The 2009 edition of Best Lawyers, which was published in November 2008, is based on more than 2.4 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on a vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2009 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives fax or email ballots; the other half is polled by phone. MetHODOlOGy Voting lawyers were provided this general guideline for determining if a nominee should be listed among the best : If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them? All votes and comments were solicited with a guarantee of confidentiality a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyerís inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the legal profession in the United States. 2009 South Florida s Lawyer of the Year SOUTH FLORIDA s Best L a w y e r s 2009 Lawyers of the Year Best Lawyers has named three individuals as Lawyers of the Year in South Florida, based on their particularly high level of peer recognition. Lewis Kapner Kapner, Calabrese & Kapner Fa m il y Law (We s t Pa l m Be a c h) hen asked to Wdiscuss some of his most significant cases, family law attorney Lewis Kapner s commitment to his clientele is clear. It s like asking a parent who are your more significant children! says the 71-year-old lawyer. A former Palm Beach County chief judge who was intimately involved in family law, Kapner hung his shingle in 1988 when he opened the West Palm Beach firm of Kapner, Calebrese and Kapner. Handling a cadre of complex family law cases, Kapner has represented everyone from celebrities to high-income business people to sports figures. A recent case he handled helped establish new law regarding rights for biological fathers in situations where the mother is in an existing marriage. Where previously these fathers were left out in the cold, Kapner appealed the case to establish that there could be exceptions to give these fathers rights. Kapner is both a former faculty member of the National and Florida Judicial College, and served as dean of the latter. A recipient of the outstanding Judicial Contribution Award of the American Academy of Matrimonial Lawyers, Kapner says his time on the bench has helped him understand much of the psychology behind decision making but his firm s philosophy for peaceful resolution through mediation and arbitration is one that often allows them to avoid the courtroom entirely. It doesn t mean that we don t litigate cases, or that sometimes we come out of the box with boxing gloves, he says. But as a general proposition our first goal is to try to resolve a case and resolve it without destroying everyone involved. Aaron S. Podhurst Podhurst Orseck Personal Injury Litigation (Mi a m i) hen a young Aaron Podhurst cut his teeth in the Wfield of aviation litigation, the task at hand was no small undertaking. The year was 1972, and Eastern Airlines Flight 401 had crashed into the Everglades, killing 101 of the 172 passengers aboard. While representing many victims families in the case, Podhurst was appointed by the federal judge as lead counsel, which the attorney calls my ticket to getting into the field. Since that time, the Miami firm of Podhurst Orseck has become a global leader in the field of aviation litigation, earning billions of dollars for the victims of airline accidents. In the May 1996 ValuJet crash in the Everglades, the firm reaped more than $250 million for the accident victims families, and later earned $187 million for the families of three Brothers to the Rescue pilots killed when their civilian planes were shot down by Cuban fighter jets over international waters. There s something really powerful about an aviation accident, which affects jurors and other people more dramatically perhaps, says the 72-year-old litigator. As aviation litigation has grown more complex, the firm is in even greater demand. In the crash of a SilkAir jet in Indonesia in 1997 that killed all 104 people aboard, Podhurst and his firm fought tirelessly against claims that it was a result of pilot suicide, proving instead that it was a manufacturing problem. I believe we got a lot of credibility from the insurance industry after that case because it was so difficult, says Podhurst. It reaffirmed that we were able to take on the industry and win a case, and there are a very few law firms that could have taken on that case and won it. Christian D. Searcy Searcy Denney Scarola Barnhart & Shipley Personal Injury Litigation (West Palm Beach) or West Palm FBeach plaintiffs attorney Christian D. Searcy, business really is personal. The son of a legendary litigator, Searcy witnessed the death of his younger brother in a family car crash, and later in life watched his first-born child suffer a brain injury at birth. I think those two tragedies in my life have caused the representation of injured people to give me great fulfillment, says the 60-year-old attorney. And I really do have a passion for it. That passion has translated into a stellar career representing individuals who have suffered catastrophic physical or financial damages. At age 30, Searcy earned the distinction of being the youngest lawyer in the country to secure a $1 million verdict in a personal-injury lawsuit. In 2007, Searcy was lauded for earning $108 million in jury verdicts, and says he is on par with that record this year as well. The Vice President of the elite International Academy of Trial Lawyers, Searcy has received accolades ranging from the War Horse Award of the Southern Trial Lawyers Association to the Perry