1 PERMIT TO OPERATE A CONCRETE BATCHING PLANT THE POLLUTION, PREVENTION AND CONTROL ACT 1999 THE POLLUTION, PREVENTION AND CONTROL (ENGLAND AND WALES) REGULATIONS 2000 (AS AMENDED). 2 DESCRIPTION OF PROCESS Process for batching concrete as prescribed by the Pollution, Prevention and Control (England and Wales) Regulations (as Amended) utilising a second-hand batching plant consisting of:- 3 x aggregate storage bins of 10 tonne capacity complete with weigh conveyor and delivery conveyor. 1 x cement silo of approximately 30 tonne capacity complete with 24m 3 reverse jet filter, emergency pressure/vacuum relief valve and audible/visual high level alarm (comprising of alarm sounder and external lights) 1 x butterfly valve feeding cement weigh hopper. 1 x weighed cement hopper fed by gravity into mixer. 1 x water storage tank complete with associated valves and meters. 1 x static pan concrete mixer PEMAT of 1m 3 output capacity totally enclosed. 3 x 3 sided aggregate storage bays with 3m height walls Dormant Plant The plant formerly operated by Hanson Aggregates shall remain dormant as the permit held by the operater has been revoked. This plant lies within the site that is Fosseway Environmental park but shall not be operated as part of the activity defined by this permit. The site boundary of the installation is outlined in Annex A. Page 2 of 10

3 Introductory note This introductory note does not form a part of the Permit Confidentiality The Permit requires the Operator to provide information to Bath & North East Somerset Council. The Council will place the information onto the public registers in accordance with the requirements of the EP Regulations. If the Operator considers that any information provided is commercially confidential, it may apply to Bath & North East Somerset Council to have such information withheld from the register as provided in the EP Regulations. To enable Bath & North East Somerset Council to determine whether the information is commercially confidential, the Operator should clearly identify the information in question and should specify clear and precise reasons. Changes to the Operation If the operator proposes to make a change in operation of the installation, he must, at least 14 days before making the change, notify the regulator in writing. The notification must contain a description of the proposed change in operation. It is not necessary to make such a notification if an application to vary this permit has been made and the application contains a description of the proposed change. In this condition change in operation means a change in the nature or functioning, or an extension, of the installation, which may have consequences for the environment. Variations to the permit This Permit may be varied in the future. If at any time the activity or any aspect of the activity regulated by the following conditions changes such that the conditions no longer reflect the activity and require alteration, then an application form providing these details shall be submitted to the Regulator. Please contact the regulator for an application to vary the permit conditions. Surrender of the permit Where an Operator intends to cease the operation of an installation (in whole or in part), then an application form providing these details shall be submitted to the Regulator. Please contact the regulator for an application to surrender the permit. Transfer of the permit or part of the permit Before the Permit can be wholly or partially transferred to another person, a joint application to transfer the Permit has to be made by both the existing and proposed holders, in accordance with Regulation 21 of the EP Regulations. A transfer will be allowed unless the Authority considers that the proposed holder will not be the person who will have control over the operation of the installation or will not ensure compliance with the conditions of the transferred Permit. Responsibility under workplace health and safety legislation This Permit is given in relation to the requirements of the PPC regulations. It must not be taken to replace any responsibilities you may have under Workplace Health and Safety legislation. Page 3 of 10

4 Appeal against permit conditions Anyone who is aggrieved by the conditions attached to a Permit can appeal to the Secretary of State for the Environment, Food and Rural Affairs. Appeals must be made in accordance with the requirements of Regulation 31 of the EP regulations. Appeals should be received by the Secretary of State for Environment, Food and Rural Affairs. In determining an appeal against one or more conditions, the Act allows the Secretary of State in addition to quash any of the other conditions not subject to the appeal and to direct the local authority either to vary any of these other conditions or to add new conditions. Relevant Process Guidance Note PG 3/1 (04) Planning Permission This Permit does not give planning permission for the process authorised, nor does it imply that planning permission will be granted or that action will not be taken against breaches of planning law. Fees A fee is required for changes to the permit such as when an application is made for a variation because of a substantial change, for surrender or transfer of the permit to another operator. The current costs are available from the Council. Annual Fee The subsistence fee is due on 1 April each year, an invoice will be sent to you from the Council, the fees are set by central government and are reviewed annually. 5 POTENTIAL RELEASES The key emissions from this type of process that warrant control are those consisting of particulate matter, and include:- Handling, loading and unloading processes. Transfer of potential dusty materials including discharge into hoppers and onto conveyors, and delivery to storage silos. Roadways including the surface of the site, if dry. Page 5 of 10

