Street closure requested is of Gross Avenue from Black Street to Chester Avenue, leaving both intersections at Black and Chester open to thru traffic. The following event was approved by the Events Management Committee. CURRENT STATUS / SITUATION ACTUELLE The Relive our Childhood in Parkton is a community event for those who grew up in the Parkton area and attended St. Henri, Verdun and Beauséjour schools. There will be both indoor and outdoor celebrations. Activities in the street closure area will take place between 10am and 12pm and include ball hockey, King Square, jump rope, face painting and more. A closure between 8am and 1pm is requested to allow for ample set-up and tear-down time. RECOMMENDATION / RECOMMANDATION That the organizers of the Relive our Childhood in Parkton event be granted permission for the following street closure: Gross Avenue from Black Street to Chester Avenue, leaving both intersections at Black and Chester open to thru traffic, from 8:00 am until 1:00 pm Saturday May 30, OTHER OPTIONS / AUTRES OPTIONS RISK ANALYSIS / ANALYSE DE RISQUES The Organizers will be required to provide an indemnity to the City of Moncton and proof of general liability insurance in an amount of at least $2 Million.

Since that time, the website has been upgraded to version 2.0 and he wishes to provide an update on the project, as well as launch the new version. CURRENT STATUS / SITUATION ACTUELLE Communities of southeastern NB have collaborated to bring you MyCommunityCalendar.ca, a unique website that offers one of the most comprehensive lists of events in the region. There are currently 32 calendars synchronized on the website and more are planned for the near future. MyCommunityCalendar.ca is a testimony to the one-community spirit of all the calendar partners for all the region s citizens, charitable organizations, government and businesses. This initiative was made possible by the co-operation of many community partners. All calendar partners have agreed to use and promote MyCommunityCalendar.ca to optimize the community s event information sharing. The rezoning will accommodate a change in use from residential to a gift shop and art gallery in 296 Mountain Road, and an existing non-conforming office space in Mountain Road will become a conforming use to be maintained as office with a research training centre included. The existing single-unit dwelling on the second floor of Mountain Road will be maintained as a single-unit dwelling. CURRENT STATUS / SITUATION ACTUELLE At the November 3, 2014 Regular Meeting, Moncton City Council resolved that a public presentation be scheduled for December 1, 2014 to inform the public of the proposed Municipal Plan amendment Z as it pertains to the rezoning of 296 & Mountain Road. To implement the zoning change, the property needs to be re-designated in the Municipal Plan from NH Neighbourhood to MUC Mixed Use Centres and Corridors in order to rezone the lands from R2U to MU. The statutory notice of the public presentation appeared in the newspapers on November 19, At the November 3, 2014 Regular Meeting, Moncton City Council also resolved that a public hearing be scheduled for January 19, 2015 for the consideration of objections to the proposed Municipal Plan amendment Z and Zoning By-law amendment Z The statutory notice of the public hearing appeared in the newspapers on December 24, 2014 while the second notice was mailed out to properties located within 100 m of the subject site. As per the requirements of the Community Planning Act, Council also referred the By-law amendments to the Planning Advisory Committee PAC for its written views. At its meeting of November 26, 2014, the Committee considered the proposed amendments and recommended that Council proceed with the proposed amendments being By-law Z and By-law Z subject to terms and conditions See attached PAC Report. RECOMMENDATION / RECOMMANDATION The Planning Advisory Committee recommends that Moncton City Council proceed with amendments to the Municipal Plan By-law, being By-law Z-113.3, and the Zoning By-law, being By-law Z in order to allow the proposed gift shop and art gallery in 296 Mountain Road and an office space and training centre on the main floor of Mountain Road with a single-unit dwelling on the second floor. Further, that the rezoning shall be subject to the following terms and conditions:

