1 Job Title: Classification: Reports to: Municipal Court Clerk/ Chief Magistrate Town of Harpersville Full Time Mayor Salary: The Municipal Clerk/Chief Magistrate salary range will be based on experience. Location: Harpersville, Alabama is situated at the intersection in Shelby County approximately 25 miles southeast of Birmingham. The Municipal Clerk/Chief Magistrate salary range will be based on experience. Job Summary: Description: Under administrative direction, receives incoming calls and visitors to Judicial Department; provides accurate information, makes appropriate referrals. Assists customers on Plea Day; performs a variety of secretarial services; maintains files, and retrieves information as requested. Constructs complaints and establishes probable cause; sets bail and prepares necessary paperwork, reports, and correspondence. Prepares and records cases, maintains files, and retrieves information. Issues warrants; performs data entry, and follows established procedures for preparing Court docket. Performs procedures for suspending driver s licenses, failure to appear, and failure to pay cases; administers final forfeiture proceedings. Oversees filing of appeals; maintains records of appeals and tracks appeal cases. Prepares and records cases, maintains files, and retrieves information. Receives pleas, takes depositions, receives and prepares reconciliation of monies. Maintains certification, assists Mayor and City Clerk as needed; and performs other related duties as required. Examples of Duties: Arrest Warrants Interviews victims, law enforcement officers, and witnesses; assesses additional information for warrant procedures. Constructs complaints, compiles statements from witnesses for evidence to ensure the charge fits the offense. Establishes probable cause and determines that all elements required in the State Criminal Code have been met. Prepares necessary paperwork for arrest procedures. Sets bail in municipal ordinance violations. Issues warrants.

2 Reception and Communications Receives incoming calls, takes messages, and forward calls. Assists window customers, receives money, and provides accurate information and instructions regarding cases. Assists window customers on Plea Day and Trial Day, receives money or returns order for court appearance. Receives complaints from the public and refers them to the appropriate party. Establishing Probable Cause Assumes Magistrate powers; establishes probable cause, issues warrants, constructs complaints. Obtains evidence or proof of the complaint. Evaluates complaints and issues warrants. Interviews multiple sources to investigate a complaint and records depositions. Reviews Incident/Offense reports. Docket Preparation Reviews, assesses, and issues failure to appear and aliases from the plea docket and trial docket. Consults with attorney regarding times and dates for court hearing. Prepares and issues subpoenas for all witnesses scheduled to appear for Court. Prepares docket for Court. Reviews files for subpoenas and distributes to appropriate parties. Issuance of Arrest for failure to Appear Cases. Performs procedures for suspending driver s licenses. Issues Failure to Appear Warrants on non-compliance of court orders and court appearance date cases. Issues Failure to Appear Notices on minor traffic violations. Issues Failure to Pay Warrants. Administers Final Forfeiture proceedings (bonds). Appeals and Related Duties Coordinates with defendant s legal counsel, defendant, and sureties for filing appeals. Follows Code of Alabama filing requirement for Circuit Court Appeals. Maintains all records of appeals for court records. Tracks appeal cases until adjudicated at Circuit Court level. Assumes responsibility for money after cases have been adjudicated and applies to fine. Issues warrants and shows cause for failure to pay. Reconciles money drawer. Performs duties of Chief Magistrate as needed. Performs other related duties as required.

3 Administration Performs duties of Chief Administrative officer of the court. Assists judge in all court proceedings. Ensures proper indexes for reference to actions and proceedings filed in court. Maintains or disposes of all records filed with court, according to records retention schedule. Assumes responsibility for adjudication over municipal parking violations. Attends all Council meetings, staff meetings, and work sessions. Assumes Magistrate powers; establishes probable cause, issues warrants, constructs complaints. Perform administrative tasks which judge is not required to perform. Disburses money to state agencies as required. Reviews previous year s budget; establishes and monitors municipal court budget. Serves as liaison between the judge, police department, attorneys, and the public. Maintains pending files on court cases Sets bond for felony cases. Generates all monthly reports regarding state funds and city funds, yearly statistics report and all report requested by Judge. Enters, records, and prints orders. Reviews credit card software and applies all credit card payments if applicable. Conducts indigent hearings. Approves all appeals, indigent council and appearance bonds. Technical Directs computer related activities. Interacts with application support software and personnel. Interacts with state agencies related to software programs Public Relations Provides Law Enforcement Officers with forms and laws which effect the operation of the municipal court. Related Duties Receives guilty pleas, takes depositions. Reconciles money drawer Receives payments and updates files to reflect payment. Performs background checks Assists other office personnel. Performs other related duties as required. Assumes responsibility for money after cases have been adjudicated and applies to fine.

Attends all Council meetings, staff meetings, and work sessions. Assumes Magistrate powers; establishes probable cause, issues warrants, constructs complaints.

4 Education and Minimum Requirements to Perform Essential Job Functions Associate s degree (A.A.) or equivalent from two-year College or technical school; or six months to one year related experience and/or training; or equivalent combination of education and experience. Criminal Justice or Related Experience preferred. Alabama Magistrate certification required. Valid Alabama driver s license required. Must be U.S. citizen Willing to travel as required. Willing to work overtime, weekends, and shift as required. Willing to maintain continuing education credits as prescribed by Alabama Law. Willing to work on call. Maintains certification through continuing education. Typical Qualifications: Knowledge of the Town of Harpersville policies and procedures Knowledge of local and state laws pertaining to criminal offenses. Knowledge of legal language interpretation. Knowledge of court policies and procedures. Knowledge of Alabama State Code Knowledge of regulations governing filing and recording complex legal instruments. Knowledge of Harpersville City Ordinances Knowledge of educational instruction techniques Skill in utilizing computerized information in performance of court related duties. Skill in performing basic computer functions. Skill in appraising employee performances consistent with the City policy including counseling and resolution of individual employee performance problems. Ability to organize work, establish, and maintain an appropriate organizational structure, and delegate authority to the staff to accomplish plans. Ability to lead and motivate groups of subordinates engaged in diverse activities. Ability to make sound impartial decisions in stressful situations. Ability to effectively communicate verbally with the public as well as the police department. Ability to establish and maintain an effective working relationship with associates and the public. Ability to make competent and timely decisions. Ability to maintain records efficiently and accurately. Ability to organize and accomplish task in a timely manner. Ability to function in a stressful environment. Ability to remain neutral between judicial and law enforcement functions.

Criminal Justice or Related Experience preferred. Alabama Magistrate certification required. Valid Alabama driver s license required. Must be U.S. citizen Willing to travel as required.