6 CONDITIONS Emission limits, monitoring and other requirements 1. All releases to air, other than steam or condensed water vapour, shall be free from droplets and from persistent visible emissions. 2. Visual assessments of emissions should be made frequently, and at least once per day during operations. The time, location and result of these assessments should be recorded in accordance with condition As part of your visual assessment you should ensure that no airborne dust emissions are visible across the site boundary as delineated in Annex A. 4. The reverse jet exhaust filters should be inspected at least once a month. 5. In the case of abnormal emissions, malfunction or breakdown leading to abnormal emissions the operator should:- Investigate and undertake remedial action immediately; Adjust the process or activity to minimise those emissions; and Promptly record the events and actions taken. 6. The local authority should be informed without delay:- If there is an emission that is likely to have an effect on the local community or In event of the failure of key abatement plant such as the reverse-jet filters. 7. Where arrestment plant is designed to meet a specific emission limit, the specification should be made available for inspection by the local authority. The plant thereafter should be maintained to meet this specification. 8. The high and low level alarms fitted shall be maintained in working order and utilised to prevent overfilling and to warn the operator of arrestment plant failure or malfunction. The correct operation of such alarms should be checked in accordance with the manufacturers instructions. If manufacturers instructions do not specify, then the check should be weekly or before a delivery takes place, whichever is the longer interval. 9. The automatic shut off system linked to the high level and pressure sensors shall be maintained in working order to cut off delivery in the event of pressurisation or overfilling. 10. Care should be taken to avoid delivering materials to silos at a rate which is likely to result in pressurisation of the silo. If compressed air is being used to blow Page 6 of 10

7 powder into a silo then particular care is required towards the end of the delivery when the quantity of material entering the ducting is reduced and hence the air flow increased. 11. In order that fugitive emissions are minimised during the charging of silos, transfer lines should be securely connected to the silo delivery inlet point and the tanker discharge point, in that order. 12. Seating of pressure relief devices on silos should be checked at least once a week, or before a delivery takes place, whichever is the longer interval. 13. Immediately it appears that the device has become unseated during silo filling, no further delivery should take place until correction action has been taken. The pressure relief device should be examined to check for defects before re-set and a replacement fitted if necessary. Tanker drivers should be informed of the correct procedure to follow. 14. If emissions or defects are detected then corrective action should be taken promptly and before another delivery takes place. Any failure of the silo management system (e.g. high level alarms, filter, pressure relief valve) should lead to a full investigation to rectify the problem. 15. If emissions of particulate matter are visible from ducting, pipe work, the pressure relief device or dust arrestment plant during silo filing, the operation should cease; the cause of the problem should be rectified prior to further deliveries taking place. Tanker drivers should be informed of the correct procedure to be followed. 16. The final discharge of all aggregate and cementitious materials to lorry mounted mixers shall be via a wet chute, the condition of which shall be inspected on a weekly basis. 17. A log book shall be kept containing a record of all visual assessments made in accordance with Conditions 2, 5, 8, 13, 14,15,16 and 32. The record shall include the time and date of the assessments, the result, and the name of the person undertaking the assessment. The log book shall be kept available by the local authority and kept on the premises occupied by the process and shall contain at least the previous 2 years records. Materials Handling 18. The ground hopper and aggregate storage bins shall be utilised for the storage of aggregate material on site. 19. Aggregate materials delivered dry shall be damped down as necessary prior to discharge to prevent the generation of airborne dust emissions. Page 7 of 10

8 20. The transfer lines, for delivery of cementitious powders, shall be checked for correct and secure connection prior to any discharge of materials. 21. Deliveries to silos from road vehicles should only be made using tankers with an on board (truck mounted) relief valve and filtration system or using a technique that affords an equivalent level of protection to the environment. This means that air from the tanker at the end of a delivery will not take place through the silo. 22. The cleaning of spillages and general yard cleaning shall be undertaken as necessary to prevent dust emissions form the process site, this shall normally be undertaken by wet handling methods. 23. Roadways in normal use and any other area where there is regular movement of vehicles should have a consolidated surface capable of being cleaned. They should be kept clean in order to prevent and minimise dust emissions. They should be kept in good repair. 24. Where necessary, to prevent vehicle dust being carried off-site, wheel-cleaning facilities should be provided and used by vehicles before leaving the site. 25. In all cases the shot blast rubber socks shall be used for loading into truck mixers. 26. Water should be added to the enclosed central mixer and fully mixed with the other materials before being discharged wet in order to minimise airborne dust emissions. 27. The transfer of aggregates and cement products within the batching facility should be by enclosed conveyor system. Stockpiles 28. Where dusty materials are stored, stockpiles should be treated where necessary to minimise dust emissions, using one or more of the methods: use of fencing, bunding, profiling reduce drop heights use of suppression such as water covering with dust covers or within suitable housing Water sprays should be used on the long term stocking areas when appropriate. 9 Maintenance 29. A written maintenance programme should be provided with respect to pollution control equipment and a record of such maintenance should be made available for inspection. Training 30. All staff whose duties include the operation of plant and machinery likely to either prevent or cause emission to air of any substance shall receive the appropriate training and should include:- Awareness of their responsibilities under the Permit; in particular how to deal with conditions likely to give rise to dust emission such as the event of spillage. Minimising emissions on start up and shut down. Action to minimise emissions during abnormal conditions. 31. The operator should maintain a statement of training requirements for each operational post and keep a record of training received by each person whose actions may have an impact on the environment. These documents should be made available to the local authority on request. General Operations 32. All spillages which may give rise to dust emissions should be cleaned up promptly, normally by wet handling methods. On the event of a major spillage it should be dealt with on the same day that it occurs and measures to minimise emissions, such as wetting the surface to create a crust, should be taken immediately. All such malfunctions shall be recorded in accordance with Condition It is recommended that waste water is collected and recycled so it can be reused in the batching process. 34. When plant is decommissioned then complete removal shall be required. Page 9 of 10
