1 Terms and Conditions of the 4.6 km Charity Walkathon, 23 April km Charity Walkathon I. GOAL OF THE EVENT 1. To popularize and promote running as the simplest form of physical activity. 2. To promote Warsaw and Poland throughout the world. 3. To promote the partners of the 4.6 km Charity Walkathon. II. THE ORGANISER OF THE 4.6 KM WALKATHON The 4.6 km Charity Walkathon (hereinafter referred to as the 4.6 km Walkathon ) is organised by AGENCJA LIVE Spółka z ograniczoną odpowiedzialnością [Limited liability company] with a registered office at Warsaw, Żeromskiego Street 17C, NIP no , REGON no , entered into the register of entrepreneurs of the National Court Register kept by the District Court for Warsaw, 13 th Commercial Division, under KRS no , with the share capital amounting to PLN 100, hereinafter referred to as the Organiser. Personal Data collected as part of the organisational tasks associated with the 4.6 km Walkathon, in line with the Personal Data Protection Act of 29 August 1997 (Dz.U. 2014, item 1182, consolidated text, as amended), shall be administrated by Polski Koncern Naftowy ORLEN S.A. [joint stock company] with a registered office at Płock, Chemików 7 Street (hereinafter referred to as the Personal Data Administrator or PKN ORLEN S.A. ), in line with article 31 of the above act and on the basis of a mutual agreement, the tasks of personal data processing is bestowed upon the Organiser to make possible the organisation of ORLEN Warsaw Marathon and the 4.6 km Walkathon. Disclosure of personal data is voluntary, albeit necessary to take part in the 4.6 km Walkathon as stated in the event s Terms and Conditions. Individuals who chose to disclose their personal data have the right to access said data and amend it, as well as withdraw their agreement for the processing of personal data at any time. The Organiser may process personal data for the needs of organising ORLEN Warsaw Marathon, including actions conducted in cooperation with other entities, to an extent that will ensure satisfactory organisation of ORLEN Warsaw Marathon and the 4.6 km Walkathon. III. DATE AND VENUE 1. The 4.6 km Walkathon shall be held on 23 April 2016 in Warsaw.

2 2. The venue, the starting line and the exact course of the 4.6 km Walkathon shall be made available on the Organiser s website: hereinafter referred to as the Website. 3. Only Participants who have registered for the Walkathon in accordance with the below Terms and Conditions (hereinafter referred to as the Participants ) may take part in the 4.6 km Walkathon. 4. The Organiser reserves the right to change the date and/or the location of the 4.6 km Walkathon, but in such cases takes it upon himself to inform Participants about the change via the Website and sent no later than 24 hours before the scheduled start of the event. Making the abovementioned change does not lead to the Organiser having any additional obligations towards Participants. 5. The course of the Walkathon shall span 4.6 kilometres. 6. Only Participants, the Organiser s personnel, as well as persons and vehicles with a special permit are allowed to be present on the course of the 4.6 km Walkathon. 7. Participants shall take places on the starting line as indicated by the Organiser. 8. No time measurement shall be performed during the 4.6 km Walkathon. IV. TIME LIMIT AND CONTROLS No time limits shall apply during the 4.6 km Walkathon. V. ISOTONIC DRINK STATIONS AND MEDICAL POINTS 1. No drink stations will be located on the course of the 4.6 km Walkathon. 2. There will be mobile medical points located on the course of the 4.6 km Walkathon. VI. PARTICIPATION 1. In order to take part in the 4.6 km Walkathon, the Participant shall: a) Fill in the application form. b) Agree to observe these Terms and Conditions. c) Participants take part in the 4.6 km Walkathon on their own responsibility, being fully aware of any threats and dangers connected with the nature of the event, which may include loss (or impairment) of their health and life. Only persons in good health and with no medical contraindications to their participation in the event may take part in the 4.6 km Walkathon. d) Agree to the processing of the Participant's personal data included in the above-mentioned application form and in the declaration of good health required in order to take part in ORLEN Warsaw Marathon, as well as to the use of such personal data, including their name, surname, sex, date of birth, nationality, address and image in any TV, radio, Internet and printed materials, and to receive information and questionnaires concerning the

