4 This section aims to help you to quickly understand what the EU rule is and what is required from you as a customer in order to ensure compliance What is the EU Customs Advanced Manifest Rule? The rule aims to ensure that security risk assessment is performed before any goods enter the EU. All ocean carriers are therefore required by EU Customs to submit cargo declaration called Entry Summary Declaration (ENS) - 24 hrs before cargo is loaded onboard a vessel that will enter any of the EU countries. Rule will be enforced as of 1 st January Meaning that all cargo that is loaded by January the 1st onboard a vessel that will enter the EU is subject to this rule. What is the Entry Summary Declaration ENS? It is the cargo declaration submitted to EU customs. It is not a format or template as such, but the information submitted to EU customs. Which cargo is subject to ENS? ENS is required for all cargo destined to the EU, to be transshipped at EU ports, in-transit via EU port to a non-eu destination and freight remaining onboard a vessel that will call an EU port. o How this rule affects me? You should provide us with accurate and complete shipping instructions within the established deadlines as this will enable us to comply with the rule without any impact to your shipment. What is an EORI? EORI stands for Economic Operators Registration and Identification number. It is different from a VAT or a Tax Maersk Line therefore requires Shipping Instructions reference number. 5 What do I need to do as a customer? Provide complete and timely Shipping Instructions to us and ensure that they are as accurate as possible In order for us to be able to submit the cargo declaration to EU customs timely on your behalf, so as to ensure the whole shipment process is smooth, we would require you to submit timely, accurate and complete Shipping Instructions in accordance to the deadlines provided. Inaccurate and/or incomplete data may compromise the cargo manifest submission which may cause cargo not to be approved for loading or to be placed on hold at port of entry/ discharge in the EU. What are the Shipping Instructions elements required? Shipper s Name, Address & Contact Details Consignee s Name, Address, Contact Details and their EORI number (if possible) Notify Party if different from Consignee s (mandatory for To Order Bills of Lading) Commodity Description (with EU HS4 / HS6 codes or acceptable goods description that is based on EU guidelines*) Type and number of packages Container Number with Seal Number (if possible) Gross Weight (in KGs) UN code for dangerous goods Shipping Marks for packaged goods (not necessary for containerized goods) Terms of Payment

8 ENS non-compliance? What happens if there is a non-compliance of ENS or the ENS is missing? The consequence of non-compliance (or a missing ENS submission) would be halting of loading or unloading. Customs will electronically let Maersk Line know if there are any risks identified with cargo scheduled to arrive in the EU. Risk types and their consequence: - Risk type A: Do not load - Risk type B: Hold at entry port - Risk type C: Hold at discharge port
