1 NOTRE DAME PREPARATORY AND MARIST ACADEMY Parent/Student Microsoft Surface Terms and Agreement Contract Notre Dame Preparatory School and Marist Academy is committed to preparing its students for a 21 st century global society and thus provides its students and teachers with the technology to develop and teach the necessary skills. We strive to afford our educational community with the essential environment for technology to fulfill our mission in education, access to hardware and software, professional development, technical assistance, student centered teaching, assessment and support. As new technologies continue to change the world in which we live, they also provide many new and positive educational benefits for classroom instruction. To encourage this growth, we will be providing students with a Microsoft Surface. Equipment Device: Microsoft Surface, 128GB, Windows 8.1, Office Suite 2013, Power Cord, Type Keyboard Cover, Case and Pen. Ownership: NDPMA retains sole right of possession of the Surface and related equipment. The Surface will be issued to students according to the guidelines set forth in this document. The classroom teacher, school administration, or school employee retains the right to collect and/or inspect the device at any time and to alter, add or delete installed software or hardware. Substitution of Equipment: In the event that the Surface is inoperable, NDPMA has a limited number of spare Surfaces for use while the Surface is repaired or replaced. This agreement remains in effect for the substitute. If a student forgets to bring their Surface or power charger to school, a substitute will not be provided. Responsibility of Electronic Data: The student is solely responsible for any data stored on the Surface. It is the sole responsibility of the student to back-up data as necessary. NDPMA does not accept responsibility for any such files. Customization of Equipment: Students can customize tiles, add an additional personalized luggage tag or use an appropriate decal. Damage or Loss of Equipment Warranty for Equipment Malfunction: NDPMA has purchased Microsoft Complete Care Warranty. Report any damage or loss to the NDPMA s IT Department at itsupport@ndpma.org. All devices are covered by a manufacturer s warranty. Complete Care Warranty covers manufacturer s defects with zero deductible. Complete Care for the Surface Pro 2 has a deductible per claim of $49 per device and carries an additional $49 deductible for the second claim. The $49 deductible is the financial responsibility of the student s family. Complete Care Warranty does not cover loss, negligence and abuse. There is a zero deductible for the Surface 3. For example, throwing the Surface or using the Surface as an umbrella would be considered examples of neglect and abuse. If a Surface is lost or damaged by neglect or abuse, it is the family s financial responsibility to reimburse NDPMA for the cost the Surface at a price of approximately $ If a Surface is damaged, NDPMA will work with the student, Microsoft, to determine if it is a warranty or an insurance claim incident. An optional third party insurance policy is available. If additional insurance was purchased it is the responsibility of the family to work directly with such company.

2 Student Responsibilities: Keep the Surface with you or within your sight at all times. Do not let anyone use the Surface other than your parents or guardians. Adhere to NDPMA Responsible Use Policy (RUP) at all times. Note: Responsible Use Policy is available on our website Report any problems, damage or theft immediately to your teacher and IT Office. General Care: Do not do anything to the Surface that will permanently alter it in any way. Do not remove any serial numbers or identification placed on the Surface. Keep the equipment clean. For example, do not eat or drink while using the Surface. Do not expose your device to extreme temperatures or direct sunlight for extended periods of time. Approved skins or labels may be used Screen Care Clean the screen with a soft, dry anti-static cloth or with a screen cleaner designed specifically for LCD type screens only. Personal Health & Safety Avoid extended use of the Surface while resting directly on your lap. As with any electronic device take frequent breaks when using for long periods of time. Do not provide your personal information to anyone over the Internet. Do not share your passwords with anyone. Keep the Surface in a secure location when it is not at school. Restricted Use Student placed on restrictive use must only use Surface on the school s campus during days of regular instruction. Student must retrieve a Surface provided in the school office prior to the start of regular instruction and return it at the end of each instructional day. Students who violate one or more of the conditions below may, at the Principal s discretion, be placed on Restricted Use until the student s Principal determines student has satisfied the conditions for non-restrictive use as specified by the Principal. Late homework as stated in the Homework Policy includes not bringing your Surface to school each day.

