NVvIR NAJAARSVERGADERING LOETJE AAN T IJ A DAM 26 NOVEMBER 2013 Big Data en de Privacywet Gerrit-Jan Zwenne

Big Data is a generalized, imprecise term that refers to the use of large data sets in datascience and predictive analytics; [..] it encompasses three types of data magnification and manipulation: first, it refers to technology that maximizes computational power and algorithmic accuracy second, it describes types of analysis that draw on a range of tools to clean and compare data, and third, it promotes a certain mythology the belief that large data sets generate results with greater truth, objectivity, and accuracy Mayer-Schönberger & Cukier 2013

Big Data refers to datasets whose size is beyond the ability of typical database software tools to capture, store, manage, and analyze. This definition is intentionally subjective and incorporates a moving definition of how big a dataset needs to be in order to be considered big data i.e., we don t define big data in terms of being larger than a certain number of terabytes (thousands of gigabytes). McKinsey

From its operational center in Britain, the company [ie Rolls Royce] continuously monitors the performance of more than 3,700 jet engines worldwide to spot problems before breakdowns occur Mayer-Schönberger & Cukier 2013

There is always money in the bananastand

Strikingly, in a big-data age most innovative secondary uses [of data] haven't been imagined when the data is first collected. How can companies provide notice for a purpose that has yet to exist? How can individuals give informed [Mayer-Schönberger & Cukier 2013] consent to an unknown

lawfulness of processing informed..? enforcement, state security, health care consent exectution of contract legal obligation public interest task vital interest legitimate interest sufficiently specific? sure, probably glass in your peanutbutter

purpose limitation personal data shall be: processed for specified, explicit and legitimate purposes not further processed in a way incompatible with those puposes

exemptions state security prevention, detection and prosecution of criminal offences important economic and financial interests of the State and other public bodies protecting the data-subject or freedoms of other persons incl. supervising compliance with legal provisions that aim to protect these interests

transparency is key (or is it?)

there is more profiling automated decision making presumption of innocence etc. dehumanization

profiling*) processing of personal data: to evaluate certain personal aspects relating to a natural person, or to analyse or predict in particular that natural person s performance at work, economic situation, location, health, personal preferences, reliability or behaviour Art 3a GDPR (LIBE) *) was: «automated decision making»

right to object to profiling every natural person shall have the right to object to profiling data subject shall be informed about the right to object to profiling in a highly visible manner Art 20 GDPR (LIBE)

So what now? And how? include data analysis in purpose description right to object against profiling make use of anonymous or pseudonymous data The Algorithmist!? people and predictions correlation is not causation breaking the black box (transparency?) data-subject control vis-a-vis data controller accountability
