Conflict Sensitive Resource and Asset Management Program

Program Brief: Conflict Sensitive Resource and Asset Management (COSERAM) Program Lead Executing Partners: National Economic and Development Authority (NEDA); Department of the Interior and Local Government (DILG) Conflict Transformation for Equitable Development Since 1 January 2011, the Conflict Sensitive Resource and Asset Management (COSERAM) Program supports an integrated approach of poverty reduction and peace building in the region of Caraga. e COSERAM Program is a joint undertaking of the Philippine and German Governments, implemented by GIZ, the KfW (German Development Bank) and the local partners. Context Caraga is an administrative region of the Philippines, on the northeastern portion of the island of Mindanao. Rich in natural resources, it has great potential for development. It is characterised by a wood-based economy, extensive water resources and rich mineral deposits, such as iron, gold, silver, nickel, chromite, manganese and copper. Target Groups: Disadvantaged poor population, people affected by land or resource-based conflicts indigenous peoples and women Location: Caraga Region, Mindanao, Philippines Duration: 1 January 2011 31 December 2014 Despite this potential, Caraga remains the poorest region in the country, and political and social disputes are prevalent. e inequitable access to resources and land is one cause of conflict. Contradictory and overlapping provisions in the Philippines land tenure legislation exacerbate the situation. Furthermore, the region is still subject to New People s Army activities. All these problems hinder development. A participatory community peace and conflict analysis identified five major peace building needs for the Caraga region: (1) classification and demarcation of land; (2) regulation and enforcement of land and resource issues; (3) management and utilisation of natural resources; (4) human security, including local conflict transformation and improved livelihoods; and, (5) access to services. e current program addresses these needs in selected areas of Caraga together with our partners.

Approach COSERAM aims to ensure that governance of natural resources and assets is implemented in a peaceful and sustainable manner, benefitting the community. e target group of the program is the disadvantaged poor population, people affected by land-based resource conflicts, indigenous peoples and women. Program Components: e program adopts an integrated approach to peace building and poverty reduction. multi-level strategy includes the use of various methods to promote the non-violent transformation of conflicts and improvement of service delivery. e program seeks to reach its goal through three components wherein Components 1 and 2 are the technical and personnel contribution of GIZ while Component 3 is the financial contribution from KfW: e DEL BUCAS GRANDE Component 1: Resource Management Aims to strengthen and improve the processes of regulation, enforcement and management of natural resources to ensure its equitable and sustainable use. Component 2: Human Security Addresses peace building needs of selected local communities through conflict transformation, legal aid and support measures for improving income and livelihoods. Component 3: Asset Management Focuses on improving sustainable access of local government units and micro small medium enterprises to development-oriented infrastructure and asset finance by applying conflict-sensitive appraisal techniques. is component is yet to be implemented. Activity Clusters: As entry points, five areas have been selected where clusters of various support activities are currently implemented. In the province of Surigao del Norte, the program for instance supports the joint endeavor of civil society and state actors to develop a conflict sensitive ecosystem approach from upland watershed down to coastal areas. Multi-stakeholder dialogues, participatory land use planning, strengthening of community-based wardens (Bantay Dagat) and empowerment of marginalized communities shall protect the watershed in the mountains, stabilize the marine protected areas in the nearby coastal zones and reduce violent conflicts on the use of these resources. In the province of Agusan del Sur, the program supports the innovative cooperation of the provincial government, the National Commission on Indigenous Peoples (NCIP) and indigenous communities to jointly enhance the process of claiming their Ancestral Domain Titles and to develop culture and conflict sensitive Ancestral Domain Sustainable Development and Protection Plans. Clearly demarked land titles and transparent conflict resolution mechanisms are important preconditions to improve the livelihood of marginalized groups and the investment climate of the province. To this end, COSERAM also provides capacity development for various stakeholders on the implementation of the Indigenous Peoples Rights Act (IPRA), the land use and development policies, the mining acts, etc. Results achieved so far In preparation for the COSERAM Program, the following results have been achieved: 480 community members collaborated for the first time in a participatory community peace and conflict assessment to identify regional peace building needs. National line agencies, local government units and representatives of civil society took responsibility for the program framework and endorsed a resolution to show their commitment to it. e Office of the Presidential Adviser on the Peace Process (OPAPP) drew on the peace and conflict analysis framework of COSERAM