1 Liverpool City College Student Regulations 1. It is necessary to have a minimum number of rules in the interests of the whole organisation. 2. The rules set standards of performance and behaviour whilst the procedures are designed to help promote fairness and order in the treatment of individuals. It is our aim that the rules and procedures should emphasise and encourage improvement in the conduct of individuals, where they are failing to meet the required standards, and not be a means of punishment. 3. Every effort will be made to ensure that any action taken under this procedure is fair, with you being given the opportunity to state your case and appeal against any decision that you consider to be unjust. 4. The following rules and procedures should ensure that:- a. you are fully aware of the standards of performance, action and behaviour required of you at college b. disciplinary action, where necessary, is taken speedily and in a fair, uniform and consistent manner c. you will only be disciplined after careful investigation of the facts and the opportunity to present your side of the case. On some occasions temporary suspension from study may be necessary in order that an uninterrupted investigation can take place. This must not be regarded as disciplinary action or a penalty of any kind d. other than for an "off the record" informal reprimand, you have the right to be accompanied by a fellow member of student or other representative who may act as a witness or speak on your behalf, at all stages of the formal disciplinary process e. you will not normally be expelled for a first breach of discipline, except in the case of gross misconduct f. if you are disciplined, you will receive an explanation of the penalty imposed and you will have the right to appeal against the finding and the penalty. g. You must appeal in writing within 5 working days of receiving the written decision. The college will if possible have a different person deal with your appeal. You have a right to attend a formal hearing and bring a person with you to witness the proceedings. 1
2 h. If you are unhappy with the college appeal decision the college will arrange for an independent panel to deal with your final appeal. Broadly the appeal procedure is similar to that in the Complaints Procedure. 2
3 STUDENT DISCIPLINARY RULES It is not practicable to specify all disciplinary rules or offences which may result in disciplinary action, as they may vary depending on the nature of the work. In addition to the specific examples of unsatisfactory conduct, misconduct and gross misconduct shown in this handbook, a breach of other conditions, procedures, rules etc. within this handbook will also result in the disciplinary procedure being used to deal with such matters. RULES COVERING UNSATISFACTORY CONDUCT AND MISCONDUCT (these are examples only and not an exhaustive list) You will be liable to disciplinary action if you are found to have acted in any of the following ways:- a. failure to abide by the general health and safety rules and procedures b. smoking in areas which contravene college policy (serious misconduct) c. unauthorised consumption of alcohol on the premises d. persistent absence from study and/or lateness e. unsatisfactory standards of study f. rudeness towards members of the College and the general public or staff, objectionable or insulting behaviour, harassment, bullying or bad language g. failure to devote the whole of your time, attention and abilities to your studies during your normal college attendance hours h. unauthorised use of and Internet (including use of social networks such as Facebook, MSN, QQ or Skype) i. failure to carry out all reasonable instructions or follow our rules and procedures j. unauthorised use or negligent damage or loss of our property k. failure to report immediately any damage to property or premises caused by you SERIOUS MISCONDUCT 1. Where one of the unsatisfactory conduct or misconduct rules has been broken and if, upon investigation, it is shown to be due to your extreme carelessness or has a serious or substantial effect upon our operation or reputation, you may be issued with a final formal written in the first instance. 2. You may receive a final written as the first course of action if in an alleged gross misconduct disciplinary matter, upon investigation, it is shown to have some level of mitigation and is treated as an offence just short of dismissal. 3