15 1. A reciprocal right-of-way agreement shall be registered on the site prior to a Development Permit being issued; 2. Notwithstanding Schedule D Parking Requirement Chart in By-law # Z-213, as the site meets Provincial Regulation Barrier-free requirements, the applicant shall provide five parking spaces plus one barrier-free parking spot on the site, as agreed and shown on the site plan; 3. All plans must conform with City of Moncton Building and Engineering standards; 4. This rezoning approval shall expire within 12 months of it coming into effect unless a Development Permit is obtained and the development is to be substantially completed within two years; 5. That the $1000 security deposit required for a Conditional Rezoning Agreement be paid prior to 2 nd and 3 rd reading; and, 6. In all other respects, the development shall be carried out in substantial conformance with the plans and drawings submitted. The building is currently vacant Mountain Road currently operates as a legal non-conforming use as an office with a training centre component. Adjacent properties zoning & use / zonage des propriétés attenantes et usage: To the east of the site sits a large family home used as a home and an office, zoned R2U Urban Dwelling. Directly to the south is a full block of residential homes, also zoned R2U. Across the street on the north side of Mountain Road is a parking lot and vacant lot behind which is an apartment building, zoned R-3 Multiple Unit Dwelling. To the west of the site on both the north and south sides of mountain Road is a long strip of MU Mixed Use Zone fronting on Mountain Road. Municipal Plan / Plan municipal: The property is designated NH Neighbourhood on Schedule 1 of the City of Moncton Generalized Future Land Use Map. Rezoning from R2U Urban Dwelling Zone to MU Mixed Use Zone will require an amendment to Schedule 1 to change the designation from NH to MUC Mixed Use Centres and Corridors. 18 Planning Advisory Committee Report Rapport au Comité consultatif d urbanisme Agenda Item / item de l ordre du jour : File / Dossier : Meeting Date / date de la réunion : 14MZ November 26, 2014 Mixed Use Centres and Corridors MU-9 The Mixed Use Centres and Corridors designation may be used to assist with creating unique mixed use neighbourhood centres which are appropriately located within neighbourhood areas near major post-secondary institutions, hospitals, other public amenities, parks and open spaces. MU-10 Within the Mixed Use Centres and Corridors designation, Council shall encourage the development of a mix of urban land uses that support the development of a high quality streetscape and transit corridor, with an emphasis on community oriented retail and service-oriented commercial uses along with medium to high density residential development, institutional uses and community facilities that will serve residents and support pedestrian activity and transit use. Developing the Arts & Culture of Our City Objectives 5. Support economic growth and prosperity through the development of arts and culture. 7. Promote dialogue and expression that brings many cultures together to promote cultural growth and advancement of arts, culture and heritage initiatives. Education and lifelong learning Objective 2. To support and recognize the importance of post-secondary and adult learning initiatives to the long-term social and economic success of the City and the region. Policy ED-18 The City shall promote and foster partnerships between area education institutions and the private sector to help reduce the gap between industry needs and the skill level of the workforce. However, the public hearing does require statutory public notifications. First notice of the public hearing will be published in the newspaper subject to Section 68 of the Community Planning Act. In lieu of a second notice in the newspaper, all property owners within 100 metres of the property to be rezoned will be notified by mail. Discussion & Analysis / discussion et analyse: The applicant is proposing to rezone the subject properties in order to accommodate the Institute for Chinese and Asian Research ICAR. This is an academic research and business consultancy centre established to serve the needs of the research and business communities, covering contemporary issues in Chinese and Asian society, culture and economy. The two properties sit adjacent to each other on Mountain Road and both are owned by the applicant. The Institute is currently operating out of Mountain Road which benefits from a legal non-conforming use as an office space. There is a single-unit dwelling on the second floor of Mountain Road which the owners plan on maintaining. The building at 296 Mountain Road was being used as a residential home prior to it being purchased by the applicant. It is currently vacant. The intent for the two buildings is to maintain the office and training centre in Mountain Road and to expand the scope of the operation to include a gift shop and art gallery in the building next door 296 Mountain Road. The current R2U Zone permits mainly residential uses and no office, educational or commercial uses are permitted As noted, the building at Mountain Road benefits from an existing legal non-conforming use status. Therefore the applicant is proposing to rezone the two properties to MU Mixed Use zone in