Building Act - Permits S16 of the Building Act requires a building permit for building work unless exempted by the Regulations. Schedule 8 of the Building Regulations lists the type of works that are exempt from the requirement to obtain a building permit. Usually there are criteria that must be met in order for the exemption to apply. If in doubt, contact the MBS for guidance. It is not possible to issue a retrospective building permit. Works undertaken without a permit can potentially result in far greater costs than would have otherwise been the case and also could impact on any potential insurance claim in the future.
Building Act Essential Safety Measures Owner of building is responsible for upkeep and maintenance of essential safety measures. ESM are defined in Schedule 9 of Building Regulations. Applied to all buildings other than a house or outbuilding. Owners must prepare annual ESM report and keep maintenance records. MBS or CFA is responsible for enforcement.
