Terms and Conditions The following terms and conditions apply to all bookings for programmes at Branwell Moore whether the programme is booked directly or through an agency. By submitting the booking form you are agreeing to the full terms and conditions. If enrolling a client aged 12-18, you agree to the terms and conditions on their behalf. 1. Payments 1.1 To make your booking, you must first submit a short booking enquiry form (Step 1), this reserves your requested programme dates for up to 2 weeks to give you chance to receive and complete the information required in Step 2.. After you submit the Booking Enquiry Form (Step 1), you will be contacted by Branwell Moore and asked to complete further information in order to write your bespoke Branwell Moore Programme. Once you have submitted this information online, you will be asked to make a 200 payment which covers part of the cost of creating your Programme. This payment is nonrefundable. However, if you proceed to accept your Branwell Moore Programme Proposal then this 200 payment is deducted from the cost of your full invoice. 1.2 50% of the full fees as quoted on your pro-forma invoice must be paid within 6 weeks of receiving your Branwell Moore Programme Proposal. The remaining 50% of the fees must be paid at least 6 weeks before the programme start date. We cannot guarantee to hold a place on the programme/accommodation unless all fees are paid in full and on time. Clients with unpaid fees will not be admitted to the programme and may not be able to guarantee their first choice of accommodation. 1.3 The initial payment of 200 can be made online or by bank transfer direct to Branwell Moore upon request. The 2 further larger payments should be made using the Bank Transfer information provided on your invoice. 1.4 It is your responsibility to cover all bank charges and exchange rate differences for payments. 1.5 You may make a maximum of 2 requests to revise elements of your Branwell Moore Programme Proposal document. Each revision request submitted may consist of multiple changes to be made. However, after 2 revision requests further amendments to your agenda will be charged at 50 per revision. 2 Programme fees include; A tailor-made programme agenda, individual to you in consideration of your learning preferences, personality style, language level and your programme objectives. Formal and informal meetings as detailed on the agenda with local English professionals, clients or retired professionals. For University Clients and Business Professionals, all programme coaching time. For Cultural Adventure clients, all time spent with your personal Cultural Companion Guide. All participation fees, entry fees, conference fees, membership fees for all activities mentioned on your bespoke programme agenda unless otherwise stated. Use of Branwell Moore study resources, all practice and test materials and library books Free on-site internet access

Branwell Moore tests and end of programme bespoke programme certificate Advice and support from Branwell Moore staff Use of Branwell Moore's sports and social facilities. Cost of transport as specified on your bespoke programme agenda e.g. taxi from airport, public and private transport, unless otherwise stated. Insurance** *The Branwell Moore End of Programme Certificate is subject to 80% minimum attendance. **This excludes clients who are UK residents. Unless otherwise stated, programme fees do not include: Accommodation Personal expenditure e.g. clothes/souvenir shopping Any food and drink unless stated otherwise on your programme agenda (you must pay for yourself during any arranged business or informal lunch/dinner) Courier fees 3. Cancellations, changes to bookings and refunds 3.1 Cancellations before the programme start date must be made in writing to Branwell Moore Head Office. Once a booking has been confirmed, the following cancellation notice periods and fees apply: Programme cancellation fees More than 2 weeks before the programme start date: you may have 25-50% refund depending on how much of the cost of the programme is recoverable. Less than 2 weeks before the programme start date: the costs you have paid will be nonrefundable. Accommodation cancellation fees The cancellation fees incurred when cancelling accommodation in an inn/guest house depend on the policy of the inn/host family in the information provided to you within your Branwell Moore Programme Agenda. If you cancel your accommodation with a Host Family at least 2 weeks prior to your arrival you will not incur any charges. However, if you cancel 1-2 weeks prior to arrival, you will incur a charge 50% of stated cost. 3.2 If you need to postpone your programme, you must tell us in writing. If we are able to change your programme dates, the following fees apply: Programme postponements More than 6 weeks before the programme start date: 50%-100% of programme costs (minus 200) Less than 6 weeks before the programme start date: 20-50% of programme costs, depending on what costs are recoverable. The costs above will be redirected to cover some of the cost of the postponed programme. Accommodation postponements

