Reason: To comply with Section 9 of the Town and Country Planning Act 990. (2) The satellite dish hereby permitted must accord with the specifications provided. Reason: In the interests of visual amenity. Note to Applicant: It is considered that, subject to compliance with the conditions and any obligations attached to this permission, the proposed development is acceptable because it will not materially harm the character of the area, the amenity of neighbours or highway safety, and it is in accordance with the policies and proposals of the development plan, as listed below, and after due regard to all other relevant material considerations the local planning authority is of the opinion that permission should be granted. 2 Report: This application has been referred to Committee because the applicant is a member of staff at Eastleigh Borough Council. The site and its surroundings. 7 Bright Wire Crescent is a ground floor residential unit within a block of eight flats, on the corner of Bright Wire Crescent, facing towards the semi-circle of open space and the remainder of the Pirelli industrial site. Description of application 2. The proposal is for the erection of a sky mini-dish, 60cm across, in matt black. the antenna is to be sited on the south-west facing elevation, at the height of the top of the patio doors. Site area 3. N/a. Residential development (net) 4. N/a. Topography 5. Flat site. Trees 6. None affected by this application. Boundary treatment 7. This block of flats is bounded by open railings, approximately.0m in height, with some low level planting inside the boundary. Site characteristics 8. The site of this planning application is a block of residential apartments within the former Pirelli s site. The units are of a contemporary design, and are sited at the corner of Bright Wire Crescent, with number 7 Bright Wire Crescent facing onto the semi-circle of grassed open-space, and the reminder of the Pirelli s work site.

3 Relevant planning history /2/00 - Outline: residential development of 665 dwellings, 7432 sqm. of offices (b) with ancillary floor space, parking and roads 26 Jun-2002 permit outline. Representations received 0. One letter of comment has been received in relation to this application. They comment they were under the impression individual satellite dishes were not permitted on these apartment blocks, and were contrary to the structure plans. They suggest it would be better if one dish sited to the side of the block was erected for the residents to share, negating the need for additional satellite dish planning applications and ensure the external frontage to the block is not spoiled. The above policies combine to form the criteria which this application will be assessed with particular regard to whether the proposal is acceptable in terms of design and siting. Comment on consultation responses 3. N/a.

4 Comment on representations received 4. Whilst it would be preferable to have a single communal satellite dish, a communal dish would not necessarily remove the need for other dishes in areas where the signal reception from the main dish is poor. It would also require co-operation between residents for funding and maintenance. However, this application is for the erection of a single, sky mini-dish, and must be considered as such. Assessment of proposal: Development plan and / or legislative background 5. Section 38 (6) of the Planning and Compulsory Purchase Act 2004 states: 6. If regard is to be had to the development plan for the purpose of any determination to be made under the Planning Acts the determination must be made in accordance with the plan unless material considerations indicate otherwise. 7. The proposal is considered to comply with the relevant Development Plan policies in that the proposed dish is of a small size, and relevant discreet design. Whilst it is not desirable to clutter the elevations of this building with satellite aerials, it is felt on balance the impact of this aerial is limited. Other material considerations 8. It is considered that there are no other material considerations to warrant a decision otherwise than in accordance with the Development Plan and / or legislative background. Conclusion 9. It is considered this application for the erection of a satellite dish accords with all the relevant policies and government guidance and therefore approval is recommended.
