1 TRACCIA COMMUNITY ASSOCIATION CLUBHOUSE RESERVATION AGREEMENT CLUBHOUSE RENTAL RULES 1. Reservations: A. The clubhouse may not be reserved within two (2) days of a regularly scheduled board of directors meeting. B. All reservations must be sent to the management company in writing via fax, , or through the US Postal Service. Verbal requests will NOT be accepted. C. A minimum of two (2) hours is required for all reservations. Should an event begin prior to or end after the agreed upon time, additional charges may apply. D. Guests are required to adhere to all rental times specified in the rules and regulations and I or contract. E. Reservations may be made by the owner of a property only. Tenants are not permitted to use the facilities, due to insurance listing Traccia as additional insured. 2. Confirmations: A. Reservation confirmations will be given upon receipt of the full deposit and signed clubhouse rental agreement forms only. 3. Clubhouse Fee: A. Clubhouse use requires $ to hold and use the date of your event. 4. Cancellations: A. Cancellations must be given at least one week prior to the scheduled usage date. B. There will be a $50.00 cancellation fee for canceling after the required one-week period. 5. Food and Beverages: A. Alcoholic beverages are permitted to be brought into the facility provided all Nevada laws are obeyed. All alcoholic beverages must remain in the clubhouse facility and not taken out of the premises. 6. No pets are allowed in the Clubhouse except service animals. 7. No smoking is allowed in the Clubhouse. 8. Insurance: A. Copy of your homeowners insurance policy naming Traccia Homeowners Association as an additional insured, indicating the address of the clubhouse, Merado Peak Drive, Las Vegas, NV Along with the time and date of the event. Damages & Liabilities: Owner hereby acknowledges that the owner assumes all liability for any loss of or damage to any person's merchandise or articles used or left at the facility whether such loss occurs prior to, during, or after the function. Owner shall be solely responsible for and shall immediately reimburse Traccia Community Association for any damage to the premises caused by guests, invitees, etc. Owner shall indemnify, defend, and hold harmless Traccia Community Association against all and all claims, losses, damages, or liability arising out of or related to owner's functions irrespective of whether such claim, loss, damage, or liabilities arise from active or passive activity. Other Conditions: No tacks, nails, or adhesives are to be used to affix any signs, banners, or decorations to the wall. If on the day of the event, the contact changes the room setup as specified on the rental agreement, a minimum $50.00 labor charge will be added to the homeowner s account. THESE RULES AND REGULATION ARE SUBJECT TO CHANGES, ADDITIONS, ANDIOR AMENDMENTS AT ANY TIME.
2 I, agree that the One Hundred Dollars ($100.00) check, made payable to Traccia Community Association, for the reservation I cleaning fee is attached. Loss of the clubhouse key will result in further action being taken against the owner as this will necessitate a lock change of the clubhouse at the expense of the homeowner. I further understand I am responsible for any liability resulting from the above function. I will adhere to the CC&R's regarding use of the common area and visitors. I will return the clubhouse to a clean and undamaged condition. I will abide by all State and Local laws regarding alcohol, drugs, and other controlled substances. I understand the Association can enforce legal remedies against any violator. There will be no concerts or loud music in violation of CC&R' s and I or City Ordinances. 4 CLUBHOUSE RULES AND REGULATIONS Facilities: A clubhouse reservation is for use of the social room, kitchenette, and restrooms only. The private offices within the clubhouse as well as the pool, spa, fitness center, pool areas and tennis courts are not included and should not be used by party guests. Smoking: No smoking is allowed in the clubhouse or in the fitness center. Availability: The clubhouse is not available for use during Traccia Homeowner Association sponsored functions and meetings. Reservation priority is based upon properly submitted applications. Hours: Reservations are for one day only within the hours of 10 AM to 11 PM. The facilities must be cleaned and vacated no later than 11 PM. Any exceptions must be approved by the Board. Noise: Live bands and disc jockeys are permitted on the condition that the noise is contained within the clubhouse. All clubhouse doors are to remain closed to contain noise. No outside activities, music or speakers are allowed. Capacity: The maximum capacity for the clubhouse is 60, as established by fire regulations. Reserving Owner: All owners in good standing with no outside assessments or fines may submit an application to reserve the clubhouse. Owners not in good standing may not reserve the clubhouse. The reserving owner must be present during the period the clubhouse is under such reservation as well as during check-in and checkout at the clubhouse. Reservation Applications: All applications must be submitted to the management company, signed by the reserving owner, and accompanied by the applicable rental fee and insurance. An application must be completed a minimum of 15 days prior to the event and is not considered to be complete until all forms are signed and checks received. Reservations may be submitted up to 90 days in advance. A reservation application may be obtained from Taylor Association Management. Check-In and Check-Out: The reserving owner must specify the check-in and check-out times on the application. Coordination of functions and times will be handled through the Management Company. Set-up and Clean-up: The reserving owner is responsible for his/her own set-up and clean-up including removal of trash and rearranging furniture in the manner provided prior to the event Furniture and Equipment: Existing furniture may not be removed from the interior of the clubhouse. All kitchen equipment, banquet table, podiums, and extra chairs must be provided by the reserving owner. Deliveries and Pick-ups: The reserving owner shall arrange for all deliveries and pick-ups to be made on the day of the event and must be present to handle them. Alcoholic Beverages: If serving alcoholic beverages, Nevada drinking age requirements must be adhered to at all times. No loud, obnoxious or intoxicated behavior will be allowed. Damages. Liability and Fines: The reserving owner is liable and responsible for any damage caused by guests attending the event as well as any fines resulting from violations of the CC&Rs... and/or these rules.
5 Abandoned Property: Traccia Homeowners Association will not be responsible for or store any rental equipment, furniture, catering supplies, or personal property delivered to or left on the premises. Cancellation: The reserving owner is responsible for providing 48 hour written notice of cancellation. Fees: The non-refundable clubhouse usage fee is $ Submit a check payable to Traccia with your application. Additional Charge: Additional charges are subject to the costs and fines incurred for: Damage to the clubhouse and/or contents Cleaning of the clubhouse (to restore conditions prior to event, including arrangement of furniture.) Violation of CCR's and/or these rules in conjunction with the use of the clubhouse. Failure to vacate the premises promptly upon check-out time. Guest List: A written list of guests must be provided to the guard house prior to the event Insurance: A copy of your homeowners insurance policy (or other event specific policy) naming Traccia Homeowners Association as an additional insured, indicating the address of the clubhouse, Merado Peak Drive, Las Vegas, NV The time and date of event must be listed.
