Trueman, General Manager, Legal and Legislative Services 10 minutes Type Public/Publique Private/à huis clos RATIONALE FOR PRIVATE DISCUSSION (if necessary/ JUSTIFICATION POUR LA DISCUSSION PRIVEÉ (s il y a lieu ISSUE / OBJET We have received a request from Christian Hébert of Immeuble INCITE Realty Inc. on behalf of Design Plus Architecture Inc. and FILO Plus Cabinets Inc. to enter into an Encroachment Agreement with the City for the installation of four (4 awnings at 83 Botsford Street. The proposed awnings will encroach over City-owned property as per the dimensions shown on the plan annexed hereto. We receive requests for encroachments quite often. The approval of those requests has been considered routine and without significant concern. Once we determine that the encroachment will not interfere with operations (i.e. snow removal and will be erected pursuant to the requirements of the National Building Code, we have completed our due diligence. Additionally, and as indicated below, the applicant (property owner is required to provide and maintain liability insurance, indemnifying the City from potential liability associated with the encroachment. CURRENT STATUS / SITUATION ACTUELLE RECOMMENDATION / RECOMMANDATION THAT an Encroachment Agreement be entered into between the City of Moncton and the owners of the property at 83 Botsford Street, Immeuble INCITE Realty Inc., to allow the encroachment of the proposed awnings, and that the Mayor and City Clerk be authorized to sign the Agreement and affix the Corporate Seal of the City of Moncton thereto. OTHER OPTIONS / AUTRES OPTIONS Refuse the request. These requests, as indicated above, are routine and approved as a matter of course. RISK ANALYSIS / ANALYSE DE RISQUES We require a full indemnity and proof of insurance prior to allowing installation of the awnings. With most encroachments we allow for thirty (30 days notice if we will require removal. Most encroachments are to permit awnings over the street.

The Department of Engineering and Environmental Services, together with the Building Inspection Department, have been consulted with respect to this request and have no objection to the City entering into an Encroachment Agreement to accommodate the said awnings/canopy signs. Both Departments require that the drawings be stamped by an engineer licensed to practice in the Province of New Brunswick and that the awnings/canopy signs conform with Section 136 of the Zoning By-Law : Canopy signs Interdepartmental Consultation Consultations interdépartementales 136. 8 THIS ENCROACHMENT AGREEMENT made in duplicate this of, A.D., day BETWEEN: The City of Moncton, a municipal corporation, duly incorporated under and by virtue of a Special Act of the Legislative Assembly of the Province of New Brunswick, of 655 Main Street, Moncton, NB E1C 1E8, hereinafter called the "City" Of the First Part; AND: Immeuble INCITE Realty Inc. of 83 Botsford Street, in the City of Moncton, County of Westmorland, and Province of New Brunswick, E1C 4X2, hereinafter called the "Applicant", Of the Second Part; WHEREAS the Applicant is the owner of the premises situate at 83 Botsford Street, in the City of Moncton, and the City is the owner of adjoining lands upon which the awnings encroach over City-owned property as shown on Schedule "A ; and WHEREAS the Applicant has applied to the City for a license to encroach upon the lands owned by the City for the purpose of accommodating the said awnings; and WHEREAS by resolution of City Council of, the City has granted leave and license to the Applicant, in consideration of the rents and covenants hereinafter specified, to encroach upon the lands and premises as set out and described in Schedule "A", hereto annexed, upon the terms and conditions hereafter set out. NOW THEREFORE THIS AGREEMENT WITNESSES: 1. The City hereby grants to the Applicant leave and license to encroach upon the said lands of the City for the purpose of accommodating the awnings which shall be deemed to be with the express licence and consent of the City to the intent that neither the Applicant nor any person claiming under it, shall acquire any easement or other right in respect of the awnings, or in the said lands. 2. The Applicant shall remove any portion of the awnings encroaching upon the said lands, to the extent of the encroachment, immediately upon the City giving the Applicant 30 days notice to do so. 3. Should the Applicant fail, neglect, refuse or be unable to remove the awnings encroaching upon the said lands within thirty (30 days notice to do so, the City may remove the encroachment, including the awnings which are encroaching, and carry out repairs or reconstruction as required to prevent damage from weather or other hazard, and the Applicant hereby covenants to pay the costs of such removal and repair forthwith upon demand being made by the City. 4. Service of the notice required under this agreement shall be sufficient when mailed by ordinary post to the Applicant at its last known place of business. 5. The Applicant shall comply with all lawful requirements affecting the said lands or the premises appurtenant to this encroachment, including municipal by-laws of the City, and shall at all times keep the said lands and premises in a clean and neat condition satisfactory to the City.

