Box 2388 Decatur, Alabama (256) telephone (256) fax POSITION ANNOUNCEMENT POSITION: TERM: LOCATION: General Legal and Posting Clerk At will full-time employment Decatur, Alabama OPENING DATE: December 1, 2015 CLOSING DATE: December 14, 2015 SALARY: RESUMES TO: $40,000 subject to work experience, education, and other factors. with copies to: The Standing Chapter 13 Trustee for the Northern District of Alabama Northern Division ( Trustee ) is accepting applications from qualified individuals for employment as a General Legal and Posting Clerk ( Clerk ) in the Trustee s office. The Clerk position is a full-time position located in the offices of the Chapter 13 Standing Trustee for the Northern District of Alabama, Northern Division (Decatur, Alabama). The position requires accounting, computer knowledge and skills, including excellent keyboard and word processing skills, the

2 ability to communicate and write grammatically, and having knowledge or experience in the laws and rules governing consumer bankruptcy or the background and ability to rapidly gain such knowledge. The Clerk reviews Chapter 13 bankruptcy cases assigned to the Trustee by the U.S. Bankruptcy Court for the Northern District of Alabama, Northern Division and assists in posting lockbox payments to the proper bankruptcy case. Key Responsibilities and Duties: The duties of the position are comprehensive and demanding, as indicated by the Job Requirements and Qualifications listed below. The Clerk shall assist the Trustee in complying with all provisions of the United States Bankruptcy Code and Procedure, and with the instructions of the Bankruptcy Court (hereinafter Court ). The Clerk shall assist the Trustee in cooperating fully with the Clerk of the Court and the U.S. Bankruptcy Administrator. The Clerk shall assist the Trustee in meeting the duties of a fiduciary, which requires the diligent exercise of good faith and loyalty in the administration of Chapter 13 cases under the Trustee s supervision. Additionally, the Clerk shall assist the Trustee in accounting for all property received. The Clerk is responsible for reviewing consumer bankruptcy cases prior to confirmation, electronically filing objections and motions, and providing information as required to the U.S. Bankruptcy Court. The Clerk will correspond with attorneys and debtors and must have the ability to express him or herself verbally and in writing in a professional manner. The Clerk will be responsible for posting lockbox payments to the proper bankruptcy case. The Clerk will send correspondence to Chapter 13 debtors regarding their payments. The Clerk will also write to or speak with employers or other third party payers regarding payments. The Clerk must be accurate in posting and in dealing with debtors and employers. The Clerk must be able to key data quickly and accurately. The Clerk must be able to work under time constraints with minimum errors. The Clerk s job duties are subject to change and additional duties may be assigned to the Clerk. Applicants are preferred but not required to have some work experience in the field of bankruptcy law and/or accounting. Applicants must be responsible, tactful, possess good judgment and initiative, be able to work harmoniously with others in a team-oriented work environment, and be able to communicate effectively, both verbally and in writing. The selected applicant will be subject to a one year introductory (probationary) period of employment. A knowledge/skills/abilities assessment may be required of applicants.

3 The Clerk is an at will employee serving at the discretion and instruction of the Trustee. Accordingly, his or her employment may be terminated at will by either the Trustee or the employee. Relocation expense and interview expense reimbursements are not available. Duty Station: The duty station will be in Decatur, Alabama. Job Requirements and Qualifications: College studies or equivalent education in law, accounting, business and computer and/or substantial experience in a legal practice or accounting firm; Excellent computer skills and ability to quickly learn specialty software; Ability to analyze and extract pertinent information from consumer bankruptcy petitions and schedules; A high degree of accuracy in work; Ability to draft pleadings and correspondence with little or no assistance, and the ability to communicate professionally; Knowledge and skills in the use of information technology and in the use of personal computer software applications; Fast and accurate typing and calculating skills; Skills to accurately and courteously resolve issues for debtors, creditors, attorneys, court personnel and bankruptcy administrator personnel. A positive attitude with an emphasis on teamwork and a willingness to help others succeed in their jobs is critical. Understanding of the theory and process of writing, depositing, posting and clearing checks and other financial instruments; Knowledge, skills and experience or full understanding of payment posting; Ability to analyze and extract pertinent information from payment remittance letters, checks, money orders, and employer remittances;

4 Job Qualifications: To be qualified for employment an applicant should: 1. Possess integrity and good moral character; 2. Be able to assist the Trustee in performing his duties satisfactorily; 3. Be free of prejudices against any individual, entity or group of individuals or entities which would interfere with unbiased performance of duties assisting the Trustee; 4. Not be related by affinity or consanguinity within the degree of first cousin to a Judge presiding in the Northern District of Alabama, the U. S. Bankruptcy Administrator for the Northern District of Alabama, a federal judicial officer in the Northern District of Alabama, or a federal court employee in the Northern District of Alabama; 5. Not be related by affinity or consanguinity within the degree of first cousin to any active member of the panel of Chapter 7 Trustees, Chapter 12 Trustees, this Trustee, or another Chapter 13 Trustee in the Northern District of Alabama; 6. Not be employed by a state, county, or municipal governmental agency that appears before the Bankruptcy Court as a creditor when employment with the Trustee begins; 7. Not be employed by the Federal government when employment with the Trustee begins; 8. Have the ability to assist the Trustee in providing timely and accurate reports required by the Court, the U.S. Bankruptcy Administrator and the Administrative Office of the U.S. Courts. 9. Exhibit by demeanor, character and personality that the applicant would be able to competently assist the Trustee in performing and discharging his required duties; 10. Have the ability to create and edit correspondence on word processing software;

5 11. Have good communication skills; and 12. Have basic knowledge of accounting principles based upon education or experience. The selection process will be confidential and competitive. After the Trustee or his designee has reviewed all applications, the best suited, most qualified applicants will be interviewed in confidence. The Clerk s annual salary and benefits are part of the Trustee s annual operating budget, which is subject to review and approval by the Court and the U.S. Bankruptcy Administrator. In addition to this salary, benefits presently include, subject to applicable participation requirements: Participation in a health and dental insurance plan; Participation in a short term disability plan; Participation in a retirement plan; Vacation, sick, and emergency leave; and Ten paid Federal holidays each year.
