2 Current air quality related conditions used by the pollution Control Team: AQ1: Air Quality Assessment (Major) AQ2: Air Quality Assessment (Minor) AQ3: Air Quality Monitoring AQ4: Energy Efficiency AQ5.1: Boiler Emissions for Larger Developments AQ5.2 Boiler Emissions for Smaller Developments AQ6: Combined Heat and Power AQ7: Renewable and Low Energy Sources AQ8: Green walls/roofs AQ9: Electric Charging Point AQ10: Car Hire Scheme AQ11: Application of dust suppressants AQ1: Air Quality Assessment (Major) Part A: No development will commence until an air quality assessment for larger developments, produced in line with any guidance provided by the Council and other best practice guidance, has been produced to the satisfaction of and approved in writing by the Planning Authority. The air quality assessment will: Identify how the building works and related activities and the future operation and use of the development may impact upon local air quality. Model the impact of the development on local air quality. Identify mitigation measures that are already part of any planned development. Identify possible additional mitigation measures that may be implemented to maintain and where possible improve air quality in the vicinity of the development. Provide full details of measures that will be implemented to maintain and where possible improve air quality in the vicinity of the development. Provide full details of measures that will be implemented to protect the internal air quality of buildings. Identify measures that will be implemented or continue to be implemented after the completion of the development with clear timescales of when information will be provided. Part B: All measures identified within the approved air quality assessment that are to be installed during the course of the development will be fully implemented. No occupation will take place until a report demonstrating that each measure is fully implemented has been provided to the satisfaction of and approved in writing by the Planning Authority. Part C: All measure identified within the approved air quality assessment that will be implemented or continue to be implemented after the completion of the development will be completed within agreed timescales. A report demonstrating that all such measures set out within the approved air quality assessment have been installed will be provided to the satisfaction of and approved in writing by the Planning Authority. AQ2: Air Quality Assessment (Minor)
3 Part A: No development will commence until an air quality assessment for smaller developments, produced in line with any guidance provided by the Council and best practice guidance, has been provided to the satisfaction of and approved in writing by the Planning Authority. The air quality assessment will identify how building work may impact upon local air quality and set out measures to mitigate these impacts. Part B: Measures included within the approved air quality assessment will be fully implemented. No occupation will take place until a report demonstrating that each measure is fully implemented has been provided to the satisfaction of and approved in writing by the Planning Authority. If the development is found to be resulting in an exceedence or significant further exceedence of a National air quality objective or standard development work will cease immediately and will not recommence until air quality levels have been returned to normal background levels. A significant further exceedance is considered to be an increase in the concentration of a pollutant by over 10% of the immediate local background concentration for any duration. AQ3: Air Quality Monitoring Part A: Due to the potential for development works to result in an exceedance or further exceedances of a National air quality objective or standard no development will commence until the details of an air quality monitoring programme to be undertaken during the course of the development have been provided to the satisfaction of and approved in writing by the Planning Authority. The monitoring programme will identify: Air quality levels that will not be exceeded during the course of the developemnt. Potential sources of air pollution associated with the development and how they may impact upon local air quality. The type(s) and optimal positions of monitoring equipment and the duration of monitoring. Set out actions that will be taken if the agreed air quality levels are exceeded and the contents of reporting that will be provided were an exceedance occurs. Part B: The agreed air quality monitoring programme will be implemented. Where agreed air quality levels are exceeded development work will cease immediately and will not recommence until air quality levels have been returned to below the agreed standard. An exceedance of an agreed air quality level will be reported to the Planning Authority and the Council s air quality officer within an hour of it being detected. Within five days of each identified exceedance a report will be provided to the Planning Authority providing full details of the exceedances, full details of any actions that were taken to return pollutant levels to below agreed levels and measures that will be put in place to ensure that further exceedances do not occur. Where exceedances occur on more than three occasions as a direct result of the development works and associated activities the works that are resulting in the exceedence will cease and will only recommence once actions to prevent future exceedances have been provided to the satisfaction of and approved in writing by the Planning Authority. Subject to written approval by the Planning Authority this condition may be discharged in agreed phases.
4 AQ4: Energy Efficiency [currently being developed] AQ5: Boiler Emissions AQ5.1 larger developments Part A: Before installation the details of non-chp space and hot water heating systems to be installed will be provided to the Planning Authority. For space and hot water heating systems incorporating a fossil fuel (or equivalent hydrocarbon based fuel) fired boiler the main information to be provided by developers as set out within the appropriate BREEAM scheme and any Council guidance will be provided to the satisfaction of and approved in writing by the Planning Authority before installation. Any fossil fuel (or equivalent hydrocarbon based fuel) fired boiler in the development must achieve dry NOx emission levels equivalent to or less than 40 mg/kwh. Any CHP or other similar systems must be dealt with as part of an air quality assessment. Part B: The agreed fossil fuel (or equivalent hydrocarbon based fuel) fired space and hot water heating system will be installed. Following installation evidence that the agreed boiler(s) has been installed will be provided to the satisfaction of and approved in writing by the Planning Authority before occupation. Subject to written approval by the Planning Authority this condition may be discharged in agreed phases. AQ5.2 small developments and refurbishments All non-chp space and hot water fossil fuel (or equivalent hydrocarbon based fuel) boilers must achieve dry NOx emission levels equivalent to or less than 40 mg/kwh. Any existing boilers that do not meet this emission level must be replaced. Evidence to demonstrate that every installed boiler meets this standard will be provided to the satisfaction of and approved in writing by the Planning Authority before occupation. Subject to written approval by the Planning Authority this condition may be discharged in agreed phases. Any CHP or other similar systems must be dealt with as part of an air quality assessment. AQ6: Combined Heat and Power [currently being developed] AQ7: Renewable and low energy sources Part A: Before commencement of development a feasibility study identifying the maximum potential to incorporate renewable and low emission energy sources in to the development will be provided to the satisfaction of and approved in writing by the Planning Authority. The feasibility study will be provided in line with the appropriate BREEAM scheme and any other guidance identified by the Council. Based on the feasibility study full details of renewable and low emission energy technologies that will be incorporated in to the development will be
5 agreed with and provided to the satisfaction of and approved in writing by the Planning Authority before development commences. Part B: Before occupation evidence that the approved renewable and low emission energy technologies have been fitted will be provided to the satisfaction of and approved in writing by the Planning Authority. Subject to written approval by the Planning Authority this condition may be discharged in agreed phases. AQ8: Green walls/roofs AQ9: Electric Charging Point AQ10: Car hire scheme AQ11: Application of dust suppressants On each day of site works that may result in the re-suspension of particulate matter (i.e. dust) CFA dust suppressants will be applied to ground surfaces of the development site where work is taking place before any building works commence or vehicles enter the site, midmorning and early in the afternoon. CFA dust suppressants must be applied wherever the ground may be disturbed, over all works areas, site roads or areas where site machinery may go. When the ground surface is dry CFA dust suppressants must be applied over all areas of exposed soil. CFA dust suppressants do not need to be applied during wet weather when the re-suspension of dust is unlikely. the maintenance or to prevent further exceedances of National Air Quality Objectives.
