HAPTICATHON Regulations (hereinafter referred to as the Regulations ) 1 GENERAL PROVISIONS 1. This Regulations specifies the terms and rules for the event called Hapticathon, featuring a contest for creating an application for mobile phones, which uses an ultrasonic haptic technology, or developing an already existing application, whose functionality is connected with haptic technology (hereinafter referred to as the Project ). The app has to work on TPad, hereinafter referred to as the Device. 2. Hapticathon is organised by: White Ducky Sp. z o.o. Sp. k., with registered office at ul. Zwierzyniecka 3, 60-813 Poznań, Court Register Number (KRS): 0000375836, tax identification number (NIP): 779-23-87-916 and Programa.pl Sp. z o.o., ul. Poplińskich 5/9, 61-573 Poznań, NIP 781-188-07-48 (hereinafter referred to as the Organisers ). 3. Hapticathon will be held between 8-10 May 2015 in Poznań. Exact date and location of the event as well as the detailed schedule will be later notified by the Organisers via Facebook. 4. Leading theme of Hapticathon is usage of haptic technology in mobile apps. 2 TERMS AND CONDITIONS FOR PARTICIPATION 1. Participation in Hapticathon is voluntary and free of charge. 2. In Hapticathon may participate all adults that have knowledge and skills adequate to Hapticathon s specifics, including e.g. from the area of programming Android apps (hereinafter referred to as the Programmer ) and/or from the area of arts, psychology, cognitive science, neuroscience, user experience and/or creation of business models, creation and/or graphic design or other (hereinafter referred to as the Creative Person ). 3. Registration can be done by filling in a registration form available on the following url address https://hapticathon.typeform.com/to/knnj5s by 11:59 p.m. on 29.04.2015. Completing the registration form does not guarantee participation in Hapticathon, subject to point 4. 4. Due to a limited number of places, the Organisers reserve themselves the right to select participants of Hapticathon based on the delivered registrations, at their sole discretion. Person classified for participation in the contest (hereinafter referred to as the Participant ) will be informed about this fact via email by 11:59 p.m. on 1.05.2015. 5. The condition for participating in Hapticathon is acceptance of the provisions of this Regulations (registration is considered acceptance of this Regulations) and registration for the event and obtaining the ticket via Eventbrite system by 05.05.2015 based on the invitation sent via email. 6. In Hapticathon may participate teams consisting of maximum 5 (five) Participants. Each team must consist of one, maximum 3 (three) Programmers and at least one, maximum 2 (two) Creative Persons. All Team members must register individually via the registration form and in the event of being classified for Hapticathon, individually register themselves via the Eventbrite system.

7. A Hapticathon Participant without a Team may join an existing/developing Team prior to Hapticathon, e.g. via the dedicated event on Facebook, or will be assigned to a Team on the day of Hapticathon. 8. The Organiser shall not be liable for the ineffectiveness of applications which have not been received due to reasons not attributable to the Organiser. 9. The Organiser may exclude a participant from the Hapticathon if the participant performs actions with regard to which one may reasonably suspect that they may lead to attempts to circumvent the Regulations or otherwise constitute an attempt to breach securities or Hapticathon rules. 3 RULES, COURSE OF HAPTICATHON AND TERMS AND CONDITIONS OF THE CONTEST 1. Hapticathon will be held on 8-10 May in Poznań. 2. The Organisers provide: access to the Internet via Wi-Fi, access to electrical grid, access to a haptic device in appropriate time slots, multimedia projector, Ppofessional support of Mentors with adequate competences; 3. In the remaining extent, the Participants are obliged to use their own resources, in particular equipment, software and other necessary tools, in particular for test devices with uploaded Android 4.4.2 (API 19) for verification of operating correctness of the created application. The device with haptic technology will be available in a limited way. The Teams, having made sure that the app works on their device, will send an.apk file to the Organiser and the Organiser will upload the app on a device. The Organisers will make sure that the time limit for testing on the device is even and fair. Breaks in access to the device may occur due to e.g. its charging. 4. Prior to the beginning of Hapticathon, the Participants who are Programmers, are obliged to prepare themselves a developer environment according to the indications specified herein. 5. Projects prepared under Hapticathon should meet the following terms and conditions: a. they must be adjusted to Android 4.4.2 (API 19); b. they must refer to Hapticathon s leading theme c. they must use haptic technology within the scope accessible on TPad Failure to include any of the specified terms and conditions in the Project will result in its exclusion from the contest s Projects pool and loss of the right to the award. 4 SELECTION OF WINNERS AND GRANTING AWARDS 1. After finishing works on the Project, a representative of the Team of Participants is obliged to demonstrate the Project to the Contest Jury as well as the audience.

