The CCI IR Master Class gave me great insight to IR and puts a lot of hot IR matters in perspective. All the presenters were well prepared and knowledgeable. It was a great course and I will be recommending it to others. The Commissioner s presentation was fantastic and very factual and gave a great insight to processes at the Fair Work Commission. I found the CCI IR Master Class very useful, I feel it has equipped me with not only knowledge but also access to resources and most importantly a familiarity with the Fair Work Commission. These 13 sessions will enable participants to significantly develop their knowledge and join a network of like minded people who will meet on a regular basis to be updated on recent case law and changes in legislation. I found the program very useful. I have a much better understanding about how to read the Act and how different parts of the Act relate to each other. I am also more confident when I have to deal with The Commission or FWO and have a better understanding of what part they can do and play. HR Manager, Oil and Gas industry Intro Session Fundamentals of Employee Relations Our introductory session is designed to provide you with a strong foundation to begin the IR Master Class journey. In particular, this session covers the interaction between different instruments and entitlements. Session 1 Fair Work Act 2009 The Fair Work Act 2009 is the key piece of legislation regulating most employment relationships in Australia. Complexity and uncertainty in the interpretation of the many provisions contained in the Act make this session imperative for any HR practitioner. In this session the presenter will guide you through the Act covering the objects and respective roles of the Fair Work Commission, the Fair Work Ombudsman and other relevant courts. Session 2 Contracts of Employment The contract of employment forms the basis of the employment relationship and often becomes critical when the relationship breaks down. This session will cover the formation or a contract, implied and express terms, as well as the enforcement and breaches of contracts of employment. In addition, the presenter will provide important tips on how to ensure common issues are avoided. Session 3 Understanding Awards and Hours of Work The resurgence of awards in the Fair Work system has again brought to the fore the need for HR practitioners to understand award coverage and the relevance of award conditions in agreement making processes and union negotiations. This relevant and practical session will cover the critical issues including award coverage and application, ordinary hours, penalties and overtime. Session 4 Agreement Making Given the prescriptive and complicated nature of agreement making under the Fair Work Act 2009, CCI s IR Master Class will include two sessions on agreement making ensuring you gain an in depth knowledge in this area. The first session will cover the procedural aspects of agreement making, as well as the role of the Fair Work Commission in the process. Session 5 Advanced Agreement Making and Strike Action In your second agreement making session the more complicated and strategic aspects of agreement making, as well as union negotiations and strike action, will be explored.

Session 6 Dealing with Union Right of Entry For most HR practitioners, the experience of a union official appearing on site demanding entry can be intimidating. Now, more than ever, practitioners must be aware of union rights and are generally held accountable for ensuring that access to employee records and freedom of association rights occur in full compliance with the Fair Work Act 2009. Whether to hold discussions or investigate a breach, union right of entry into the workplace is often not as straight forward as it seems. Refusing entry to a union official can have a range of consequences. Our expert on right of entry issues will assist IR Master Class participants to understand how current laws apply and will also consider the more practical aspects of managing union right of entry. Session 7 Understanding and Managing Leave Entitlements Disputes over entitlements such as annual leave, sick, carers and compassionate leave are a regular occurrence. This session will identify key leave entitlements, how they apply in the workplace and will consider the recent case law in relations to the more challenging areas of dealing with leave entitlements. CCI s expert in long service leave will also present a targeted session on employees entitlements to long service leave. Session 8 General Protections: The New Workplace Challenge Recent prominent cases have highlighted the challenge the General Protections under the Fair Work Act 2009 can create for organisations. With a focus on understanding this complicated area, this session will delve into a series of recent cases to show how this section of the Act impacts decisions relating to employees. Session 9 The Fair Work Ombudsman and Compliance Compliance with the Fair Work Act 2009 has become a critical component of every h HR professional s role. Recent cases have shown that HR professionals can be held personally liable for breaches of the Fair Work Act. This session will give an overview of the compliance section of the Fair Work Act, will examine some recent enforceable undertakings entered into by employers and will cover the key areas of risk for employers. CCI has also invited a representative from the Fair Work Ombudsman to provide an overview to IR Master Class participants about their enforcement and compliance role. Session 10 Managing Bullying and Conducting Workplace Investigations The Fair Work Commission now has the ability to scrutinise the way employers manage bullying in the workplace. The first part of this session will provide HR practitioners with an overview of these new bullying laws, while the second part of this session will cover the skills needed to investigate workplace incidents, such as bullying, harassment and serious misconduct. Session 11 Ending the Employment Relationship: Termination and Redundancy In recent decisions Fair Work Commissioners have been scathing in their criticism of HR practitioners for failing to ensure that valid reasons for termination of employment exist and not affording procedural fairness to employees. Ending an employment relationship requires careful planning and consideration. This session will cover how to terminate employees in line with the requirements of the Fair Work Act. Session 12 External Perspectives and Influences CCI has invited a Commissioner from the Fair Work Commission to provide some practical insights into the workings of Industrial Tribunals. We will then conclude the IR Master Class journey with insights into how CCI is seeking to shape the future of IR.

Who are the presenters? Along with guest speakers, the IR Master Class sessions will be presented by a senior member of CCI s Employee Relations team who has been working in the field for many years. Some of our presenters include: Gerda Musikanth CCI s senior employee relations consultant Gerda Musikanth has been working in the industrial relations and human resources management industry for over 15 years. Gerda worked in senior industrial relations management positions within the engineering and food manufacturing industries before joining CCI 12 years ago. She has extensive experience in drafting and reviewing contracts and agreements, reviewing and developing HR policies as well as the development and provision of customised training across a range of HR and IR topics. Gerda holds a master s degree in Industrial Relations and Human Resources Management from the University of Western Australia. David Jones David has over 40 years experience representing CCI Members before industrial relations tribunals and courts on a range of matters including contractual benefits, unfair dismissals, equal opportunity disputes and breaches of industrial awards and agreements. David has experience across all industry sectors and is frequently sought out by organisations for his expert advice on employment contracts and termination of employment. He has a degree in Economics and has recently completed a Bachelor of Laws. Renae Catalano Renae is an Associate in the Employee Relations Consulting team. She has worked in CCI s Industrial Relations Policy division as a Policy Adviser, where she has gained experience appearing before the relevant Commissions in matters related to Workplace Gender Equality and State Location Allowances. Renae has also gained a broad range of experience as a Senior Employee Relations Adviser in CCI s Employee Relations Advice Centre. Renae has a number of year s prior experience working in the road transport, construction (earthmoving) and retail sectors. She holds a Bachelor of Science degree from Curtin University majoring in Psychology and a post graduate qualification in Human Resource Management. Renae is a certified trainer and assessor. Dean Langridge Dean Langridge is a Principal Employee Relations Consultant with over 9 years experience providing complex human resource and industrial relations advice within the transport, manufacturing, mining, construction and oil and gas industries. Dean s area of expertise is providing HR/IR solutions that contribute to the strategic thinking and direction of businesses to meet their core objectives and core values, strategically drafting and negotiating enterprise agreements. Dean is also experienced in advocating before the Fair Work Commission. Dean holds a bachelor s degree in Psychology and is currently completing his Bachelor of Laws.
