Rainbow International of North York (together with its agents and/or subcontractors, RAINBOW ) have been retained by the Condominium Corporation and/or the owners, ( Customer ) to provide Emergency Water Restoration Services ( Services ) to help mitigate further damage. RAINBOW agrees to perform the Services in a professional and competent manner in accordance with applicable laws, regulations, rules and policies. The Customer acknowledges and agrees that RAINBOW is an independent contractor and not an employee, agent or partner of the Customer. UNRELATED CONDITIONS. The Customer acknowledges and agrees that RAINBOW shall not be liable for addressing or correcting any damage/conditions to areas that are unrelated to the event(s) that necessitated the Services. The Customer acknowledges and agrees that RAINBOW shall not be liable for: (a) conditions that preexisted the event(s); (b) harm or damage that results from premature removal of equipment or premature termination of Services; (c) harm or damage that results from any refusal by the Customer to allow RAINBOW to perform the procedures recommended, according to standards set out in IICRC S500, third edition or (d) any harm or damage to any structures, personal contents, upgrades or improvements that result during or from the provision of the Services, unless caused by the gross or willful negligence of RAINBOW. Mould and Bacteria can start to develop within 48-72 hours following a water loss. There are potential health risks when moisture is allowed to remain on a growth medium (ex. Owner/Customer acknowledges and agrees that any Services related to personal contents, upgrades and improvements, including but not limited to: content manipulation, blocking and padding of furniture, moving and resetting appliances, and removal and disposal of Improvements are not covered by the Corporations Insurance. These items are the responsibility of the Owner/Resident and may be charged back to the unit when such Services are not insurable by the Condominiums Insurance. The Customer acknowledges and agrees that a service fee of $50.00 per hour per technician will be charged in the event that personal contents, upgrades or improvements need to be moved or removed in order for RAINBOW to provide the Services. If personal contents remain in the unit, it is acknowledged and agreed by the Customer that any equipment rental necessary for drying and preventing secondary damage to personal contents, upgrades and improvements, may be charged back to the unit, for such Services that are not covered by the Condominium Insurance coverage. The Customer or contact shall verify all Services and equipment as detailed on the Customer Instruction/Responsibility Form, and Emergency Service Details Form. 4. INVOICING. Declarations, by-laws, schedules, rules and/or policies related to disaster remediation and insurance requirements are specific to the individual Condominium Corporation. It is the responsibility of the Owner, the Condominium Corporation and the Broker representing the Insurance Company to determine insurance coverage requirements. If the Condominium Corporation dispatched RAINBOW to mitigate damages, then all invoicing will be sent to Management. A Purchase Order shall be issued immediately. If the owner/resident called RAINBOW directly, then all invoicing will be sent to the owner/resident. The Condominium Corporation will be provided a copy of the invoice for their records. If requested, RAINBOW will e-mail a copy of the invoice to the Customer s insurance carrier(s) as a courtesy. The Customer has been informed of, and agrees that the Customer is personally responsible for any and all deductible(s), depreciation, Services and/or charges not paid by insurance. Current Xactimate pricing will be used with 10% profit and 10% overhead added. The balance is due within 30 days. 5. ENVIRONMENTAL CONDITIONS. Infants, elderly, and individuals with chemical sensitivities or respiratory problems may be sensitive to certain types of products used in the provision of the Services. Botanical Disinfectant is used whenever possible instead of harsh chemicals. Drying Equipment is very loud and can disturb the resident. The resident is advised to arrange alternate sleeping arrangements for up to 5 days for structure drying and completion of the Emergency Services. Thermal Imaging, a non-invasive technology, may be required to ensure that the structure and any affected personal contents, upgrades or improvements are dry. The Customer acknowledges and agrees that RAINBOW may remove any items that IICRC S500, third edition deems as unsalvageable. Full documentation related to disposal will be provided. The Customer acknowledges receipt of and agrees that it has read the Notice and Disclosure Statement. The customer acknowledges the possible health effects with respect to bacteria and mould growth if wet unsalvageable materials are not removed. 6. ACCESS AND SECURITY. The Customer agrees to provide or arrange to provide RAINBOW, and its subcontractors, vehicles and equipment, free and unrestricted access to affected areas in order to provide the recommended Services. If requested by RAINBOW, the Customer will provide additional security to escort emergency technicians into units. Delaying access always increases the cost for services as the category of water loss changes. 7. FORCE MAJEURE. RAINBOW shall not be liable or responsible for any delays or failure in providing the Services or damages arising from, occasioned or caused by strikes, blackouts, lockouts, fire, flood, elements, Acts of God or other causes beyond the control of RAINBOW. Any delays due to any of the above causes, including refusal of services, shall not be deemed to be a breach or failure to perform under this Agreement. 8. ENUREMENT. This Agreement (and any other document pertaining to the provisions of the Services) shall enure to the benefit of and be binding on RAINBOW and the Customer and their respective successors and permitted transferees and assigns of each. 9. GOVERNING LAW. This Agreement (and any other document pertaining to the provisions of the Services) shall be governed by and construed in accordance with the laws of Ontario and the laws of Canada applicable therein and shall be treated in all respects as an Ontario contract. 