3 ORLEN Warsaw Marathon, sent by the Organiser to the Participants addresses. The sample consent form for the processing of personal data and the use of image has been attached hereto as Annex 1, whereas the sample parent or legal guardian consent form for allowing underage persons to take part in ORLEN Warsaw Marathon has been attached hereto as Annex 3. The Participant's personal data may be passed by the Organiser to entities cooperating with the administrator of personal data and the Organiser in preparation of ORLEN Warsaw Marathon and the accompanying events, based on contracts on authorising such other entity to process personal data, pursuant to Article 31 of the Polish Act of 29 August 1997 on protection of personal data (Dz.U. 2014, item 1182, consolidated text, as amended). e) Agree to the use of their image in the form of a photograph or a video recording free of charge. The Participant shall grant PKN ORLEN S.A. and the Organiser a non-exclusive licence, unlimited by territory or by time, to use his/her recorded image within the following fields of use: 1. Recording and multiplication of such image with the use of any known technique, and its distribution in any form, 2. Making copies of such recorded images available to the sponsors and official partners, for the purpose of promoting the sponsor or official partner within the context of their participation in the ORLEN Warsaw Marathon event, 3. Copying such images to computer memory and into a multimedia network, 4. Multiplication of the recorded image, 5. Public display, screening, reproduction, broadcasting and rebroadcasting of such images, as well as making them publicly available in a form that makes it possible for everyone to have access to such images from any place and at a time of their choice, 6. Posting and publishing the recorded image on Internet sites, in the press, on posters and billboards, 7. Broadcast of the recorded image in any TV and radio coverage, 8. Publishing photographs of the 4.6 km Walkathon s Participants taken during the Walkathon (links to photographs and videos will be placed beside the Participants names). f) Submit his/her application in line with the rules specified in point VII of these Terms and Conditions. g) Take part in the verification process at the Competition Office between 21 and 23 April 2016 in accordance with these Terms and Conditions. 2. The Organiser and PKN ORLEN S.A. reserve the right to grant sub-licences for the use of the recorded image specified above to official partners and sponsors of ORLEN Warsaw Marathon

4 and the 4.6 km Walkathon, the scope of which may not exceed the licence granted to the Organiser and PKN ORLEN S.A. 3. Participants under 18 may also take part in the 4.6 km Walkathon, provided they have been registered by their parent or legal guardian through the Website and provided they have presented a consent document to their participation in the 4.6 km Walkathon signed by their legal guardian. The consent, a specimen of which is provided as Annex 3 to the Terms and Conditions, shall be presented in the Competition Office when claiming the commemorative t- shirt. The consent specimen to be signed by the legal guardian may also be downloaded from the Website (available under the tab Participant Area ). 4. Participants under 18 shall carry with them during the 4.6 km Walkathon the statement of the ability to participate in the 4.6 km Walkathon signed by a parent or legal guardian. 5. Parents or legal guardians who have registered a person referred to in points 3 and 4 above for the event shall be fully responsible for participation of such persons in the event. 6. Participants in the 4.6 km Walkathon shall receive a commemorative t-shirt in one of the standard adult sizes and undertake to wear it during the 4.6 km Walkathon. However, due to organisational and technical reasons, the Organiser may not guarantee t-shirts in the appropriate size. 7. Participants shall respect public order, observe any instructions from the event safety personnel and respect other Participants in the 4.6 km Walkathon. The Organiser shall be entitled to remove from the course of the 4.6 km Walkathon any persons who in any manner disturb public order, disturb the organisation of the 4.6 km Walkathon or breach either of these Terms and Conditions. VII. APPLICATION PROCEDURE 1. Applications shall be accepted via the application form available on the Website. 2. The Organiser sets the limit of Participants at 10,000 (ten thousand) individuals. The applications for participation in the 4.6 km Walkathon shall be processed in the order they are received. 3. Applications may be submitted through the Website until 17 April Between 21 and 23 April 2016 applications may be submitted only at the Competition Office during its working hours. The exact location of the Competition Office and its working hours will be disclosed by the Organiser on Website no later than 3 days before the 4.6 km Walkathon. The deadline for submitting applications shall be 23 April Participation in the 4.6 km Walkathon is free of charge. VIII. CLASSIFICATION AND PRIZES The Organiser shall not provide any classification or prizes for the 4.6 km Walkathon Participants.

5 IX. FINAL PROVISIONS 1. The Organiser shall provide medical care along the course of the 4.6 km Walkathon and at the finish line, throughout the entire 4.6 km Walkathon and following its conclusion. All Participants shall be covered by the Organiser s third party liability insurance for the time the 4.6 km Walkathon, under general rules. Individual insurance against an injury or other accident which may take place during the 4.6 km Walkathon requires an insurance coverage to be acquired individually by the Participant. 2. It shall be specifically forbidden to move around the course of the 4.6 km Walkathon by riding a bicycle, in a wheelchair, by roller skating, skateboarding and by riding any other mechanical devices, or being accompanied by animals, without valid consent from the Organiser. The use of Nordic Walking type trekking poles shall also be forbidden. 3. The Organiser shall not be responsible for the Participants' belongings left on the course of the 4.6 km Walkathon. 4. The Organiser shall not be liable for any possible damage made by Participants as a result of their participation in the 4.6 km Walkathon. 5. Participants acknowledge and agree that the Organiser shall be entitled to refuse to allow any Participant to take part in the 4.6 km Walkathon if such Participant does not observe these Terms and Conditions, instructions from the event personnel or from representatives of the Organiser during the 4.6 km Walkathon. 6. The Organiser reserves the right to change the Terms and Conditions, unless such a change would serve to disadvantage the Participants, especially through limiting the rights acquired through these Terms and Conditions. Any changes shall be valid from the date of being published on the Website. THE ORGANISER