The postponement fees incurred when cancelling accommodation in an inn/guest house depend on the policy of the inn/host family in the information provided to you within your Branwell Moore Programme Agenda. If you postpone your accommodation with a Host Family at least 2 weeks prior to your arrival you will not incur any charges. However, if you cancel 1-2 weeks prior to arrival, you will incur a charge 50% of stated cost. 3.3 Clients who decide to leave their Branwell Moore-arranged accommodation, or move to a different type of accommodation, before the end of the booked period for accommodation, must do so at their own cost. No refunds for booked accommodation will be given even if it is not used. 3.4 Any refunds must be made by the same payment method and to the same source as the original payment. Handling charges and fees levied by the card company on any card payments are non-refundable. Fees are not transferable to other clients. 3.5 We reserve the right to charge an administration fee for any changes made to the original booking. 3.6 In the event that Branwell Moore has to cancel a booking, we will do our best to move the client to an equivalent programme. If this is not possible, we will refund all fees paid to Branwell Moore, but will not refund any other payments to 3 rd parties, such as for flights. 4. Visas (if required) 4.1 It is the responsibility of the client to check the client's visa requirements for entry into the UK, and if necessary apply for and ensure the client is granted the appropriate visa for their period of study with Branwell Moore. Information on visas can be found on the UK Border Agency website. In many cases, a study visa is not required and a tourist visa will suffice due to the length and nature of our intensive programmes. 4.2 Branwell Moore will only issue visa support documentation (if required) once all registration requirements are met and all fees due have been paid. 4.3 If you have not received your visa 2 weeks before the programme starts, you must inform us so we can work with you to make any necessary arrangements. If we receive less than 2 weeks notice of a visa delay and you wish to postpone your programme, we will charge postponement fees as detailed in Section 3 of these T&Cs. All programme and accommodation postponements are subject to availability. 4.4 If a visa application is rejected and we receive notice in writing, along with a copy of the visa refusal letter, we will refund the following: More than 2 weeks before the programme starts: 50%-100% of programme costs (minus 200) 2 weeks or less before the programme starts: 20-50% of programme costs, depending on what costs are recoverable. We will only offer refunds in cases for visa refusal where the client followed UK Home Office guidelines for their visa application

If a client arrives at one of our centres without the correct visa, we are required by law to arrange for them to leave as soon as possible. 4.5 If a client with a Tier 4 visa leaves Branwell Moore before the end of their programme, we are required by law to inform the UK Home Office. 4.6 All decisions on visa applications made by the UK Home Office are final. 5. Arrivals and departures 5.1 Do not book flights or make travel arrangements until you have received your agreed Branwell Moore Programme Proposal document from Branwell Moore. 5.2 Clients need to inform Branwell Moore, any arranged chauffeur and their Accommodation via telephone or email as soon as they are aware of any travel delays on their inbound journey. These contact numbers will be made clear for your convenience, in your Branwell Moore Programme Proposal document. 5.5 Delayed departure: should a client's departure at the end of the period of study be delayed due to circumstances beyond the client's control, Branwell Moore will continue to provide accommodation if possible, but will do so at the standard rate of fees. 6. The programme 6.1 All Branwell Moore centres and programmes have entry requirements, such as minimum age and language level. Please refer to the programme details or contact us for further information. If any information provided at the time of application is later found to be incorrect, we reserve the right to make any changes considered necessary to the enrolment at the client s own expense and, if appropriate, ask them to leave their programme and accommodation without a refund of fees. 6.2 All programme components are run subject to availability. 6.3 We reserve the right to change programme arrangements and prices without advance notice. 7. Accommodation 7.1 We reserve the right to change accommodation arrangements and prices without advance notice. 7.2 By agreeing to these Terms and Conditions, you are also agreeing to the rules, terms and conditions of your selected accommodation provider. If you wish to see a copy of these T&Cs then you can ask to have them emailed to you prior to your stay. 7.3 If you have booked Host Family accommodation we will carefully select the right Host Family family for you. We will do our best to meet all special requests, particularly relating to health and diet, but we cannot guarantee that this will always be possible.

8. Insurance 8.1 Insurance is included as part of our programme fees* and covers the following, amongst others: Cancellation and curtailment: Up to 7,500 Medical expenses: Unlimited Personal belongings: 2,000 Personal liability: 2,000,000 A summary of the cover, which is provided by Ace European Group Ltd, will be sent to you with your booking confirmation. *This policy does not cover clients who are UK residents. 8.2 Pre-existing medical conditions are not covered by the insurance. 9. Medical information 9.1 You must inform us of any disabilities, medical, dietary or other information that may affect the client s ability to participate in the programme at time of booking. If a client needs special assistance or arrangements and medical information has not been provided before the programme, Branwell Moore may be unable to provide the necessary support and the client may be asked to leave the offices and/or accommodation with no refund of fees. 10. Branwell Moore rules 10.1 These rules are to ensure clients benefit from their time at Branwell Moore and in the UK and apply to behaviour in Business or Leisure time, on Branwell Moore activities and in Branwell Moore arranged accommodation. Any clients breaking these rules, or English law, or persisting in serious anti-social behaviour will be disciplined and may be asked to leave the Business and their Branwell Moore-arranged accommodation with no refund of fees. 10.2 Branwell Moore accepts no responsibility for a client's personal actions to another party while at Branwell Moore, or for the supervision of clients out of lessons or scheduled activities. 10.3 All clients must: Attend all arranged meetings and coaching lesson, unless they are ill. Inform the Business of any changes of address or circumstances while at Branwell Moore Obey Branwell Moore procedures as explained at the beginning of their programme Observe fire procedures Comply with all UK laws and visa restrictions 10.4 Clients aged 18 and over must: Behave appropriately towards clients aged under 18 who are considered to be children in UK law Smoke only in designated areas (it is illegal to smoke indoors in the UK) 10.5 Clients aged under 18 are considered to be children in the UK and must: Return to their Branwell Moore accommodation by 23:00 hours every evening.