4 RULES COVERING GROSS MISCONDUCT (these are examples only and not an exhaustive list) You will be liable to summary expulsion if you are found to have acted in any of the following ways:- a. grossly indecent or immoral behaviour, deliberate acts of unlawful discrimination or serious acts of harassment b. dangerous behaviour, fighting or physical assault c. incapacity at study or poor performance caused by intoxicants or drugs d. drinking alcohol whilst in college except at college organized events and with the permission of the Principal; e. possession, supply or use of illicit drugs f. deliberate falsification of any records (including time sheets, absence records and so on, in respect of yourself or any fellow student) i. taking part in activities which result in adverse publicity to ourselves, or which cause us to lose faith in your integrity j. theft or unauthorised possession of money or property, whether belonging to us, another member of staff, or a third party k. destruction/sabotage of our property, or any property on the premises l. serious breaches of the health and safety rules which endanger the lives or disability of staff, or any other person m. interference with, or misuse, of any equipment for use at work that may cause harm n. gross insubordination and/or continuing refusal to carry out legitimate instructions o. serious breach of the personal harassment policy p. smoking in College buildings. STUDENT DISCIPLINARY PROCEDURE 1. Disciplinary action taken against you will be based on the following procedure OFFENCE Unsatisfactory Conduct Misconduct Serious Misconduct Gross Misconduct First Formal verbal Written Final written Second Written Final written Third Final written Fourth 4
5 2. We retain discretion in respect of the disciplinary procedures to take account of your length study with us. 3. If a disciplinary penalty is imposed it will be in line with the procedure outlined above, which may encompass a formal verbal, written, final written, or dismissal, and full details will be given to you. 4. If you are found to have submitted work for any course at the college which includes one of the above conditions, you will be subject to serious disciplinary procedure and may even be asked to leave the course. matters concerned, and any further breach of the rules in relation to similar or entirely independent matters of misconduct will be treated as further disciplinary matters and allow the continuation of the disciplinary process through to dismissal if the s are not heeded. DISCIPLINARY AUTHORITY Because the college is very small it may not always be possible to have different people deal with different stages of a disciplinary process. Nevertheless, the college will attempt to do this if possible. PERIOD OF WARNINGS 1. Formal verbal A formal verbal will normally be disregarded after a three month period. Written A written will normally be disregarded after a six month period. Final written A final written will normally be disregarded after a one year period. 5
6 CHEATING AND PLAGIARISM Plagiarism is unauthorised copying or use of another s work, whether from a textbook, internet source or otherwise. This is not permitted and breach of this rule is a serious matter which could lead to expulsion from the college. Candidates may not: submit coursework which is not their own; lend coursework to other candidates; allow other candidates access to, or the use of, their source material, unless it is part of an authorised project. include in coursework, work copied directly from books or other sources without acknowledgement or attribution; All work must be written by you, not a friend or anyone else, is the product of your own mind, not learned from previous candidates, not copied from any other candidate in the, and was produced under exam conditions. Copied or false examinations or tests could lead to expulsion from college and loss of tuition fees. It is in your own interests at this stage to study responsibly and produce your own work. submit without acknowledgement coursework typed or word processed by another person. take unauthorised papers or materials into any examination or test copy any other candidates work in an examination or test Any breach of the Rule against Plagiarism, Copying or Cheating in examinations may be treated as a breach of the College Regulations and will attract the severest disciplinary penalties, 6
7 STUDENT LATENESS POLICY It is important for both the performance of the student and the smooth running of the college that students attend on time. It is accepted that from time to time unforeseen events (such as late buses or trains) may cause a student to be late. Therefore the college will always listen to explanations for lateness. If a student is delayed for any reason it is recommended that a phone call is made to the college ( ) to explain the lateness and to estimate when the student will arrive. Generally lateness of less than 15 minutes with a reasonable explanation will not attract any formal action. However persistent significant lateness (with significant defined as being more than 15 minutes) without reasonable explanation with result in the implementation of a formal meeting and/or system. In any calendar month one instance of a significant lateness without a reasonable explanation will result in an informal First Lateness Letter. A second significant lateness without reasonable explanation may result in a Second Lateness Appointment letter arranging a meeting at which a formal first lateness written may be issued. A third significant lateness without reasonable explanation will incur a Third Lateness Appointment letter arranging a further meeting and possibly a Final Written Warning over lateness. Depending on the severity of the lateness issue it is possible that any lateness may be classed as a missed contact for absence purposes and hence count toward the Attendance policy absence procedure which potentially may amount to expulsion from the college. 7
