ELIGIBILITY: This Contest is conducted by Shoppers Drug Mart Inc. and Pharmaprix Inc. (collectively, the Contest Sponsors ) and is open to all Shoppers Optimum Members /Pharmaprix Optimum Members who are residents of Canada, nineteen years (19) of age or older at time of entry. All entrants are responsible for ensuring that their contact information is up- to- date and correct on their Shoppers Optimum Card / Pharmaprix Optimum Card account. Entrants must hold a valid Shoppers Optimum/Pharmaprix Optimum Card and meet all other eligibility requirements to enter. If you do not have a Shoppers Optimum/Pharmaprix Optimum Card, visit any Shoppers Drug Mart/Pharmaprix store or visit www.shoppersdrugmart.ca/www.pharmaprix.ca for details on how to become a cardholder. There is no charge to enroll. By enrolling you agree to be bound by the terms and conditions of the Shoppers Optimum Card/Pharmaprix Optimum Card Program as amended from time to time. Travel companion must be nineteen (19) years of age or older at time of travel. Employees of Shoppers Drug Mart Inc., the Associate/Owners of Shoppers Drug Mart stores and the Associate/Owners of Pharmaprix stores, Elizabeth Arden, and each of their respective parents, affiliates, subsidiaries, advertising, promotional agencies, fulfillment house, agents, and representatives, and members of their respective immediate families or those with whom they are domiciled, are not permitted to enter the Contest. Participation in this Contest constitutes entrant s full and unconditional agreement to these Official Rules and the Contest Sponsors decisions, which are final and binding in all matters related to this Contest. Winning the Grand Prize is contingent upon fulfilling all requirements set forth herein. This Contest is subject to all applicable federal, provincial and municipal laws. Void wherever prohibited by law. 2. HOW TO ENTER: NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. There are two (2) ways to enter this Contest, as described below. Limit of one (1) entry per day regardless of method of entry. To enter the Contest and qualify for a chance to win the Grand Prize, you may enter in two (2) ways: a) AUTOMATIC ENTRY: Every time you purchase any Juicy Couture fragrances between September 1, 2016 and September 30, 2016 (the Contest Period ), at any participating Shoppers Drug Mart or Pharmaprix store (each store a licensed operator of Shoppers Drug Mart Inc. or its affiliates) and present your valid Shoppers Optimum Card /Pharmaprix Optimum Card, your name will be automatically entered into the Contest for a chance to win the Grand Prize.
b) NO PURCHASE ENTRY: To enter the Contest without making a purchase, please handwrite an entry form including: your name, Shoppers Optimum Card / Pharmaprix Optimum Card number, mailing address, postal code, and phone number, and mail it in an envelope with sufficient postage to: Shoppers Optimum/Pharmaprix Optimum Juicy Couture Fragrances VIP fashion experience at New York Fashion Week c/o Shoppers Drug Mart, 243 Consumers Road, Toronto, Ontario, M2J 4W8. Limit of one (1) entry per envelope. All entries must be postmarked by September 30, 2016, and be received by Shoppers Drug Mart Inc./Pharmaprix at the aforesaid address no later than five (5) days after the closing date to be eligible for entry into the draw at the end of the Contest Period. 3. PRIZES: There will be one (1) Grand Prize awarded. The Grand Prize consists of a two- night trip for two (2) to the 2017 New York Fashion Week event in New York, NY USA during the week of February 11-18, 2017 (exact dates to be confirmed by sponsor). Grand Prize Winner and one (1) travelling companion must be available to travel on the dates specified by the Contest Sponsors. The Grand Prize Winner and his/her travelling companion must each sign a Contest Sponsors standard declaration and release form. Grand Prize Winner and one (1) travelling companion will each receive: round trip economy air transportation from the major Canadian commercial airport nearest to the Grand Prize winner s residence (departure point), Limo transportation to and from the airport in New York, luxury hotel accommodations for two (2) (based on one (1) standard room, double occupancy, room and taxes only for two (2) nights, two (2) One Thousand United States Dollars (USD $1000) shopping experiences to the store of an organizer- selected designer from the February 2017 Event, two (2) dinners for two (2) guests each at an organizer- selected restaurant where organizer will cover up to Five Hundred United States Dollars (USD $500) in food and beverage for each dinner, and one (1) VIP pass per evening of the trip (total of two events) to a New York Fashion Week event occurring that evening. (Date, time, location, and all other aspects of access to the event are to be determined solely by New York Fashion Week). Grand Prize winner will be required to provide their name and personal information as well as their travelling companion s name and personal information to Shoppers Drug Mart and Elizabeth Arden in order to fulfill prize(s) including travel and hotel accommodations. Prize travel must be taken between the dates of February 11th, 2017 and February 19th, 2017. Specific details of the Grand Prize package, including, without limitation, all travel arrangements, accommodations, activities, flights, airlines, and scheduling will be determined solely by the Contest Sponsors, in their sole and absolute discretion, and are subject to change without notice or compensation. Total approximate retail value of the Grand Prize is twelve thousand dollars ($12,000 CND) (depending on time and point of departure). Grand Prize is non- transferable, may not be substituted or extended, may not be redeemed for cash or credit, is non refundable and must be accepted as awarded except in Contest Sponsors and Prize Suppliers sole discretion. Grand Prize Winner is not entitled to any monetary difference