3 Reasons for placing a student on Restrictive Use include the following: Repeated use of device not being used for educational purposes during school hours Non-acceptance of user agreements and handbook policies regarding electronics Violation of NDPMA Responsible Use Agreement Inappropriate, defamatory, inaccurate, abusive, obscene, profane, or illegal material found on Surface Violating Standards for Personal Surface Care Repeated failure to bring to class daily/failure to bring charged Security Responsibility to keep the device secure rests with the student who keeps it with him or her at all times. Notre Dame Marist Academy is not liable for any device stolen or damaged on or off of school property. If a device is stolen or damaged, it will be handled through the IT Office and/or a third party optional insurance company. In case of theft, vandalism, and other criminal acts, a police report MUST be filed by the student or parent and reported to the IT office immediately. Additionally, NDPMA will be providing a protective case/cover for each Surface. These cases are required to be on the device at all times. Students are not permitted to switch cases/covers. It is recommended that you add an appropriate unique label or tag to a portion of your device case. This will make the case easily identifiable. Student/Parent Financial Commitment These prices will follow the student through the life of the lease. In the Upper and Middle divisions, the devices will be made available to students on either a 3 year or 4 year lease program. The length of the lease will be solely determined by the device the student is receiving. The device lease fees will be assessed and are payable in full on July 1. Maximum use of a loaner is 30 days. Any 3 rd party additional insurance contract is between the parent/guardian and the insurance company. You may check with your homeowner s insurance policy as well.

4 Microsoft Surface User Agreement All users in the Microsoft Surface Program must adhere to the Student Code of Conduct, as well as all Handbook policies, particularly Internet Responsible Use Policy. Additionally, the device: 1. May not be used to cheat or gain an unfair advantage on assignments or tests or for non-instructional purposes (such as making personal phone/video calls and text/instant messaging). 2. May not be used to record, transmit, or post photographic images or video of a person or persons on campus during school activities and/or hours except with teacher approval for a class project or homework. Nor can any images or video recorded at school be transmitted or posted at any time without the express permission of all persons involved. 3. Must be in its protective case/cover provided by the Notre Dame at all times. Users are not allowed to switch cases/covers. 4. Users must comply with staff request to shut down the devices or close the screen. User issued device is not to be disruptive to classroom activities or the user s learning. 5. The use of Google Docs, OneDrive, blogs, podcasts, or other Web 2.0 tools are considered an extension of the classroom. Therefore, any speech that is considered inappropriate in the classroom is also inappropriate in all uses of blogs, podcasts, or other Web 2.0 tools. 6. During school hours the user should only use his/her device to access classroom related activities. 7. Violations of NDPMA policies, administrative procedures, or school rules involving a user s device may result in the loss of use of the device in school, disciplinary action. Students and Parents acknowledge that: 1. When the device is connected to the NDPMA s wireless network, internet and network filters will be applied to one's connection to the internet, and no attempt will be made to bypass them. The Children s Internet Protection Act (CIPA) requires all network access to be filtered, regardless of the device you use to access it while in school. While filtering does an effective job of preventing access to inappropriate web sites, it is impossible to completely filter access. 2. When the device is connected to any other wireless network that is not owned and operated by the NDPMA, the device will not receive internet and network filters. 3. NDPMA will be using a Mobile Device Management appliance which allows for tracking the device and location services, remotely locking and wiping the device, deploying software or apps, and disabling/enabling Surface features. 4. Disabling or deleting location services, mobile device management profiles and/or mobile device management apps is strictly prohibited. 5. NDPMA has the right to collect and examine any device at any time. The school reserves the right to inspect a student s device if there is a reason to believe that the user has violated NDPMA policies, administrative procedures, school rules, has engaged in other misconduct while using his/her issued device, or if the device is suspected to be the source of inappropriate material, an attack or virus infection. 6. If the device runs out of storage space, personal apps and data must be deleted to make room for educational material. Educational Apps, documents and resources always take precedent over personal data. 7. NDPMA is not financially responsible or liable for any intentional or accidental purchases made by the user on the device, including Apps, Music, Movies, Books, etc. 8. Upon leaving the NDPMA permanently (transfer out, etc.), the device and all accessories must be returned to the NDPMA in proper working order. For non-returned and/or damaged equipment, NDPMA has the right to issue fines, file a police report, and/or withhold final grades 9. Device must be fully charged prior to bringing it to school and runs off its own battery while at school. The student must shut down device when not in use, not just sleep mode to preserve battery life. 10. Any violation of the above will result in disciplinary actions and may result in loss of device privileges.

I further understand that any violation of the above may result in the loss of my network and/or device privileges and fines, as well as other disciplinary action. I have read and discussed the guidelines with my child and understand the responsibility he or she has. If the issued Surface or loaner is lost, damaged by or abused, it is the family s financial responsibility to reimburse the school the cost of the Surface at a price of $ If a Surface is damaged, NDPMA will work with the student and Complete Care to determine if the damage is a warranty or insurance claim coverage. If a family has purchased additional insurance, it is the family s responsibility to contact the insurance company. These devices are solely owned by Notre Dame Preparatory School and Marist Academy. NDPMA has the right to protect its network and technical resources. Thus, all students are required to adhere to the NDPMA Responsible Use Policy (RUP).
