Remodelers Council - Remodelers Tour ENTRY FORM Date of Event: September 10-11, 2016 The completed form must be accompanied a method of payment: credit card or 2 separate checks made payable to Rochester Area Builders (RAB) Payment #1: Entry Fee First entry is $500 (1 st deadline) or $600 (2 nd deadline) for members of the Remodelers Council Entry fee + $60 for RAB members who are not members of the Remodelers Council (includes 1-year membership in Remodelers Council at a discounted price. Renewal of dues after the first year will be the normal rate of $120) Additional entries are $300. Please use a separate form for each project entered. Rochester Area Builders Remodelers Council 2016 Remodelers Tour Participation Agreement I hereby agree to abide by the following rules and regulations: 1. My home entry will be open for public viewing during the entire event September 10th & 11th; 11:00 A.M. 5:00 P.M. 2. I agree that all information on the Remodelers Tour forms will come from me and be my responsibility. No information is to be dispensed by any agent. I can be reached during business hours at the number listed at the end of this form. 3. I agree that damages due to errors or omissions concerning my project, the maps, or my firm in the Tour publications or any related advertising or press releases will be limited to a maximum of a refund of my Tour entry fee. I agree to call errors to the attention of the Remodelers Tour Committee through written communication by August 26, 2016. 4. Remodelers will be allowed to place directional signs in strategic street locations to direct potential buyers to Tour homes. I agree to remove all directional signs and return them to the RAB office within 24 hours of the completion of the Tour. 5. No changes in text can be made after August 26, 2016. 6. I agree to staff my project adequately during all hours of the Remodelers Tour. 7. I agree to follow the recommended guidelines set forth by the Remodelers Tour Committee. 8. I agree to have a liability insurance policy in effect covering my project during the time of the promotion, and will send a copy of a certificate of insurance with my entry form to the RAB office. 9. Any violation of the above rules will result in a one-year suspension (2017) from participation in the Remodelers Tour. 10. If the project is not complete or presents a safety hazard to the public by the opening date of the Tour, I agree to remove the site sign and also to remove any directional signs in the area. Failure to comply with this clause will result in a denial of my Remodelers Tour participation privileges for 2017. The final decision as to whether the home is complete or safe will be made by the Tour Committee. Remodelers Council 2016 Remodelers Tour HOMEOWNER S PARTICIPATION AGREEMENT Dear Homeowner: On behalf of the Remodelers Council of Rochester, we would like to thank you for agreeing to display your home in the 2016 Remodelers Tour. This event represents a tremendous investment of time and talent by the Remodelers Council of Rochester to publish the Tour program and to promote the event. It also requires a great deal of dollar investment for the remodeler, not just for the entry fee, but for the planning, staffing, and merchandising of your home during the event. For many remodelers, it may be the most significant effort for the entire year. The end result is to present your remodeled home and your remodeler at their very best throughout the weekend of the show. We sincerely appreciate your participation. Make the home available during the entire event and allow for any necessary time to set-up before and clean-up afterwards. 2. Make every effort to present the project at its best during the weekend. 3. Allow photographs to be used for publicity by the Remodelers Council of Rochester and/or the remodeler. 4. Allow for the display of additional signage in the home during the event. And the Remodeler Agrees to: 1. Maintain adequate staffing throughout the event s duration to ensure homeowner s security. 2. Make every effort to protect homeowner s property by sectioning off unshown areas, protecting carpet, landscaping, etc. 3. Maintain liability insurance on the property during the entire show. A certificate of liability insurance to the prescribed limits will be kept on file at the offices of the Rochester Area Builders. 4. Allow no pictures to be taken by people touring the project. 5. Maintain the customer s privacy by not using their name in the marketing for the event. 