between actual prize and the stated approximate prize value, if any. Contest Sponsors and Prize Supplier reserve the right to substitute the prize with another prize of equal or greater approximate value. Airline carrier s regulations and conditions apply. Flights do not qualify for loyalty points. Grand Prize Winner and travelling companion must depart from the same departure point and must travel together on the same itinerary. Contest Sponsors and Prize Supplier are not responsible for any flight, event or appointment that is cancelled, delayed or rescheduled for any reason beyond their control. Grand Prize Winner may be required to present a valid major credit card upon check- in to cover any expenses over and above the standard room charge. The Grand Prize winner and his/her travelling companion are responsible for all incidental expenses incurred for the purpose of taking or during the trip including, but not limited to, ground transportation not specifically mentioned in the Grand Prize description above, travel insurance, trip cancellation insurance, sightseeing tours or optional tours, taxi charges, post trip accommodations, day excursions or concerts, entrance fees or admission fees, meals or drinks, tips, departure taxes, fees and surcharges, excess baggage fees, costs associated with obtaining travel documents, visas, or necessary vaccinations, change fees, telephone calls, in- room movies, mini- bar expenses, room service, gratuities, medical and travel insurance, or items of a personal nature (the Expenses ). The Grand Prize Winner understands that he or she may not seek reimbursement for the Expenses from the Contest Sponsors, Prize Supplier or their respective advertising and promotional agencies. Contest Sponsors and Prize Supplier are not liable for any missed Grand Prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. Flight schedules are subject to change without notice. No refund or compensation will be made in the event of the cancellation or delay of any event or flight, or failure of Grand Prize Winner and/or their travelling companion to complete travel. Contest Sponsors and Prize Supplier will not replace any lost, mutilated, or stolen tickets, gift cards, travel vouchers or certificates. The Grand Prize winner and his/her travelling companion are responsible for ensuring that they have all necessary travel documents prior to departure. Terms and conditions of gift card(s) apply, not redeemable for cash. No change in travel arrangements can be made by the Grand Prize Winner and travelling companion once the booking has been arranged. In the event the Grand Prize Winner and/or a travel companion live within driving distance of the New York Fashion Week event, as determined by the Contest Sponsors, the winner and/or travel companion will not be eligible for the air or ground transportation of the Grand Prize and no monetary compensation will be substituted. CONDUCT: Grand Prize Winner and travelling companion must at all times behave appropriately when taking part in the Grand Prize and while at the hotel, the Event and/or any other Grand Prize- related location and observe the Contest Rules and any other rules or regulations in force at the hotel, the Event and/or any other Grand Prize- related locations. The Contest Sponsors and Prize Supplier reserve the right to remove from the hotel, the Event and/or any other Grand Prize- related
location, any Grand Prize Winner or travelling companion who breaks such rules and/or fails to behave appropriately and to disqualify such Grand Prize Winner and/or travelling companion. 4. CHANCES OF WINNING: The odds of winning depend on the total number of eligible entries received. 5. RANDOM PRIZE DRAW AND WINNER SELECTION: One (1) grand prize entry winner will be randomly selected to determine the potential prize winners at the end of the Contest Period from among all eligible entries received. No purchase entries will be date stamped and included in the draw if postmarked by September 30, 2016, and received no later than five (5) days after the closing date. The random draw will occur at the Shoppers Drug Mart central office in Toronto, Ontario on October 8, 2016 by SDM, (the Draw Date ) at approximately 2:00 PM Eastern Time (EST). No responsibility is assumed by the Contest Group (as defined in this section) for any inability for a potential entrant to successfully enter any draw for any reason. A representative of the Contest Sponsors will notify the selected entrant by phone at the number provided by the entrant within three (3) business days of the Draw Date. The representative will make a maximum of three (3) attempts to contact the potential Grand Prize Winner. Before being declared a winner, the selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question to be administered by phone at a mutually convenient time and then sign a standard declaration/release form ( Declaration and Release ) confirming compliance with the Contest Rules, and releasing the Contest Sponsors, Elizabeth Arden, ABG Juicy Couture, LLC, and each of their respective shareholders, employees, parents, directors, officers, affiliates, subsidiaries, franchisees, licensors, licensees, representatives, agents, advertising and promotional agencies, prize providers, successors and assigns (collectively, the Contest Group ) from any and all liability with respect to the entrant s participation in this Contest and the awarding, use and/or misuse of the Grand Prize or for matters that inhibit, reduce or prevent enjoyment of the Grand Prize. Grand Prize Winner and travelling companion will be required to sign and return the Declaration and Release forms within three (3) days of its receipt or the prize may be forfeited, and an alternate Grand Prize Winner may be selected. If the selected entrant cannot be contacted within three (3) attempts or three (3) business days of the Draw Date (whichever occurs first), or does not meet all of the Contest conditions, the selected entrant shall forfeit any rights to the Grand Prize, and another entrant will be randomly selected from the remaining eligible entries and be subject to disqualification in the same manner. No correspondence pertaining to this Contest will be entered into except with potential winner. Potential winner may be required to show proof of identification as part of the verification process. In case of a dispute concerning the identity of the individual who submitted an entry, the entrant will be deemed to be the account holder of the Shoppers Optimum/Pharmaprix Optimum account under which the entry was submitted. The account holder shall be the natural person whose name appears on the Shoppers Optimum Card/Pharmaprix Optimum Card account. If a dispute cannot be resolved to the Contest Sponsors' satisfaction, the potential winning entry will be deemed null and void.