10. SEVERABILITY. If any provision or portion of this Agreement (or any other document pertaining to the provisions of the Services) is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable, such determination shall not impair or affect the validity, legality or enforceability of the remaining provisions of this Agreement (or any other document pertaining to the provisions of the Services), and each provision or portion thereof shall be considered to be separate, severable and distinct. NOTICE AND DISCLOSURE STATEMENT AVOIDING MOULD AND UNDERSTANDING WATER DAMAGE What You Should Know about Mould Mould is a type of fungus. It occurs naturally in the environment. It spreads by means of microscopic airborne spores. Mould is found everywhere that life can be supported. It requires certain conditions to grow. First and most importantly, mould growth requires moisture. By minimizing moisture, you can reduce or eliminate the risk of mould growth. Spills, leaks, overflows, condensation, and high humidity are common sources for mould growth. Good maintenance practices are essential in the effort to prevent or eliminate mould growth. If moisture is allowed to remain on the growth medium, mould can develop within 48 to 72 hours. Immediate action is essential to avoid mould! Consequences of Mould All moulds are not necessarily harmful, but certain types of mould are believed to have adverse health effects in susceptible persons, such as allergic reactions, skin irritation, and respiratory problems. Individuals with suppressed immune systems may risk infections. However, experts disagree about the level of mould exposure required to cause health problems, and the U.S. Center for Disease Control and Prevention (CDC) has stated: At present there is no test that proves an association between Stachybotrys Chartarum (Stachybotrys atra) and particular health symptoms. What you can do You can take positive steps to reduce or eliminate the occurrence of mould growth in your home, office or building, and thereby minimize any possible adverse effects that may be caused by mould. These steps include but are not limited to the following: 1. Report any water damage immediately. Should you hear a dripping sound, or water pressure is low, please report it to the Superintendent or management immediately. 2. Try to prevent further damage. The longer water is allowed to remain in your unit the more damage it will cause. Having the ability to turn off the water supply in your unit will stop the source of water faster. Water will travel to your laminate, engineered hardwood, carpeting or any other flooring very quickly. Depending on the material composition, the flooring may or may not be salvageable once water has penetrated the surface. Place towels to absorb the water or place a bucket to the catch dripping water. Try to protect your personal contents, upgrades and improvements. 3. Floor coverings are often excluded from the Standard Unit Description by means of a by-law, therefore deeming all flooring as an improvement. Corporation s Insurance Policy. The Condominium Corporations Insurance Policy would cover repairs to items that are part of the Common elements, such as drywall and concrete flooring, etc. The services related to salvaging, removal and replacement of improvements and personal contents would be at the owner s expense, section 92(4) of The Condominium Act, 1998 (Ontario): An owner shall be deemed to have consented to the work done by a corporation under this section and the cost of the work shall be added to the owner s contribution to the common expenses. Make sure you have appropriate Unit Owners Insurance based on the insurance section(s) of your Condominium Corporations declaration, description, schedule, and by-laws related to Standard Units, deductible application and rules related to emergency procedures. A reasonable amount of time with regards to Complex Residential Loss Condominium water escape, is immediate, during the emergency services! All delays increase costs. Invoicing will be divided up according to what constitutes a Standard Unit, section 43 (5) h. of The Condominium Act, 1998 (Ontario) if possible. Costs associated with improvements and personal contents may be invoiced separately. The Corporation must ensure payment of these charges, when the Corporation initiates emergency services on behalf of the unit owner. 4. Keep the humidity in your home, Condominium, Office or Commercial Property low. Vent clothes dryers outdoors. Ventilate kitchens and bathrooms by opening the windows, using exhaust fans, or by running the air conditioning to remove excess moisture in the air and to facilitate evaporation of water from wet surfaces. Inspect for leaks on a regular basis. Look for discoloration or wet spots. Act on the repair as soon as possible to avoid further damage. 5. Promptly clean up spills, condensation and other sources of moisture. Repair/report any leaks promptly. Wet materials should be professionally dried quickly or they may have to be replaced. Rainbow International is trained in professional restoration techniques to promptly dry wet materials using Applied Structure Drying / Rapid Structure Drying which encourages drying all material at once. We avoid using harsh chemicals. 6. Porous materials, such as fabric, upholstery or carpet with visible mould growth should generally be discarded. If the mould growth is extensive, call a qualified mould remediation company, do not do anything yourself. Check with your Condominium Corporation to clarify who has responsibility to correct problems if any are found. Early detection always reduces damage and thereby saves money. Exposed tackless (broadloom) strips are a danger even when covered. Take care when walking near sharp strips. Floors are slippery when wet; take extreme care when walking on or from wet flooring materials. Walking from wet carpeting to other flooring (ceramic, laminate, wood) is extremely dangerous.
