STATEMENT: "This meeting is being held in compliance with the Open Public Meetings Act. It was published in the Tri-Town News, Asbury Park Press, Trenton Times and posted on the bulletin board. THOSE OFFICIALS PRESENT WERE: COMMITTEEMAN TROTTA COMMITTEEMAN WYSONG COMMITTEEMAN MARINARI DEPUTY MAYOR SORCHIK MAYOR LEUTWYLER ATTORNEY FORAN CLERK HENDRICKSON BUSINESS ADMINISTRATOR DANCER Mayor Leutwyler reviewed the agenda. Committeeman Trotta said that youth of PYNE (Plumsted Youth for Nature and Environment) made a presentation to the County for a park on West Colliers Mills Road and gave copies of that presentation to the Committee. He felt the Township Committee should support this. Mayor Leutwyler said he and Committeeman Marinari met with the school and they were looking to move forward with the SRO (School Resource Officer) Program in the fall. Business Administrator Dancer said he spoke to the Borough of Lakehurst s attorney with respect to a shared service with the Borough of Lakehurst to provide Municipal Court Services. He wanted to add in this agreement subject to attorney review. Mayor Leutwyler also noted that the County Administrative Office of the Court wanted it noted in the agreement that this agreement could be dissolved at any time with the mutual agreement of both municipalities. Mayor Leutwyler wanted to advise the Committee and residents that he received a call from JCP&L and they asked for a list of priority locations which need power after storm. ON MOTION OF COMMITTEEMAN TROTTA, SECONDED BY COMMITTEEMAN MARINARI, RESOLUTION NO , A RESOLUTION OF THE TOWNSHIP OF PLUMSTED, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE CONVENING OF AN EXECUTIVE SESSION IN ACCORDANCE WITH THE OPEN PUBLIC MEETINGS ACT WAS ADOPTED. ROLL CALL VOTE: ALL AYES. Mayor Leutwyler said since the Committee did not complete the Executive Session, they will return to Executive Session after the public portion of the meeting. Mayor Leutwyler called the regular session of the Township Committee meeting to order with the flag salute. Leutwyler introduced the professionals at the dais. ROLL CALL VOTE: ALL AYES WITH COMMITTEEMAN TROTTA ABSTAINING ON RESOLUTION NO The following resolution was pulled from the consent agenda for comment. Committeeman Marinari asked Assemblyman Dancer to explain Assembly Bill A-4084, which authorizes the establishment of a Federal Impact Aid Reserve Account. Assemblyman Dancer stated that in the State of New Jersey there are 27 school districts that receive Federal Impact Aid as a result of either having Federal Land in their municipality or Federal Facilities. In the case of North Hanover Township, Burlington County, they educate military personnel s children in their school system. He explained there is a Federal Law that provides for compensation to those school districts because they are tax exempt with the Federal Government with both their land and facilities and the Federal Government has deemed it proper and appropriate to provide this Federal Impact Aid to help the local taxpayers. In Plumsted Township s case, we are a 40 square mile township with 20 square miles in the Fort Dix Military Reservation, so Plumsted has land that is considered Federal Impact Aid eligible. He explained that this legislation, for the first time in New Jersey, establishes by law that there could be Federal Impact Aid reserve account. If there was not a statute that authorized the schools to keep in a reserve account, you never know when this money would come in from the Federal Government and in the past, the State has confiscated it because it was over the 2% 3

4 allowance of total appropriations, which is their surplus. The money coming in from the Federal Government goes into the account the schools have established. In the statute, it does not say Federal Impact Aid Reserve Account. What it says is that the Boards of Education may keep this money in their reserve account, use and spend it as they deem necessary, but the key is that the State of New Jersey cannot take the money. He explained that the State reduces the amount of State Aid by the amount of money, which is held in a surplus account over and above the 2% of appropriations. In Plumsted where there could be over $800, in a Federal Impact Aid account, the school could lose that money. This will give assurances to the local taxpayers of the State of New Jersey that the State of New Jersey will establish a Federal Impact Aid Reserve Account and that money will be protected for the local taxpayer and for those school boards to use that money, as they deem necessary. The second and last point of the legislation is that the Federal Government is operating on continuing resolutions and has not had an adopted budget in a number of years and they are under sequestration, which means that there needs to be a balanced budget. To protect the Federal spending and to prioritize it, any State that passes