3 INTRODUCTION About ONC and the ONC HIT Certification Program The Office of the National Coordinator for Health Information Technology (ONC) is required by statute to perform certain duties in a manner consistent with the development of a nationwide health information technology (HIT) infrastructure that, among other things, allows for the electronic use and exchange of information. ONC is required under section 3001(c)(5) of the Public Health Service Act (PHSA), in consultation with the Director of the National Institute of Standards and Technology, to keep or recognize a program or programs for the voluntary certification of HIT as being in compliance with standards, implementation specifications, and certification criteria adopted by the Secretary of Health and Human Services (the Secretary) under section 3004 of the PHSA. The ONC HIT Certification Program is a voluntary certification program established by ONC to provide for the certification of HIT to the standards, implementation specifications, and certification criteria adopted by the Secretary. Certification provides assurances that technologies have certain capabilities as included in adopted standards, implementation specifications, and certification criteria. Certified technologies can be used by eligible providers to meet the Certified EHR Technology definition under 45 C.F.R and to attempt to achieve meaningful use objectives and measures under the CMS Medicare and Medicaid EHR Incentive Programs. ONC Certified HIT Certification and Design Mark The ONC Certified HIT certification and design mark (Mark), as identified below, represents that a HIT was certified under the ONC HIT Certification Program. This document contains a series of guidelines that help ensure proper use of the Mark. These terms of use are intended for use exclusively by authorized users (see the section Who Is Authorized To Use The Mark, infra) who wish to use or display the Mark consistent with these terms of use. 4 WHO IS AUTHORIZED TO USE THE MARK ONC administers use of the Mark. ONC-Authorized Certification Bodies (ONC-ACBs), 1 on behalf of ONC, may grant use of the Mark to HIT developers, consistent with the criteria and terms herein, for use with HIT that is certified under the ONC HIT Certification Program. CHARACTERISTICS THAT THE MARK REPRESENTS The Mark, as used by an authorized user, represents that a HIT has been: 1) Tested in accordance with test tools and test procedures approved by the National Coordinator; and 2) Certified in accordance with: a. Adopted standards, implementation specifications, and certification criteria; and b. Requirements of the ONC HIT Certification Program. Test tools and test procedures approved by the National Coordinator can be accessed through the main ONC HIT Certification Program web page found at: Test tools and test procedures are approved for each adopted edition of certification criteria. 2 Adopted standards and implementation specifications can be found at 45 C.F.R. HOW THE CERTIFYING BODY VERIFIES THOSE CHARACTERISTICS Under the ONC HIT Certification Program, certification activities are performed by ONC-ACBs in accordance with the requirements of 45 C.F.R. Part 170, Subpart E. 1 ONC-ACBs are certification bodies authorized by ONC to conduct certification under the ONC HIT Certification Program. 2 The test tools and test procedures for the 2014 Edition EHR certification criteria can be found here: 4

5 HOW THE MARK MAY BE USED An authorized user may reproduce and display the Mark on its web site as well as in marketing materials, communications statements, and other assertions related to certified HIT products, subject to the following conditions and limitations: Placement The Mark should be displayed adjacent to and in close proximity with the product(s) to which it refers. At a minimum, the Mark must not be displayed in a manner that could reasonably give rise to ambiguity or confusion concerning which product(s) the Mark is referring to or the nature of the certification that those products have obtained. For example, the Mark must not be displayed above a list of both certified and uncertified products. Similarly, when accompanied by text referring to a particular edition of certification criteria (e.g., 2014 Edition) or type of product (e.g., Complete EHR), the Mark must not be displayed in connection with products that have not been certified to that specific edition or were not certified as the product type indicated. Accompanying Text The Mark may either be displayed as is (i.e., without any accompanying text) or accompanied by text referencing: The edition of the certification criteria (e.g., 2014 Edition) to which the relevant product(s) have been certified; or The type of product(s) certified (e.g., Complete EHR or EHR Module), provided that the relevant edition of certification criteria is also referenced. No text other than the above variations may accompany the Mark. Accompanying text must be positioned either below or to the right of the Mark, never above or to the left. The following examples illustrate these requirements. The following Mark and accompanying text would be acceptable for use with all products certified to the 2014 Edition EHR certification criteria (2014 Edition), including Complete EHRs and EHR Modules: 5

6 As an example, the following use of the Mark with accompanying text would be acceptable for Complete EHRs certified to the 2014 Edition: In the examples above, 2014 Edition can be replaced with any edition that ONC-ACBs use to certify HIT under the ONC HIT Certification Program. Similarly, Complete EHR can also be replaced with EHR Module or any other type of certification that may be issued by ONC-ACBs under the ONC HIT Certification Program. Accompanying Marks, Logos, and Symbols: The Mark may be accompanied by or displayed alongside one or more of the following: The relevant ONC-ACB s certification mark, logo, or other identifying symbol. The relevant HIT developer s company mark, logo, or other identifying symbol. However, the Mark s dimensions must be no less than 75% of the width and 75% of the height of any such accompanying mark, logo, or symbol. The following examples illustrate these requirements (another sequence of the marks is also acceptable but not illustrated): 6

7 Other Requirements and Guidelines: The Mark s graphical design elements and text may not be altered in any way. Clear Space The minimum amount of clear space on the left, bottom, and right is equal to the x-height of the tallest letter. Minimum Size The size of the Mark will affect legibility and overall impression; it should always be sized as specified in these guidelines. For print, the minimum size of the Mark must not be smaller than two inches wide. For web, the minimum size of the Mark must not be smaller than 200 pixels wide. 7

8 Incorrect Usage In order to maintain the integrity of the Mark, it is essential that the ONC identity be used correctly. Always use the Mark as provided. The logo must always appear. Do not alter the position of the Mark elements. Do not alter the aspect ratio of the Mark. Do not stretch or distort the Mark. Do not alter the color of any of the Mark elements. Do not use any of the Mark elements to create a new mark or graphic. Do not use the Mark on background colors, images, or other artwork that interfere with the legibility of the Mark. Do not rotate the logo or any of its elements. Preferred Color Palette Use the following color palette for identity program components on all graphic communications materials. Match the indicated colors as closely as possible. For four-color process printing (also known as full-color printing), refer to the CMYK values indicted. For software like Microsoft Word or Microsoft PowerPoint, refer to RGB (print/on-screen). For web applications, refer to the RGB web values or hexadecimal web values. For printing on coated and uncoated paper, use the PANTONE and CMYK values provided. 8

9 HOW THE USE OF THE MARK IS SUPERVISED The Mark may be used only: In conjunction with products that have been certified under the ONC HIT Certification Program; and According to the usage guidelines included in these criteria and terms of use. MISUSE OF THE MARK An ONC-ACB or HIT developer that has HIT certified under the ONC HIT Certification Program is required to inform ONC of any alleged misuse of the Mark that the ONC-ACB or HIT developer becomes aware of. PROCEDURE FOR RESOLVING DISPUTES For disputes regarding proper use of the Mark, HIT developers may file a complaint with ONC. However, developers should make every attempt to resolve the dispute directly with the relevant ONC-ACB. 9
