1 Rental/Occupant Agreement for Texas Week - March 10 through March 18, 2012 Homeowners, Here is the rental agreement, as recommended at the 2010 Annual Meeting, which should be used by Falcon House Homeowners who plan to rent or lend out their condos during Texas Week 2012 also known as Spring Break. (March 10 through March 18). If you already have a long term renter, they should be informed about some of the changes for that week, for instance, the 1 car policy, Parking Pass requirement for that week, guest limited to _6 _ people per condo, and sub-renting not permitted. We strongly recommend that you use this signed written lease agreement for your renters BEFORE any funds are exchanged. Do not accept a payment without the completed forms. These forms are equally important as payment. If you are not renting, but allowing someone to stay at your condo, like extended family, you can delete the following from the Agreement: Page 1 -- # 4, # 5, and # 8 Page 2 -- # 9 Revise Page 2 -- # 11 Make sure they read and sign page 3, 4, and 5 You should revise this agreement as necessary to accurately represent your condo on the items below. 2 Rental/ Occupant Agreement This Short Term Rental/ Occupant Agreement (the Agreement ) is made by and between ( Homeowner ) and ( Guest / Lessee ) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. Property: The property known as Falcon House Condominiums is located at: E. Esperanza, South Padre Island, Texas The property is furnished and includes appliances and other provided items like linens, towels, etc. 2. Rental / Occupant Party: The rental party shall consist of Guest/ Lessee and the following persons. Guest/Lessee must be 25 years of age or older and will be occupying the premise during the term of the lease. Sub-renting is not permitted. Please list all people that will be staying at Falcon House Condos. Limit of 6 Guests Name Age Relation Address 1 Lessee Maximum Occupancy: The maximum number of guests is limited to _6 _ people. An additional penalty charge or $ per person per night will be added for additional guests. 4. Term of the Lease: The lease begins at p.m. on (the Check-in Date ) and ends at a.m. on (the Checkout Date ). 5. Minimum Stay: This property requires a night minimum stay. If a rental is taken for less than days, the guest will be charged the $ per night rate. 6. Rental Rules: Guest/Lessee agrees to abide by the Rental Rules attached as Exhibit A and Exhibit B and at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. 7. Access: Guest/Lessee shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. 8. Rental Rate and Fees if applicable. Deposit: A deposit of $ is due at least days prior to the Check-In Date. 1

3 The deposit is for security and shall be refunded within days of the Checkout Date provided no deductions are made due to: i. Damage to the property s interior, building s common area, or furnishings; ii. Dirt, scattered cigarette butts, or other mess requiring excessive cleaning; or iii. Any other cost incurred by Homeowner or Association due to Guest s stay. If the premise appears dirty or damaged upon Check-in, the Guest shall inform Homeowner immediately. Rental Rate: Payment in full of the following fees shall be due within days of the Check-in Date: $ per night x nights = $ Cleaning fee Sales Tax TOTAL Due $ $ $ 9. Cancellation Policy: If Guest/Lessee wishes to cancel his/her reservation, the deposit will be refunded as follows: % if cancelled days prior to the Check-in Date % if cancelled days prior to the Check-in Date 10. Insurance: We encourage all renters to purchase traveler insurance. 11. Payment: Acceptable payment method is by personal check or cash. Please provide the following information. Signature Page The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the signatures set forth below. Sub- renting is not permitted. 4 Exhibit A Rental Rules 1. Smoking is NOT allowed OR Smoking is allowed outside only. (Dispose of cigarette butts properly. Do not throw butts on the premises - refer to number 8 above) 2. People other than those in the Guest party set forth above may not stay overnight in the property. Guest limited to _6 _ people per condo. An additional penalty charge per person per night will be added. Any other person in the property is the sole responsibility of Guest. 3. All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 4. Keep the property and all furnishings in good order. 5. Only use appliances for their intended uses. 6. Pets are NOT allowed OR PETS are permitted only with prior approval. All Pets must be on a leash according to the SPI ordinance. Pet owners are responsible for cleaning up any/all pet refuse. Pets are not allowed in the back area. 7. Parking: Only 1 parking space is available to each condo unit. *** PARKING PASSES Parking passes are located inside the unit or are included with this contract. Renters must display parking pass on the front dashboard at all times. Failure to display may result in towing of vehicle at renter's expense. Leave the parking passes inside the unit upon departure. **** Parking is limited solely to 1 vehicle per condo. Vehicles are to be parked in designated parking areas only. No double parking allowed. Vehicle will be towed.(see map for your assigned parking area) Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. Parking on the street is permitted, but must not block any parking area or driveway. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units or hung over any of the balcony railings at any time. 9. Grills: Electric grill, charcoal/ flammable barbecue pits are not permitted in the balcony area or front area at any time. ** Signature Guest (electronic or manual) X 3