Inform their Host Family in advance if they are taking part in a Branwell Moore trip or activity that will finish later than 23:00. Not buy or consume alcohol, cigarettes (including electronic cigarettes) or tobacco as the minimum age to purchase this in the UK is 18 Have written permission from their parent or guardian to join day trips booked by Branwell Moore, but organised and run by an Independent travel company. Not move out of Branwell Moore accommodation without written permission from their parent or guardian 10.6 We reserve the right to ask clients to leave Branwell Moore immediately and with no refund of fees for these reasons: Not attending lessons regularly Serious anti-social behaviour (e.g. verbal abuse or rudeness, drunkenness, sexual harassment, violence, assault) Bullying, intimidating or threatening behaviour of any sort Proof of or admission to an illegal act (e.g. theft, assault, drink driving, poslesson or use of illegal drugs or offensive weapons such as knives, guns or other object with intent to cause harm etc.) Breaking any UK law Interference with fire or safety equipment and procedures Misuse of computers or downloading of any offensive material Any other act that brings the name of Branwell Moore into disrepute Refusal to obey reasonable requests from a member of Senior Staff 10.7 A Coach or Facilitator may recommend that a client is not re-admitted to Branwell Moore. Reasons for this include the following: Lack of progress in spite of everyone s best efforts Long term or repetitive illness making it impossible for the client to get full benefit from the programme Poor attendance and lack of commitment to the previous programme Behaviour in business, leisure lessons or accommodation which is inappropriate, disruptive or disturbing to others Failure to pay fees Breaking any UK law 10.8 Discipline: If the problem concerns behaviour in lesson your coach will speak to you. If there is no improvement, a senior member of Branwell Moore staff will speak to you. A formal warning may be given to you, and your parents/sponsor will be informed. If there is a very serious problem you may be asked to leave Branwell Moore premises without a refund of fees. 11. Clients under the age of 18 The minimum age for clients joining Branwell Moore programmes is 12. Clients under the age of 18 are considered children by UK law and we require additional information and consent to be able to accept these clients onto our adult programmes. In addition to the above rules, the following applies to clients aged under 18: 11.1 We strongly recommend that clients aged under 18 stay in Branwell Moore Host Families.

11.2 By choosing not to book Branwell Moore Host Family accommodation you are giving permission for the client to live independently in the UK. 11.3 If a client is not staying in Branwell Moore arranged accommodation, we must receive full contact details of where the client is staying. We accept no responsibility for accommodation not booked through us. 11.4 Some airlines do not allow clients under the age of 18 to travel without an adult. Please check the airline s guidelines before booking flights. 11.5 Branwell Moore must receive written permission from parents or guardians for clients aged under 18 who wish to; be absent from lessons or leave Business during booked lesson time travel independently and be absent overnight move out of Branwell Moore accommodation 11.6 If a client under 18 needs urgent medical attention and their parents/guardians cannot be contacted, Branwell Moore will act in loco parentis and will arrange for a doctor to give any medical treatment considered necessary, as well as authorise the administration of an anaesthetic and operation. 12. Complaints procedure 12.1 We are committed to providing the highest level of customer care. If you are not satisfied with our service, please see the complaints procedure. 13. Privacy policy 13.1 By making a booking with Branwell Moore you are agreeing to the storage and use of the information you supply for Branwell Moore's purposes only. 13.2 Branwell Moore will share your personal details only with third party providers who are contracted to provide a specific service on behalf of Branwell Moore and require the information to perform their function (i.e. taxi transfers, 24hour helpline.) Branwell Moore will pass on your details to UK government agencies if requested by them to do so. 13.3 We will take photocopies of clients passports and visa documents at the beginning of the programme for ad hoc UKBA record requests. 13.4 Branwell Moore may take photographs of social events, lessons and activities which may be used in promotional materials or social networking sites such as Facebook. Please indicate on the booking form if you are not happy for your photographs to be used for these purposes. 13.5 Please see our full website cookies and online privacy policy. 14. Intellectual property 14.1 All intellectual property rights in Branwell Moore s name and logo, website, promotional and marketing materials and all programme and examination content and materials belong to Branwell Moore. Anyone seeking to use, publish or copy any of Branwell Moore s materials needs to seek our permission in order to do so. 15. Liability 15.1 Branwell Moore will only be responsible for loss or damage suffered by a client which occurs as a foreseeable result of Branwell Moore s breach of the terms and conditions or its

negligence. 15.2 Nothing in the terms and conditions shall limit or exclude Branwell Moore s liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. 16. Force Majeure 16.1 Branwell Moore is not liable for any failure or delay in providing our services that occurs as a result of any event outside our reasonable control, such as but not limited to war, disease outbreak, natural disaster or terrorist attack. In such cases, we will immediately notify you in writing and shall be excused from performing our obligations for the duration of the force majeure event. 17. Legal enforcement 17.1 These terms and conditions are governed by English law. English courts will have exclusive jurisdiction to settle any disputes that may arise out of the terms and conditions.
