8 GUIDE TO ASSISTING HOMELESS PEOPLE IN PUBLIC PLACES Introduction West Australians who are at risk of, or experiencing homelessness, are some of the most vulnerable in the community and require support to end homelessness. Tackling homelessness requires a strong focus on intervening early to prevent homelessness, and ensuring a range of flexible and responsive services are available to break the homelessness cycle. It is recognised that the response to homelessness also requires an integrated service system from all sectors of the community. This Guide to Assisting Homeless People in Public Places has been adapted with permission from the NSW Government Protocol for Homeless People in Public Places to assist government and non-government agencies that have contact with homeless people. Use of the Guide will help ensure that homeless people are treated respectfully and appropriately, and are able to request and receive the services they need. The Guide aims to assist service providers with their interactions with homeless people in public places and serve as an important tool in responding effectively. The Guide does not prevent agencies from taking appropriate action where health or safety is at risk or where there is a breach of the peace or unlawful behaviour. Underlying Principles of this Guide Homeless people have the same entitlement as any member of the public to: be in public places but at the same time respecting the right of local communities to live in a safe and peaceful environment; and participate in public activities or events. Homeless people have diverse backgrounds and needs, these should be considered in any response: cultural sensitivity and respect should be applied when engaging with Aboriginal homeless people and those from different cultural, linguistic or religious backgrounds; many homeless people have complex needs such as mental health and/or drug and alcohol issues, or cognitive impairment. These issues may result in behaviour that is seen to be antisocial; and homeless people may also have experienced other traumatic life events that affect their needs. The Guide does not override existing laws, statutory requirements or regulations. It does not reduce the powers of organisations or their authority to enforce specific laws and regulations. Homeless people have the same access to a right of reply and appeals/complaints mechanisms as all members of the public. Homeless people will not be harassed or moved on from public places unless there is a threat to the public; their personal safety or, they are causing a disturbance. Where unlawful behaviour has occurred Move On Orders may be issued by the Police. This applies to any person in a public place. Homeless people found in private places without the permission of the owner will be asked to leave. If they do not leave it can be considered trespass. Police will investigate complaints of squatting where homeless people occupy private residences and a prosecution may result. A response or intervention is appropriate if: the person requests assistance; the person is distressed or in need of assistance; the person s behaviour is threatening the safety of the individual or the safety and security of people around them; the person s behaviour has resulted in damage to property or the environment such as an accumulation of litter or items scattered in the area; the person is sheltering in circumstances that place their or others health and safety at risk (for example, staying in derelict buildings and high risk areas); the person is an unaccompanied child who appears to be under the age of 15. In the first instance, contact should be attempted with parent/s or guardian, or Department for Child Protection and Family Support Perth District Office ( ) during office hours or the Crisis Care Unit ( ) after hours; the person is a young person who appears to be 16 to 17 years old who may be at risk of significant harm; the person occupies private property or derelict buildings without the consent of the owner (squatting). First Response for Rough Sleepers Persons who are homeless, or at risk of being homeless, are encouraged to visit one of the inner city homeless day centres to seek assistance. You can call The Salvation Army Assertive Outreach Service (24 hours) on The State Government through the Department for Child Protection and Family Support has established the Street to Home Program to provide outreach assistance to rough sleepers. The information in this guide applies only to public places such as parks and open spaces accessible to the public. It does not apply to private property, or property which is not generally accessible to the public