order to accommodate the full training centre facility. The MU Mixed Use Zone would permit an art gallery, educational use, office use and retail store. Furthermore, by applying to rezone the properties appropriately the legal non-conforming status on Mountain Road will be removed and the use will henceforth be legal and conforming. The site Mountain Road sits at the corner of Mountain Road and Birch Street in the central part of Moncton. Directly across the street is the intersection of Portledge Avenue and Mountain Road. 296 Mountain Road sits adjacent to on the east side. Both properties have frontage on Mountain Road. 296 Mountain Road has a driveway on the western side of the building which is wide enough to accommodate several parked cars along the side of the house Mountain Rd. has Page 3 of 5

In order to accommodate access and parking for the two buildings, the applicant has proposed to remove the existing curbed barrier between the two driveways and create a one way drivethrough driveway to be shared by both buildings. Access into the site will be maintained at 296 Mountain Road as an in-only driveway. Parking will continue to be available on the west side of the building as well as maintaining the existing parking spot in front of the building. The driveway will flow through to the parking pad at the rear of Mountain Road where three more parking spots will be established along with the out-only driveway onto Birch Street. Please see attached site plan The site is located just one block east of the Green Line public transit route, and just two blocks west of two Hospital transit lines. Mountain Road is considered an urban arterial with an emphasis on higher levels of services and amenities. Parking According to the Zoning By-law, a site with commercial, office space and a dwelling unit would require seven parking spaces plus one barrier-free. However, due to the existing size of the site and the orientation of the buildings, only five spaces will be provided, plus one barrier-free. For an infill use on a busy arterial road, five parking spaces plus one barrier free is not unreasonable. As noted above there are several options for public transit in close proximity to the site and with sidewalks on both sides of Mountain Road the site is very walkable and easily accessible. The owners are installing bicycle parking on the site and there is also free parking along Birch Street if the need arises. The applicant does not expect a high volume of vehicular traffic to be accessing the site. The staff is expected to be small and will include the owners of the property. Parking and access is not expected to be an issue with this development. In terms of the driveways and access, a reciprocal right-of-way agreement shall be registered on the site to accommodate the shared driveway and parking for both buildings. This will be a condition for approval. In terms of the proposed use and whether it will fit in with the neighbourhood, we must look at the surrounding streetscape and uses. As noted, the surrounding neighbourhood is quite diverse. To the north of the site sits a block of houses, apartments and duplexes zoned for higher density. Just east of the site down Mountain Road sits Moncton s Castle Manor, behind which is a large community oriented area that includes the Georges Dumont Hospital, St. Patrick s Family Centre, and the CBC building. West of the site along Mountain Road is a long strip of commercial and residential uses ranging from higher density residential to offices and retail. The block in which the subject site sits is the only small pocket of R2U left along this part of Mountain Road. It is not unreasonable to expect a change in use from residential to a low-impact commercial / mixed use facility in this area. The Institute is expected to be a positive addition to the neighbourhood and not be out of place within the fabric of the streetscape. Conclusions Mountain Road is considered to be an urban arterial with an emphasis on higher levels of services and amenities. The majority of the buildings fronting onto Mountain Road are zoned MU Mixed Use in recognition of this fact. The services that the Institute will be providing fit in well with the commercial and higher density residential mix fronting on Mountain Road. A rezoning of these two properties is not an unreasonable request. Although downtown would have been a more ideal location for such a use, to be situated along Mountain Road close to amenities as well as public transit is an acceptable alternative. The application meets the intent of the Municipal Plan to support the arts and culture of our City as well as supporting education and lifelong learning for our citizens. It also meets the intent of Policy PA-6, therefore staff are of the opinion that Council should proceed with the rezoning process. Page 4 of 5