All repairs, renovations, alterations, extensions now or hereafter made on, in or to this encroachment, shall be subject to the approval, in every particular, of the City and shall during the existence hereof be in exact accordance with such instructions as may from time to time be given with respect thereto by the City, including removal of the encroachment. 7. The Applicant covenants and agrees to save harmless and keep indemnified the City of Moncton, its successors and assigns, from and against all actions, suits, proceedings, claims, demands, costs and expenses whatsoever, which may be taken or made against it in anyway whatsoever by reason of the aforesaid encroachment or demolition of same, and to keep in force liability insurance in the amount of two million dollars ($2,000,000 for this purpose during the period this agreement subsists. Further the Applicant covenants and agrees that the City will not be liable for any damage caused to the encroachment when caused by normal maintenance or repair of the right-of-way, including, but not limited to sidewalk repair, street renewal, or snow removal. 8. The City may act in respect of any covenant, term or condition herein contained by any of its officers or servants having the management or supervision of its business or of a division thereof, including for greater certainty but not restricted to the Director of Building Inspection, City Clerk, General Manager Engineering & Environmental Services, General Manager Finance and Administration, and the City Solicitor, or the authorized deputy of any of them. 9. The City, its servants and agents shall at all times and for all purposes have full access to the encroaching part of the said lands. 10. The Applicant agrees to pay to the City for and in consideration of the sum of two hundred and fifty dollars ($ of lawful money of Canada to it in hand well and truly paid by the Applicant, at or before the ensealing and delivering of this Agreement, the receipt whereof is hereby acknowledged. THIS AGREEMENT and everything herein contained shall enure to the benefit of and be binding upon the heirs, executors, administrators, successors and assigns of the parties hereto respectively. All residents on the affected closure area have been notified of this annual event and they will be distributing 400 flyers to the community to encourage them to attend the event. Street closure requested is of Broadview Avenue from Grandview Drive to Orchard Drive, leaving both intersections open to thru traffic. The following event was approved by the Events Management Committee. CURRENT STATUS / SITUATION ACTUELLE The Halloween House Block Party is inviting people from the neighborhood to celebrate Halloween and make donations to the Open Hands Food Bank Inc. While creating a friendly atmosphere within the neighborhood, they help support the whole community. RECOMMENDATION / RECOMMANDATION That the organizers of Halloween House Block Party be granted permission for the following street closure: Broadview Avenue from Grandview Drive to Orchard Drive, leaving both intersections open to thru traffic, from 1:00 pm until 7:00 pm Saturday October 25, Further, that they be granted permission for same street closure on Sunday October 26 in the event of cancellation due to rain on Saturday October 25. CURRENT STATUS / SITUATION ACTUELLE A request has been received in Economic Development and Events from the Greater Moncton Majesta Santa Claus Parade Committee requesting permission to hold the 2014 Santa Claus Parade on Saturday, November 22, The Events Management Committee approved this request on Friday, October 3, The 2014 parade route for public viewing begins at the corner of Main Street and Cameron Street, heading east on Main Street, where it will conclude at Champlain Street and Paul Street in Dieppe. Street closures are requested as follows for Saturday November 22, 2014: For parade staging, a street closure is requested of Vaughan Harvey Boulevard from Collishaw Street to Main Street from 1:00 p.m. until the end of the parade (leaving both Main Street and Collishaw Street open to traffic. For the parade, a street closure is requested of Main Street from Vaughan Harvey Boulevard to Moncton City limits at Hall s Creek from 6:00 p.m. until the end of the parade. The closed streets will be reopened as the parade passes. RECOMMENDATION / RECOMMANDATION That organizers of the Santa Claus Parade be granted permission for street closure(s as follows for Saturday, November 22, 2014: For parade staging, Vaughan Harvey Boulevard from Collishaw Street to Main Street from 1:00 p.m. until the end of the parade (leaving both Main Street and Collishaw Street open to traffic; and For the parade, Main Street from Vaughan Harvey Boulevard to Moncton City limits at Hall s Creek from 6:00 p.m. until the end of the parade. The event has raised a grand total of $788,000 over the last nine years. Funds are not only earmarked for the Lions Sick Children s Fund, but, many other local charities as well. CURRENT STATUS / SITUATION ACTUELLE The two day event engages high school students, corporations and community groups in friendly competitions and has over the years become a popular spring event in our community. Ms. Murphy and Mr. McConnell wish to thank council and inform citizens of their appreciation of the continued support provided by the City over the years. They will also provide highlight of events that will take place d during the Greater Moncton Dragon Boat Festival s 15 th anniversary year.