a State Law then has a State Law protecting the Federal Impact Aid, those States will receive a higher priority because our State Legislature said this is a priority. They feel that this money is so important to our school districts and local taxpayers that the State of New Jersey passed this law to protect it. If another state does not take a similar action, they will be more likely to lose their money. Administrator Dancer said that Committeeman Marinari, as the former President of the School Board, knows how many hundreds of thousands of dollars flow from the Federal Government to our local school. There was a meeting with the Assistant Commissioner of Education in the State of New Jersey and briefed the Governor s Office. There is a bipartisan bill support from District #1, in Vineland City and Cape May City. There is a vested interest in both parties in the State of New Jersey to move forward with this legislation. Local support is needed from municipalities and school boards to forward resolutions of support so the entire legislature and Governor will see that we want to protect our local taxpayers by trying to preserve the Federal Impact Aid. Committeeman Marinari, as Committee liaison to the school, said this legislation is one of best things he has heard as far as a past school board member. There was a meeting with the School Board and this legislation was discussed. As a past school board president, he thanked Assemblyman Dancer. He also thanked him from our district and the taxpayers because this is something extremely important. In today s economy, this legislation would be a vital part of any new law and this one of the best things he has seen. Mayor Leutwyler also thanked Assemblyman Dancer and noted that he did not just do this for Plumsted Township; it was for all of the towns in the 12 th District and in the State of New Jersey. There was no further business from the Township Committee. Mayor Leutwyler asked for public comments. Sabate (Sam) Russo, Sr. questioned Resolution No regarding the temporary shared service with Lakehurst Borough. He asked if the court sessions would still be held in Plumsted, which it was explained that it would be Lakehurst. Since Plumsted Township does not have a Court Administrator now, the Committee is looking into several different options. Mr. Russo said he read on Facebook that Chief Petrecca might be taking another position because some agreement could not be reached between him and the Township Committee. He said the Township has come a long way in getting the police department accredited and the Chief is very conscientious, capable and has all of the credentials and still going to school. He felt it would be a tremendous loss if the Township lost him and revert to a Safety Director again. He said the first responders are the backbone of a community and the public welfare and safety of the residents should be number one on anybody s list. He did not know where the Township stood on this matter and Mayor Leutwyler said that the Township Committee echoes his sentiments and hopes the Chief is here for a long time. Mayor Leutwyler said the Committee has not received any letter of resignation so he would have to ask Chief Petrecca his intentions. Committeeman Wysong wanted to state that this Committee totally supports the Chief and wants him to stay. The Committee has had meetings with the Chief and State Officials and were doing everything in their power to do right by Chief Petrecca. Brant Uricks, President of the Plumsted PBA, asked if the Committee was looking to take our court full time in Lakehurst or possibly actively seeking candidates to replace the Court Administrator s position. Mayor Leutwyler said Lakehurst is a good solution temporarily because it gives the Committee time. The Administrative Office of the Courts of Ocean County asked the Township to educate themselves on a joint court, shared court and having the court here with a part-time administrator. While Lakehurst is a three-month agreement, it is being amended to add that it can be dissolved sooner as long as it is in agreement with both parties. Lakehurst is doing this as a courtesy to Plumsted. Detective Uricks said the officers were worried and wanted to make sure that the Committee was trying to replace her position, as it was important to the officers. Secondly, he said there were rumors that the Township has been looking to outside agencies for covering police services in Plumsted Township, which could affect the staffing levels for the existence of the police department. Deputy Mayor Sorchik said that was false. Sorchik said the Township couldn t hold interviews without the Ocean County Administrative Office of the Court being present. They have to give approval and sit in on the interviews. ON MOTION OF COMMITTEEMAN TROTTA, SECONDED BY DEPUTY MAYOR SORCHIK, MAYOR LEUTWYLER RECESSED THE PUBLIC PORTION TO RETURN TO EXECUTIVE SESSION.