6. GENERAL RULES: Entries obtained through fraudulent means or through an abuse of the Shoppers Optimum Program /Pharmaprix Optimum Program or in any way tampered with, forged, mutilated, illegible, incomplete or mechanically reproduced entries may, at the sole discretion of the Contest Sponsors be disqualified. All entries are subject to verification by Contest Sponsors and Contest Sponsors reserve the right to cancel and revoke any entries if they are found to be improper or if the entrant is subsequently found to be ineligible pursuant to the Contest Rules. All entries become the property of Shoppers Drug Mart and shall not be returned. The Contest Group is not responsible for entries lost, late, misdirected, containing inaccurate information or delayed for any reason. Mailed in, no- purchase entry must bear sufficient postage, which is the sole responsibility of the entrant. Proof of sending an entry or purchasing a participating product is not proof of receipt by the Contest Sponsor. By entering the Contest and/or accepting the Grand Prize, entrants consent to the use of their name, voice, photograph and/or videotaping in any publicity or advertisement carried out by the Contest Group and publication of same on the list of winners without further compensation. The Contest Group shall not be liable to the confirmed winner of the Grand Prize for any guarantee, warranty, condition or representation, express or implied, relating to the Grand Prize, including without limitation, its quality, condition or fitness for a particular purpose. Entrants, Grand Prize Winner and/or traveling companion assume liability for, and release and hold harmless the Contest Group from any losses, damages, or injuries of any kind (including death) resulting, in whole or in part, directly or indirectly, from participation in the contest, any contest- related activity, or the acceptance, possession, use or misuse of any prize awarded. The Contest Group and its respective agents are not responsible for typographical or other errors in the offer or administration of this Contest, including, but not limited to, errors in advertising, the Contest Rules, the selection and announcement of the winner, distribution of the prize or parts of the prize or technical malfunctions of telephone network lines, computer online systems or providers, software and hardware configurations, or failure of any entry to be received by the Contest Sponsors for any reason. Subject to the approval of the Régie, the Contest Sponsors may, at their sole discretion and without liability, terminate the Contest in whole or in part, without notice, or modify or suspend the Contest at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or communications or other errors or other causes beyond the control of the Contest Sponsors corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these Contest Rules. In no event will the number of prizes awarded exceed the available number of prizes as specified in these Contest Rules. In the event of any discrepancies between the English language rules and the French language rules, the English disclosures or other statements contained in any contest related materials, including, but not limited to: the Contest entry form, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English rules shall prevail, govern and control.
7. PRIVACY / USE OF PERSONAL INFORMATION: By participating in the Contest, entrant: (i) grants to the Contest Sponsors the right to use his/her name, mailing address, telephone number, and Shoppers Optimum/Pharmaprix Optimum account number ( Personal Information ) for the purpose of administering the Contest, including but not limited to contacting and announcing the Grand Prize Winner and fulfillment of prizes; and (ii) acknowledges that the Contest Sponsors may disclose his/her Personal Information to third- party agents and service providers of any of the Contest Sponsors in connection with any of the activities listed in (i) above. The Contest Sponsors will use the entrant s Personal Information only for identified purposes, and protect the entrant s Personal Information in a manner that is consistent with the Shoppers Drug Mart Privacy Policy at www.shoppersdrugmart.ca. 8. WINNER S LIST: For the name of the winners, send a self- addressed, stamped envelope by November 30, 2016, to Shoppers Optimum/Pharmaprix Optimum Juicy Couture Fragrances VIP fashion experience at New York Fashion Week c/o Shoppers Drug Mart, 243 Consumers Road, Toronto, Ontario, M2J 4W8. 9. GOVERNING LAW: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action; and (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Contest, but in no event lawyer s fees. Entrant agrees that under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Contest Group in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of laws of any jurisdiction other than the Province of Ontario. Quebec residents: Any litigation regarding the conduct or organization of a publicity contest may be submitted to the Régie des Alcools, des Courses et des Jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. 10.
