsorbent, easily sanitized surface with a changing pad between the child and the surface. The diaper pad was ripped and was therefore no longer nonabsorbent and easily sanitized. R Home maintenance and safety. (2) All dangerous and hazardous materials or items shall be stored securely and out of the reach of children. Dangerous and hazardous items were accessible to children. In the kitchen, boxes with sharp edges, plastic bags, and cleaning products were located in drawers and cabinets accessible to children. On the dining room table, a prescription medication bottle was accessible to children. R Electrical service; maintenance. (2) All electrical outlets, including outlets on multiple outlet devices, accessible to children shall have safety covers. 6

9 Electrical outlets in bedrooms, the playroom, and dining room did not have safety covers. R Fire; tornado; serious accident and injury plans. (1) A written plan for the care of children shall be established and posted for each of the following emergencies: (c) Serious accident or injury. There were no written plans for serious accident or injury emergencies. IV.