6. Will use discretion when discussing project specific financials. WAIVER & INDEMNIFICATION AGREEMENT You, as a member (the Member ) of Rochester Area Builders, Inc. ( RAB ), must be complete and sign this form prior to your involvement in RAB s 2016 Remodelers Tour event (the Event ). If you fail to do so, you will not be allowed to participate in the Event. By voluntarily participating in the Event, you hereby agree that RAB is not responsible for personal injury, property damage or any other loss, claim or damage related to or arising out of, in whole or in part, the acts or omissions of any person that is part of your organization, including your employees, agents, and representatives, or any third party or person that is engaged or invited by you in connection with the Event or otherwise occurs at the site which you are sponsoring for the Event. You further agree to keep in full force and effect during the Event comprehensive liability insurance covering all of your acts and your employees, agents, and representatives in a single limit amount of not less than Two Million and 00/100 ($2,000,000.00) Dollars for personal injury or death, and no less than One Million and 00/100 ($1,000,000.00) Dollars for property damage and fire liability. You hereby release and forever discharges RAB, its other members, volunteers, employees, representatives, successors, officers, managers, governors and/or agents (each an Indemnitee ) from all claims or liabilities of any kind arising out of your participation in the Event. You also agree to hold harmless, defend, and indemnify each Indemnitee from any and all claims, suits, or causes of action by others for bodily injury, property damage, or other damages which may arise out of, result from, occur during, or are in any way connected with your participation in the Event, including claims arising from RAB or any other party s negligence. YOU AGREE THIS WAIVER, RELEASE AND INDEMNIFICATION AGREEMENT IS TO BE CONSTRUED UNDER THE LAWS OF THE STATE OF MINNESOTA, USA, AND IF ANY PORTION HEREOF IS HELD INVALID, THE BALANCE HEREOF SHALL, NOTWITHSTANDING, CONTINUE IN FULL LEGAL FORCE AND EFFECT. YOU AGREE THIS AGREEMENT IS TO BE CONSTRUED BROADLY TO PROVIDE A WAIVER, RELEASE AND INDEMNIFICATION TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAW. Rochester Area Builders, Inc. 2016 Remodelers Tour Rules & Guidelines ENTRIES IN THE REMODELERS TOUR Only builders and appropriate associate members can enter a project in the Remodelers Tour and they must be members in good standing of Rochester Area Builders and the Remodelers Council. All entries in the Remodelers Tour must have been completed within the past three years. The builder or representative must be on the premises during all Tour hours. Projects may be shown either furnished or unfurnished. It is suggested that owners NOT be present during Tour hours sometimes negative comments can be made about their home that could cause a problem. The Hold Harmless Agreement must be signed by the owners of the property. The Homeowner s Participation Agreement must be signed by the owners. Members agree that the project must be completely finished on or before September 2, 2016. Tour projects that are not ready by Friday, September 2, 2016, will not be open for the Remodelers Tour and the member will forfeit half of the security check. SIGNAGE Official Remodelers Tour signs will be furnished by Rochester Area Builders. They will include one outdoor sign for the front yard of the Tour project and five directional signs for members to place as needed to direct visitors to the Tour project. Signs must be returned in the same condition as they were checked out. Missing signs for any reason will be the responsibility of the member and will be invoiced to the member. Signage can only be used for the project that is entered in the Tour event. Subcontractors and suppliers will be permitted to advertise their firm providing there is not more than one sign per room per company. FEES The entry fee is set by the Remodelers Tour Committee. A $100 discount is available if the entry is received by the June 17th deadline. This discount is eligible on the 1st entry only since there is an automatic $300 fee for the second entry. In order to qualify for the discount all information including completed entry forms and checks must be in the office by 5:00 P.M. on July 15th. There are no exceptions. Pictures must be submitted by August 19th. Members are to provide one before photo and 2 after photos, along with the most current logo for the business. No substitutions are allowed after August 12, 2016.

We require a security deposit of $400.00 per project for the items that you receive. Each participant will be required to pay with two separate checks. A credit card may also be used. The first check represents the entry fee and will be deposited upon receipt. The second check will be held by the association office until signs, flags, shoe covers, and containers are returned. The deadline for returning all materials is Tuesday, September 13, 2016. At that time invoices will be sent to cover the cost of the missing items. Replacement cost for the large sign is $100.00, for each small sign is $35.00, for the string of flags is $15.00, and for the containers and shoe covers is $15.00. Deposit checks will be returned when all outstanding Remodelers Tour invoices are paid or all items are returned. CANCELLATION If the member wants to cancel their participation in the Remodelers Tour, that request must be in writing no phone cancellations are acceptable. Requests postmarked prior to July 15, 2016 will receive a full refund of their entry fee and their entire security check. No refunds of entry fees will be made to requests postmarked on or after July 15, 2016, but the security check will be returned.
