Applicant agrees that false, misleading or misrepresented information may result in the application being rejected, will void a lease/rental agreement if any and/or be grounds for immediate eviction with loss of all deposits and any other penalties as provided by the lease terms if any. 2 Memorandum to Enter into a Lease Terms to be included in the LEASE upon owner acceptance (THIS IS NOT A LEASE) Property Address Disclosure of Real Estate Brokerage Relationships -WEICHERT, REALTORS - Hallmark Properties will act as an Owner's Agent with respect to negotiations with Tenants. This is to advise that the undersigned broker is the agent for the Owner and will be paid by Owner. 1. Rental period to commence on and ends. 2. Rent of $ per month 3. Applicant understands that other applications may be processed and another approved Applicant may be chosen. If Applicant is approved by Landlord and/or Management and the lease is entered into the Good Faith Deposit, if any paid, shall be applied toward the Security Deposit. If Applicant is approved and chosen, but fails to sign the lease within 2 days of verbal and/or written approval and/or take possession after lease signing, the Full Good Faith Deposit amount shall be forfeited to the Landlord or Management in addition to any penalties as provided in the lease if the lease has been signed by the Applicant. The Good Faith Deposit shall be refunded only if Applicant is not approved and chosen. Keys will be furnished only after lease and other rental documents have been properly executed by all parties and only after applicable rent, fees, deposits, and security deposits have been paid and all requirements of Landlord and/or Management have been met including but not limited to Applicant providing proof that all utilities have been placed in Applicant s name. This application is preliminary only, in no way implies that a particular rental unit shall be available and in no way obligates Landlord or Management to execute a lease or deliver possession of the proposed premises to the Applicant even if approved. 5. Security Deposits are held by the Lessor against damages which may be incurred during the rental term by the Lessee. The security deposit is not part of the rental monies which are paid to the Lessor and cannot be used as such. Breaching a lease will result in the forfeiture of the security deposit, as well as, the Lessee being held liable for damages and missed rents for the term of the lease. 6. Lessee shall allow Lessor or his agent to show the property, by appointment, during the last 30 days occupancy. 10. 3 Tenant Selection Criteria 1. Your applications will not be processed without the correct funds. 2. All applicants over the age of 18 must submit a fully completed, dated, and signed rental application along with the non-refundable application fee of $50.00 per adult applicant. Applicant may be required to be approved by a condo/homeowner s association and may have to pay an additional application fee, or an additional security or damage deposit. Two (2) forms of identification is required (driver s license, military ID, Social Security card, or state ID). 3. Applicants must have a combined gross income of at least 3 times the monthly rent. We reserve the right to require a co-signer. 4. Self employed applicants may be required to produce 2 years of tax returns or 1099 s or 6 months of bank statements. Non-employed applicants must provide verifiable proof of income. 5. All sources of income must be verifiable if needed to qualify for a rental property. 6. Proof of rental insurance will be required prior to occupancy of the rental property. 7. Previous rental history reports from landlords must reflect timely payments, sufficient notice of intent to vacate, no complaints regarding noise, disturbances, or illegal activities, no unpaid NSF checks, and no damage to the unit or failure to leave the property clean and without damage at time of lease termination. 8. Credit history must not contain eviction filings, unsatisfied liens or unsatisfied bankruptcies within the last 5 years. For applicants with discharged bankruptcies, the applicants credit history must reflect good credit history free of any collections, slow pays, and etc. We will not provide you a copy of the credit report or tell you of its contents, but will provide you with the name of the credit reporting agency so you may receive a free copy. 9. Criminal records must contain no convictions for misdemeanors for crimes involving violence, assault or battery, drugs, firearms; felonies within the past seven years and no sexual offenses ever. In the event a record comes back adjudication withheld, nolle prosse, or adjudication deferred, further documentation may be required and applicant may be denied on this basis. 10. No pets (with the exception of medically necessary pets) of any kind are permitted without specific written permission of Landlord in the lease agreement, an addendum to lease, a non-refundable pet fee acceptable to the landlord and/or an additional refundable pet deposit. A pet application and application fee is required for all pets. Fees and deposits are waived for medically necessary pets. 11. Resident will be required to pay a security deposit at the time of lease execution in a minimum amount of one month s rent. We reserve the right to require a higher security deposit and/or additional prepaid rent. We do not accept personal checks for the security deposit or first month s rent. All funds must be paid by cashier s check or money order. We do not accept cash. 12. We may require a good faith deposit to be collected to hold a property off the market. In the event the application is approved and applicant fails to enter into a lease, the applicant shall forfeit this deposit. In the event the application is approved, this deposit shall be applied to the security deposit. 13. The number of occupants must be in compliance with HUD standards/guidelines for the applied for unit. 14. In the event any exceptions to our company s criteria are made, additional security, cosigners, and/or additional advance rent payments may be required. 15. Proof of utilities transfer will be required prior to occupancy of rental property. Applicant Signature Date

4 PET APPLICATION This PET APPLICATION is for (name & address) I do hereby request that my pet be approved to reside with me during the term of my lease agreement. If my pet is a Service Animal or a medically necessary pet I will notify MANAGEMENT in writing and this PET APPLICATION may not be applicable. NOTE: This is a PET APPLICATION ONLY. In order for the pet to be permitted on the premises, the pet must be approved by MANAGEMENT, a PET ADDENDUM signed by RESIDENTS and MANAGEMENT and all fees paid including but not limited to an additional security deposit, pet deposit, pet fee or additional rent as required by MANAGEMENT. I understand that MANAGEMENT is under no obligation to approve my pet for occupancy. In consideration of having my PET APPLICATION being processed, I agree to pay a non refundable PET APPLICATION fee ($10.00 per pet) of $ to MANAGEMENT. This fee is paid as I understand that a pet occupied property often times causes more work, more frequent inspections and occasional complaints from neighboring properties. I further understand that the non refundable PET APPLICATION FEE is strictly an administrative fee paid to MANAGEMENT and is not considered a security deposit or pet deposit. MANAGEMENT requires a photo of the pet for MANAGEMENT S files and the pet must be brought to the parking area of the MANAGEMENT office for inspection by a representative of MANAGEMENT. 5 I, the owner of the above described pet, do hereby certify the following: My pet is well trained, is not dangerous to others and does not have a propensity to be vicious. My pet has never bitten, clawed, or caused harm to another person or other pet. My pet is not pregnant and will not become pregnant while we are residing on the premises. If my pet becomes pregnant, I will be in violation of this agreement and the pet and any offspring must be immediately removed from the premises OR I will be subject to eviction. I shall not engage in any pet raising activities. There shall be no other pets, other than listed above on the premises without the express written approval of MANAGEMENT. Should I desire additional pets, I agree to apply to with MANAGEMENT for approval and obtain approval prior to pet occupancy. MANAGEMENT does NOT guaranty any approval. I agree to keep the pet from becoming a nuisance to neighbors and follow everything stated in the PET ADDENDUM. This includes but is not limited to controlling the barking of the pet, if necessary and cleaning any animal waste on and about the premises. In the event that my pet causes damage or destruction to the property, I agree that all cost of said damage or destruction shall come out of our Security Deposit and/or Pet Deposit. Should the Security Deposit or Pet Deposit be insufficient to cover the cost of any pet damage or destruction, then I agree to be financially responsible for damages above and beyond the amount of my security deposit. If the pet becomes a nuisance or causes damage or destruction to the premises or otherwise violates the terms of the PET ADDENDUM OR PET APPLICATION, MANAGEMENT may terminate the RESIDENT S privilege of having a pet and or RESIDENT S tenancy.
