1 Dear Art Festival Applicant: The Art in the Park Committee and the City of Kennedale invite you to apply to participate in the Fifth Annual Art in the Park Arts Festival to be held April 4 6, Please follow the application instructions carefully and note that the deadline for submitting the application for Art in the Park is February 15, Space is limited for this festival. All applicants will be notified by regarding acceptance or non acceptance. Checklist The following items must be completed and enclosed for the application to be considered 1. Application (pages 3 7) and Application Fee ($20.00) 2. Notarized Exhibitor/Vendor Waiver (page 7) 3. Copy of Texas Sales Tax and Use Permit 4. A minimum of (3) photos or digital images: of your products, booth you intend to use, and your overall display. Color copies are acceptable. 5. Food Vendors will need to submit a temporary food permit (must apply for permit 2 weeks prior to the festival) Incomplete forms will not be accepted. Photos of accepted applicant s products become the property of Kennedale Art in the Park Committee. Submission of application does not guarantee acceptance of placement. Festival officials reserve the right to select or reject Exhibitors/Vendors. Art in the Park is an outdoor event. There are no refunds for inclement weather. On Site Information Artist/Exhibitor/Vendor must be present during the entire event and must personally staff their exhibit space. No commission on sales will be charged. Fees: Application Fee: A $20 Non refundable check or money order in care of: City of Kennedale c/o Art in the Park Standard Booth Fee: $120 Exhibitors/Vendors must provide their own 10 x 10 tent, supplies and lighting. All sales and display items must be contained within booth area. Business Booth Fee: $320 Exhibitors/Vendors must provide their own 10 x 10 tent, supplies and lighting. Concrete tieoff anchors will be provided at no charge to Business Area tents only. Late Fee: A $20 Late Fee will apply to all Exhibitors/Vendors whose application and all associated fees are not received by February 15, 2014, which is the deadline for all fees to be paid in full. Returned Check Fee: A $30 returned check fee will be applied to all returned checks. Cancellation: A $40 cancellation fee. All cancellations must be in writing and mailed to: City of Kennedale c/o Art in the Park 405 Municipal Drive Kennedale, TX All fees (except the application fee and cancellation fee) will be refunded should there be a rejection of application. Checks, cashier s check or money orders payable to: City of Kennedale c/o Art in the Park Must be paper clipped, NOT stapled to the application I need: Standard Booth (s) (10 x 10 area) at $120 each Business Booth Space (s) (10 x 10 $320 each Exhibitor/Vendor tents will be inspected April 4, 2014 from 3:00 pm to 4:00 pm prior to the beginning of the festival. All tents are required to be in good condition and must pass visual inspection (free from rips, tears, stains, rust or excessive wear spots). All tents must be properly assembled and staked as to not be a safety hazard. If any tent is found to be unacceptable, the Exhibitor/Vendor must replace the tent with an acceptable substitute. 4 The Art in the Park Festival Committee reserves the right to assign space(s) in accordance with other Exhibitors/Vendors and products. No exclusives will be offered. Important Art in the Park Rules: Please INITIAL next to each item indicating you have read it. (1) One 110 volt 15 amp electrical outlet will be provided. All Exhibitors/Vendors must provide their own free standing, canopy or tent, supplies and lighting. Exhibitors/Vendors must also bring a minimum of (1) one 100, personally identified, heavy duty extension cord. All sale and display items must be contained within assigned booth space. Art in the Park is an outdoor event and will go on RAIN or SHINE. There are NO REFUNDS for inclement weather. A submission of an application does not guarantee acceptance to the festival. There are no provisions for water. The City of Kennedale, Texas will not assume responsibility for damage or theft of your property. We do not offer any exclusives. Exclusives will be granted to our Food Vendors. Festival Hours: Friday (4/4) 4:00 pm to 9:00 pm Saturday (4/5) 10:00 am to 10:00 pm Sunday (4/6) 12:00 pm to 5:00 pm Exhibitors/Vendors are required to remain open until 8:30 pm Friday and Saturday; and 4:30 pm Sunday Check in will begin Friday, April 4 at 9:00 am (No Exhibitors/Vendors will be allowed in the Park before 9:00 am, NO EXCEPTIONS) Festival Set up will take place Friday, April 4 from 9:15 am 3:00 pm (Exhibitors/Vendors MUST check in first) Festival breakdown/clean up will take place Sunday, April 6 between 5:00 pm 8:00 pm All arts and crafts must be original designs by the applicant Cancellation Policy Cancel prior to February 22, % refund after cancellation fee Cancel February 23, 2014 February 28, % refund after cancellation fee Cancel after February 28, 2014 No refund All cancellations must be in writing and received by the date listed above. 5 Art in the Park recommends but does not require Exhibitors/Vendors to obtain a minimum of $500,000 of product liability insurance. A copy of your certificate naming City of Kennedale as an additional insured must be filed prior to the event. My signature acknowledges that I am the creator of my work, I will be present during the festival, and my booth will be open all advertised hours of Art in the Park. I have read, understand and agree to the above stated rules and regulations set forth by the Art in the Park Committee and understand that failure to comply can result in immediate expulsion without refund. 7 Hold Harmless and Indemnity Agreement I,, the Undersigned, binding my heirs, executors, administrators, Estate and assigns, do hereby agree to completely and wholly release, indemnify and hold harmless the Kennedale Art and Culture Foundation, Art in the Park, City Parks, City of Kennedale Texas, its officers, agents, independent contractors, and employees for any and all claims, damages, harm, personal injury, including death, property damage, lawsuits and judgments, including court costs, expenses, and reasonable attorney s fees, and all other expenses resulting from the activities, programs, and events, occurring on the above-stated date of the stated festival in Kennedale, Texas. It is the understanding of all parties that this release, indemnity, and hold harmless agreement shall apply whether or not the claims, damages, harm, personal injury, including deaths, property damage, lawsuits, judgments, court costs, attorney s fees or any other expenses arise from the negligence of whatever nature, omissions, willful or intentional acts of the vendors or vendor s officers, agents, employees, independent contractors, other representatives invites, licensees, or guests. If this vendor is other than an individual, vendor certifies, warrants and represents that the individual whose signature appears below is duly authorized to execute this Agreement on behalf of the firm, corporation, partnership or other who is the vendor.
