CALL TO ORDER: called the meeting to order at 7:00 p.m. FLAG SALUTE: ROLL CALL: Led by (absent Committeeman Delorenzo Committeeman Moscatiello Also present: Municipal Clerk Cindy Dye and Township Attorney Mark Roselli. SUNSHINE STATEMENT: The provisions of the Open Public Meetings Act have been met. Notice of this meeting has been transmitted by email to the Bordentown Register News, Burlington County Times and The Trenton Times as well as given to those having requested same and posted on the Township bulletin board located in the foyer of the municipal building. PUBLIC COMMENT OPEN PUBLIC COMMENT opened the meeting to the public. There was no public comment. MOTION TO CLOSE PUBLIC COMMENT Proposed By: Committeeman Delorenzo Seconded By: ENGINEER S REPORT Justin Gibson stated that he has prepared a revised estimate for the capital road project and distributed it to the Committee. The Township was awarded $60,000 from the 2014 Burlington County Road Overlay Program, which is significantly less than what was requested. Mr. Gibson will be contacting to the County to see why the award was much lower than what was requested. There has been no announcement to date regarding the FY 2014 Burlington County Municipal Park Development Program. The FY 2015 NJDOT State Aid Application has been submitted and the resolution approving the submission is on for action this evening. DEPARTMENT REPORTS FOR SEPTEMBER 2014 a. Tax Collector b. Committeeman Delorenzo Committeeman Moscatiello MINUTES FOR APPROVAL October 2, 2014 Regular Meeting Committeeman Delorenzo Committeeman Moscatiello BILLS AND CLAIMS FOR APPROVAL Committeeman Delorenzo Committeeman Moscatiello CONSENT AGENDA DEFINED: All matters listed on tonight s consent agenda are to be considered as one vote by Township Committee and will be enacted by one motion. There will be no discussion of these items. If discussion is desired, that item will be removed from the consent agenda and considered separately. 2014-107 Resolution to Cancel Taxes RESOLUTION 2014-107 TOWNSHIP OF NORTH HANOVER COUNTY OF BURLINGTON RESOLUTION TO CANCEL TAES WHEREAS, the United States Department of Veteran Affairs has classified James Bernhard 100% Permanently and Totally Disabled; and WHERAS, by application from Donald Kosul, Tax Assessor in the Township of North Hanover, the said exemption is granted from April 30, 2014; and 2

WHERAS, N.J.S.A. 54:4-3.30a Allows for the exemption from taxation from real and personal property for any citizen and resident of the State who has a total or 100% permanent disability as defined by this statue; and WHEREAS, the following taxes must be canceled and any monies paid by the owner should be refunded. THEREFORE BE IT RESOLVED, that the following taxes be canceled: BLOCK 601 LOT 1.01 2014 $4,382.79 2015 1 st half $3,287.10 THEREFORE BE IT RESOLVED FURTHER, that a copy of this Resolution be forwarded to the Burlington County Board of Taxation, the Treasurer of Burlington County, the Municipal/Regional School Board to advise them of the action taken by the Township Committee on this matter. Committeeman Delorenzo Committeeman Moscatiello 2014-108 Approval to Submit a Grant Application and Execute a Grant Agreement with the New Jersey Department of Transportation for the Reconstruction of Jacobstown- Arneytown Road (Phase III) Project Committeeman Delorenzo Committeeman Moscatiello 2014-109 Resolution Authorizing Amendment for the Extension of the Contract for Snow Removal Services Contract The Township Attorney indicated clarification was needed regarding the light snow fall. stated that it was the Township s desire that if there is a snow fall of 4 inches or less that a light duty truck would be utilized rather than a tractor. Mr. Roselli indicated he would amend the contract and resolution to reflect the same. RESOLUTION 2014-109 3

