Golf Cart Rental Agreement This contract is between Bolivar RV Resort, hereinafter, referred to as the "Lessor" and, hereinafter referred to as the "Lessee". 1) The Lessor shall deliver the gasoline golf cart with a full tank. It is the Lessee's responsibility during the term of the lease to provide any additional fuel needed for the golf cart. All golf carts shall be returned full of fuel or Lessee will be charged for fueling. 2) The Lessee shall be responsible for normal maintenance, which includes vehicle fluid levels, cleanliness, and proper inflation of the tires. 3) The Lessor guarantees the performance and condition of the equipment and expects the cars to be returned in the same condition as when delivered. Normal wear and tear is expected, but abuse or damage to the golf cart while in the Lessee's possession shall be the responsibility of the Lessee. 4) Any cost to repair or replace cars and their accessories as a result of any acts of vandalism, fire, theft, or neglect will be the responsibility of the Lessee. If the equipment is stolen, Lessee is responsible for the replacement of the golf cart. $20.00 per key will be charged for each key not returned to Lessor. 5) Rental payments and deposits are payable in advance at the time of delivery or pickup. payment shall be made by credit cards only. 6) Lessee agrees that only persons who are 25 years or older, possessing a valid driver's license and insurance as required by law shall be permitted to drive the golf car. Lessee further agrees that the maximum occupancy of the golf cart is four persons, including children. Violating this rule will result in cancellation of the privilege of the golf cart and full payment will be due for the full lease agreement. 7) No signs or decals shall be affixed to the cars with any kind of adhesive. 8) Lessee understands that if the golf cart should become inoperable through no fault of their, that Bolivar RV Resort will take reasonable steps to have the vehicle repaired. In the event the golf cart cannot be repaired or replaced, a refund will be issued towards the unused rental agreement period. 9) The Lessee agrees to fully reimburse, indemnify, provide defense for and hold harmless Lessor... from and against any and all claims, losses, suits, damages... liability, demands, expenses, causes of action, whether for property damage, bodily or mental injury, or death which may arise, directly or indirectly, out of, incident to, either : a) any damage to property of, or death or personal injury to, Lessee, its sublessees, laborers, or to any of their respective employees, agents, invitees or representatives. This indemnity obligation shall apply regardless of the theory on which a claim may be made, including, without limitation, breach of contract or warranty (expressed or implied), negligence, strict liability in tort, or fraud; regardless of whether claims are caused or contributed to by: the sole negligence, fault, acts, or omissions of Lessor; the concurrent combined or joint negligence, fault, acts or omissions of Lessor and Lessee; or any concurrent, combined or joint negligence, fault, acts or omissions of Lessor, Lessee, any third person, firm or entity, or any combination thereof; and regardless of whether a defect or breach is known to Lessor. Lessee understands that this agreement includes the obligation to indemnify Lessor for the consequences of Lessor's sole and concurrent negligence, fault, conduct, and other acts and omissions of any nature. 10) Lessee shall contact Lessor in the event there are mechanical problems during lease period.
11) During the term of the lease, the Lessor has the right to inspect any and all vehicles leased to the Lessee. Upon finding any tampering or adjustments made to the vehicles causing them to perform outside the manufacturers design and specifications, the Lessor has the right to pick up any or all vehicles leased to Lessee. Lessor also has the right to collect full payment for the amount of the lease contract. 12) Should the machinery returned not be in a state of good repair, a deposit will be used toward the repair of the golf cart and additional monies may be owed by Lessee depending on how much the repair is. If the repairs exceed the deposit, the Lessee's credit card will be used to pay the balance of the repairs. 13) Any deposit due back to Lessee shall be returned within 7 days following the termination of the lease, or within a reasonable time. 14) I agree to become familiar with the operation and use of the golf cart and to read the information sheet supplied to me by Bolivar RV Resort on the use of the Golf Cart. I agree to contact Bolivar RV Resort if I have any questions or concerns about operating the golf cart or if any damage to the golf cart has been done. I agree to examine and inspect the safety and mechanical condition of the golf cart and report any concerns or problems before driving the vehicle. Golf Cart Rules Effective Date: 08-1-13 1) A golf cart is a motor vehicle. All rules that apply to a car or truck also apply to golf carts, including traffic laws. All rules apply on the beach also. 2) You must have a valid driver's license to operate a golf cart. 3) You may only operate a golf cart on a roadway including ditches that has a speed limit of not more than 35 mph. You cannot operate golf cart on a highway. You may cross the highway going straight across and not at an angle. 4) You can only operate a golf cart between sunrise and sunset. Not at night. 5) You must have a slow moving triangle on the rear of the golf cart. 6) Neither the driver nor passenger of a golf cart may have an open container of alcohol in it, even if it is not moving. 7) If an unlicensed driver is operating a golf cart, the parent or person in charge of the cart may be charged with "allowing an unlicensed driver to operate a motor vehicle." 8) A golf cart must have a beach parking sticker to park on the beach. 9) If the golf cart is equipped with safety belts, they must be worn. The Galveston County Sheriff's office and Precinct 6 Constable's office are stepping up enforcement of these laws. The number of accidents resulting in serious bodily and death have increased dramatically due to the popularity of these vehicles. These are not new laws, warnings have been given for years but most have gone ignored. They are now issuing citations and will continue to insure our beach is safe for pedestrians and golf carts. Golf Cart Rental Information Sheet 1) Do NOT operate the golf cart in the surf or any tidal waters. Doing so will result in the loss of the use of the car and the security deposit at a minimum, no exceptions. 2) The Key must be removed from the golf cart any time it is left unattended. 3) The golf cart is equipped with a "low engine oil" light. If this light comes on, stop operating the vehicle and notify Bolivar RV Resort immediately. 4) Make sure the lights are turned off when not operating the golf cart Do not use the lights unless necessary. 5) Follow all local and state rules and regulations 6) Upon completion of the rental, the golf cart should be washed off thoroughly. Do not use a pressure washer, only a water hose. Make sure the entire golf car is rinsed, including the engine compartment and undercarriage. 7) Failure to wash the golf cart at the completion of the rental period will result in a minimum fee of $20 cleaning fee that will be charged against your deposit.