Nichols Award from the Florida Justice Association for a lifetime of outstanding service to the cause of justice. The name partner at Searcy Denney Scarola Barnhart & Shipley has a hard time singling out his most significant cases, since most in his career are critical enough to cause changes to the way that governments or businesses operate. All of my verdicts have been on such substantial matters that they all make life-changing differences, he says. Sidney A. SOUTH FLORIDA s Best L a w y e r s COVER SPOTLIGHT Not Always the Stuff Movies Are Made From Grossman Roth and Other Small Firms Look at Each Case with a Keen Eye W hile legal thrillers like Erin Brokovich or A Civil Action might only hit the big screen every few years, similar battles are being waged every day in law firms across the country. Here in South Florida, small firms such as Grossman Roth take on defendants ranging from insurance companies to medical institutions to automobile manufacturers. One highly publicized case that Grossman Roth took part in resulted in a recent verdict of $80 million for three Cuban plaintiffs against the Curacao Drydock Company. The plaintiffs are alleged to have suffered physical and mental damages while working 16-hour shifts repairing cruise ships and oil tankers in Curacao. Plaintiffs Alberto Justo Rodríguez, Fernando Alonso Hernández and Luis Alberto Casanova Toledo escaped first to Venezuela, then to Colombia, before seeking refuge at the United States embassy and moving to Florida. They sued under the Alien Tort Statute, which allows foreigners to file civil suits in federal courts when a serious international law is alleged to have been violated. The legal action involved Grossman Roth against aninternational law firm which tried getting the case dismissed on both jurisdictional and procedural grounds. Ultimately, the lawsuit was won in federal court last August when attorneys for Curacao Drydock failed to appear in court. The court in its ruling stated: Because all of Defendant s pleadings had been stricken and the Defendant chose not to defend this matter at trial, this Court accepts as true Plaintiffs uncontroverted factual allegations...as well as their uncontroverted and credible testimony at trial. Seth Miles from Grossman Roth was involved in another legal battle in a products liability case against Suzuki Motor Corporation, which resulted in a confidential settlement in October. Thirty-eight-year-old architect Woody Friese was riding his ATV when it flipped over. Grossman Roth attorneys alleged that the ATV handlebars were defective. The defendants denied all charges, claiming that Friese was negligent in his operation and maintenance of the vehicle. Being the first to wage battle with Suzuki over this issue, Miles says it was a grueling investigatory process, which resulted in close to 100 depositions and more than 100,000 pages of discovery. I spent a week and a half in Japan deposing Japanese executives, which is a whole mission in and of itself, he says. In another case, Gary Cohen of Grossman Roth brought suit on behalf of an at-risk mother whose child was severely disabled as a result of alleged negligence by the medical staff at a South Florida hospital. According to Cohen, the mother was left unattended and untreated, despite fetal monitoring reports indicating problems with her labor. An emergency cesarean section was necessary, and the baby nearly died during delivery, Cohen says. The child has severe cerebral palsy and mental retardation, he says. And [the child] will be like that for life. In two mock trials, separate juries returned verdicts unanimously in favor of the plaintiff, ranging from $23 to $35 million, Cohen reports. The case was settled shortly thereafter for a confidential amount. Economically, the child is covered for life, Cohen says of the settlement for plaintiff Shelley Chambers on behalf of her minor child, Shyneice Coley. The defendant hospital denied liability. In the hospital s answer, it claimed that the plaintiffs received treatment from other sources, so any findings should be reduced accordingly. The defendant hospital also stated that the alleged injuries and damages suffered by the plaintiffs resulted from negligence of third parties. Also this year, attorneys Andrew B. Yaffa and Miles from Grossman Roth earned a settlement for an immigrant family whose child was born limbless as a result of the mother s alleged exposure to pesticides during her time as a migrant worker in the tomato fields of North Carolina and Southwest Florida. Partner Neal A. Roth attributes the large settlement to the firm s unique approach to the case, which targeted the individual farm owner, rather than going up against the chemical manufacturing industry. Yaffa adds, We focused on the basic premise that if you re going to create a dangerous environment, you re going to be responsible for those that you harm. The defendant denied that it negligently exposed either parent to pesticides. It is the work of small law firms like Grossman Roth and countless others that helps level the playing field in these types of legal battles. These smaller boutique firms are able to give each of their clients the attention to detail that larger firms do not always have the ability to do. Though many are quick to paint plaintiffs lawyers with a broad brush as being opportunistic what is sometimes forgotten is that they often walk away with nothing in the fight for justice for their clients, which is certainly not the glamour of which movies are made.