TOWNSHIP OF NORTH HANOVER COUNTY OF BURLINGTON RESOLUTION AUTHORIZING ETENSION AND AMENDMENT TO CONTRACT BY AND BETWEEN THE TOWNSHIP OF NORTH HANOVER AND A CUT ABOVE THE REST FOR THE PROVISION OF SNOW REMOVAL SERVICES WITHIN THE TOWNSHIP OF NORTH HANOVER WHEREAS, the Township of North Hanover (hereinafter Township ) previously awarded by way of public bid by way of Resolution No. 2013-122 adopted November 7, 2013, a contract (hereinafter Contract ) to A Cut Above The Rest having an address at 837 Route 524, Allentown, NJ 08501 (hereinafter Contractor ) for the provision of snow removal services for the Township s streets, roadways and other Township property for an initial term of November 15, 2013 to November 14, 2014; and WHEREAS, pursuant to the terms of the initial Contract and the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., the term of the Contract can be extended by the Township for up to two (2), one-year additional terms, under the same terms and conditions of the awarded contract, including price, unless a different price is accepted by the Township Committee in accordance with the requirements of the New Jersey Local Public Contracts Law; and WHEREAS, the Township Committee hereby finds that the services being provided by the Contractor are being performed in an effective and efficient manner; and WHEREAS, in accordance with the paragraph IV of the Contract, the Township wishes to extend the term of the Contract for an additional one year term, commencing November 15, 2014 and terminating November 14, 2015, under the same terms and conditions, except that the price of the Contract shall be increased by 2.0% over the prior year s price, the maximum amount permitted under state law and the Contractor has agreed to utilize light duty vehicles, i.e. pick-up trucks and dump trucks, for light snow falls measuring 4 inches or less; and WHEREAS, the Contractor has consented to the extension of the Contract under the same terms and conditions of the original contract, except as amended hereby, which shall be set forth in an amendment agreement to be executed by the parties and the following prices: $204 per hour when utilizing tractor $204 per hour when utilizing Dump truck, spreader & plow $76.50 per hour for backhoe operator/or when utilizing Township s front end loader and snow box 4

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, County of Burlington, State of New Jersey that it does hereby authorize an amendment to the Contract with A Cut Above The Rest having an address at 837 Route 524, Allentown, NJ 08501 by extending the term of the contract for an additional one year term; increasing the contract prices as set forth herein above, requiring the Contractor to utilize light duty vehicles, i.e. pick-up trucks and dump trucks, for light snow falls measuring 4 inches or less, with all other terms and conditions of the contract remaining the same. BE IT FURTHER RESOLVED that the Mayor and Township Clerk are authorized to execute an amendment to the Contract providing for the terms of this resolution. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to A Cut Above The Rest. DISCUSSION Funding of Street Maintenance Plan (continuation) stated that he would like to hold this discussion until the next meeting. Discontinuing Salt Service for the North Hanover School District explained the current procedure for the School District utilizing the salt. reiterated his concern regarding the amount of salt being used, especially during the shortage last winter. He explained his conversation that he had with the School Superintendent. He feels that the usage by the School is very careless. Committeeman Delorenzo stated that there is a clipboard in the salt shed, which is not being utilized by the School. stated that he feels that the school needs to give us an honest estimate of how much salt it takes to do an application. Committeeman Moscatiello stated that an estimate should be made of how much salt they would be utilizing and some of that should be paid up front. An official contract should also be done. stated that there should be a nominal fee for storage. will contact the Superintendent and Mr. Roselli will draft a contract. TOWNSHIP COMMITTEE COMMENTS Committeeman Delorenzo indicated that cleanup day was successful. indicated that there are drainage issues on Orr Road. A quote was received from our current public works contractor. However, he feels that there may be more work required than what the quote would allow. He requested that the Township Engineer take a look at it. 5

Committeeman Moscatiello reiterated Committeeman Delorenzo s comments regarding cleanup day. stated that he has received a revised COAH proposal from the Township Planner for an amount not to exceed $3,500. It was the consensus of the Committee to move forward with the work. EECUTIVE SESSION RESOLUTION (if needed) 2014-110 Authorizing a Closed Session Meeting to discuss the following matter(s) pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12; Personnel, Contract Negotiation and Litigation matters RESOLUTION 2014-110 TOWNSHIP OF NORTH HANOVER COUNTY OF BURLINGTON AUTHORIZING A CLOSED SESSION MEETING WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss personnel matters, of which requires attorney-client privilege in this regard. NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss personnel matters. BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard. 6
