2 Allerhand Summit: Inso & Restructuring Law 2012 is the event that will initiate the forthcoming series of annual meetings dedicated to diverse aspects of insolvency and restructuring law The Allerhand Institute has been an organizer of conferences on insolvency issues since Its greatest event to date was the INSO FORUM (Insolvency Law Summit), a forum that has become the primary venue for the exchange of findings and opinions between specialists in the areas of insolvency, economics and management. The issues of insolvency law, which were initiated there, are still in need of further discussion and revision so they can be utilised as indicators of the present situation in Poland as well as contribute to the drawing up of measures on how to improve the national position. The integration of specialists from the field of insolvency law will be within the scope of this year s Allerhand Summit since the Allerhand Institute wishes to create a learning environment for the specialisms of law and economics, and insolvency and restructuring to convene.

3 This year the number of declared bankruptcies, even among so called big enterprises, has been increasing. After 3 years of the existence of the formalized institution of consumer insolvency, we are sufficiently prepared to make improvements to its operation. Another controversial problem is the regulation of an amendment implementing the developer insolvency. An increase in main developers insolvency resulted in a rapidly conducted legislative project whose legitimacy seems to be doubted. Furthermore, the dramatic economic situation in Europe triggers a debate over transborder insolvency, or even the insolvency of the country itself. European acts impose on Poland an obligation of adjusting the binding law to new regulations, which in consequence affects the abovementioned insolvency law. The Polish Ministry of Justice has already appointed a team of experts whose main purpose is to draw up principles to amend it. This move only confirms the importance of these issues. The new regulations are alleged to be ready by the end of the year, but a prior multifaceted discussion ending with practical proposals appears to be useful for the final reading.