2. The Participants, after finished work, will present the Projects in the order of their submission. 3. Prepared Projects will be evaluated by the Contest Jury composed of Mentors of the Event(Mentors are persons invited by Organisers, who are to help the Participants in completion of Projects). The Contest Jury is composed of at least 5 persons. 4. For presentation of the Project created under Hapticathon, each Team will have 3 minutes. Presentations that do not have at least one part of working prototype will not be evaluated. 5. The Projects will be evaluated according to the following criteria: a. concept 0-5 points b. level of app s advancement 0-3 points what will be taken into consideration here is the general impression regarding the app, its complexity, advancement of app execution. c. presentation of the Project 0-2 points, which allows each member of the Contest Jury to grant a Project maximum 10 points. 6. A member of the Contest Jury individually evaluates each Project. Points may be granted within the scale specified next to the above mentioned criteria (it is only possible to grant whole points). Final evaluation is a total of evaluation given by particular member of the Jury. In the event of draw, the Jury votes on draw Projects. Only 3 first places and possible special awards are announced. 7. Works of the Jury will be documented with a report. 8. Results of the Contest will be announced by the Organisers within the date specified in the schedule. 5 AWARDS 1. The Organiser envisaged awards for Participants of the Teams that will win the Contest. The awards will be announced at a later date on Facebook. 2. The awards cannot be replaced for cash equivalent or any other award. 3. A Participant, who has been granted an award, cannot transfer the rights to the granted award for a third party. 4. The awards will be granted to the winners in person during Hapticathon. 5. The Organiser reserve themselves the right to add additional awards and such change is not considered as a modification of the Regulations. 6. The Organisers do not charge any taxes connected with granting awards. Participants of the Contest keep their tax settlements on their own. 7. - The Organiser shall not be liable for the impossibility of or obstructions to receiving the prize due to reasons not attributable to the Organiser. 6 INTELLECTUAL PROPERTY 1. Participants remain the owners of all intellectual property rights to works and compositions created during Hapticathon.

2. Participants of hackathon undertake to make the source code accessible in the open source formula on an open source licence, however a participant may choose a preferred type of licence. List of all licence types is available on http://opensource.org/licenses. 3. A Participant declares that the Project completed during Hapticathon has been co-authored by them and does not breach any third party rights whatsoever. The Participant also declares that they take all and unlimited by nothing responsibility for any third party claims addressed against the Organisers and which have occurred in relation with the Participant s performance of an economic or professional activity based on the Project prepared during Hapticathon. 4. Each Participant gives the Organisers consent for using any photographs presenting a Project, which have been taken during Hapticathon for internal and promotional purposes. 5. Each Participant gives their consent for disseminating their image under audiovisual registration of the Contents, pursuant to Art. 81 paragraph 1 of an act of 4 February 1994 on copyrights and related rights (Journal of Laws of 2006 no. 90, item 631 with amendments), on exploitation fields of public reproduction and public sharing in such a way that everyone could have an access to it in place and time chosen by themselves, including websites. 7 PERSONAL DATA PROTECTION 1. Personal data shared by the Participants of Hapticathlon is administered by White Ducky Sp. z o.o. Sp. k., with registered office at: Zwierzyniecka 3, 60-813 Poznań, KRS number: 0000375836, NIP: 779-23-87-916 and Programa.pl Sp. z o.o., ul. Poplińskich 5/9, 61-573 Poznań, NIP 791-188-07-48. The personal data of the Contest Participants shall be processed pursuant to the Personal Data Protection Act. 2. By completing a registration form for Hapticathon a Participant gives consent and authorises the Organisers to process their personal data only for purposes subjectively connected with Hapticathon. 3. The personal data shall be provided voluntarily, however such provision shall be necessary for the prizes to be awarded. Under the provisions of the Personal Data Protection Act, the persons making their personal data available have the right to: access the data, amend the data, request the data to be removed, and request the discontinuation of data processing. 4. By participating in Hapticathon a Participant gives the Organisers consent for recording their image on photo and video materials for promotional purposes within an indefinite period of time, without limitations and remuneration. 8 ORGANISER LIABILITY 1. The Organiser shall be not liable for the following in particular: a. problems in the operation of the Hapticathon if these are the result of events which the Organiser exercising due care could not have forecast or prevented, in particular in the case of problems related to acts of God, b. the impossibility for a Participant to apply due to reasons not attributable to the Organiser.

2. The Organiser reserves the right to cancel the Hapticathon should this be necessary due to a technical failure, a final and conclusive court ruling, an administrative decision, an amendment to the provisions of the law in force, or a force majeur event within the meaning of the provisions of the civil law, and due to other reasons not attributable to the Organiser. The Organiser shall notify of the cancellation of the Hapticathon in a manner adopted for the dissemination of information on the Hapticathon. 9 FINAL PROVISIONS 1. Advertising and promotional materials connected with Hapticathon have an informational character only. Binding legal force have exclusively the provisions of this Regulations. 2. Regulations of Hapticathon will be available from the time of opening of Participants registration and during Hapricathon at Organisers. 3. The Organisers reserve themselves right to amend the Regulations, on condition that amending the terms and conditions of this Regulations will not influence the rights acquired by the Participants prior to the amendments in the Regulations coming into force. 4. This Regulations is governed by Polish law. In the event of any dispute in relation to the Contest, the Organiser sand reporting Entities are obliged to amicably settle the dispute. In the event of an ineffective trial to amicably settle the dispute, it may be resolved by a ratione materiae court in Poznań. 5. Correct course of the Contest will be ensured by the Organisers of the contest. In any matters not regulated by this Regulations, the Organisers of the Contest will make decisions, that will be final.