as basis for their work in conflict affected areas. Regional, provincial and municipal line agencies developed plans for testing conflict transformation strategies in selected watershed areas in the region. Contact DR. Factsheet Conflict Sensitive Resource and Asset Management (COSERAM) Program Peaceful and Sustainable Ridge to Reef Approach This Activity Cluster of the COSERAM program aims at supporting initiatives that will achieve an ecosystem based sustainable and peaceful development of the Malimono area from the watershed in the upland (ridge) to the coastal zones (reef). Context Malimono is one of the poorest municipalities in the Province of Surigao del Norte. The estimated forest land of 1,890 hectares in the uplands of Malimono is covered with primary and secondary forest, also extending into the Surigao Watershed Forest Reserve. Farming and fishing are the main sources of income. The municipal waters have potentials for eco-tourism. Coral reefs and underwater caves along the coast provide a sanctuary for endemic fish species. There are ten pending mining claims in the municipality covering an area of 3,450 hectares within existing agricultural and forestland. These potential mining sites partly surrounding the upland watershed have substantial gold deposits already explored by foreign and local mining companies. DEL BUCAS GRANDE Several conflict lines hinder a peaceful and sustainable development. The degradation of natural resources from the mountain ridge down to the reef starts to show its effects across the ecosystems (e.g. decreasing quantity and quality of water supply, damage to marine resources). This occurs primarily through small scale timber and mining operations as well as illegal fishing in the area. Other emerging conflicts involve competing environmental and economic priorities and interests of stakeholders. Those are further aggravated by inadequate public services; lack of consultation of affected groups (in particular the indigenous community of the Mamanwas); and overlapping mandates among government and other agencies. All those conflicts are potentially violent, and can trigger further escalation. The presence of the New People s Army might lead to an increase of military operations and disrupt the daily lives of the residents. Approach COSERAM supports the joint endeavour of civil society and state actors to develop a conflict sensitive management approach from the mountain ridge down to the coastal reefs. The Ridge to Reef (R2R) is a holistic ecosystem approach for sustainable resource management particularly suitable for the context of Malimono. R2R emphasizes connectivity within and between sub-ecosystems such as upland, lowland, freshwater and the sea. It focuses on the protection and restoration of ecosystem functions and processes, with the aim to mitigate further degradation of land, water and coastal areas and the implied land and resource conflicts. The innovative asset of the COSERAM program is the application of a multi-stakeholder dialogue process in which different perspectives of all actors are discussed, aiming towards a joint objective. The program supports capacity development of all stakeholders to strengthen the conflict sensitive management of marine protected areas and eco-tourism sites, and participatory development planning. Through the inclusion of the R2R approach in plans and processes of the municipality of Malimono and line agencies such as Department of Environment and Natural Resources (DENR), COSERAM and its partners work towards an improved management of natural resources. Joint aim of the Surigao Metropolitan Water District (SMWD) supported by a GIZ Development Worker and the Hinatuan Passage Development Alliance (HIPADA) is a strengthened watershed protection and management, addressing conflicts regarding overlapping land use claims. SMWD draws the water supply for Surigao City from the upland watershed. HIPADA is a cooperation of eight municipalities in Surigao del Norte and has great interest to learn from the pilot activities to up-scale the experiences beyond Malimono. The Surigao del Norte NGO Coalition for Development (SUNGCOD) a coalition of 8 NGOs supported by a German Civil Peace Service Expert currently establishes with the LGU Malimono marine protected areas and strengthens the Bantay Dagat (a community based sea patrol/warden). Apart from focusing on environmental protection, SUNGCOD also assists marginalized groups with alternative livelihood projects, conflict analysis and the provision of advocacy services. Especially the Mamanwas security of tenure needs more attention, legal aid and technical expertise. The situation and rights of indigenous people should thus be mirrored in planning and implementation activities of all government agencies. Anticipated Results A comprehensive R2R framework is established and implemented! Development interventions are planned within the framework considering the impacts on the different ecological and social subsystems! Participatory conflict sensitive land use and development planning is improved and plans are adopted! Multi Stakeholder Management of the area is strengthened Stakeholder s capacity to protect coastal and upland areas is strengthened! Further land degradation is prevented and food security enhanced! Infrastructure for protection and processes of non-violent enforcement, e.g. through a functional bantay dagat, is improved! Cooperatives for small-scale fishers and farmers (including women s organisations) identify alternative livelihood opportunities Awareness on Indigenous People s rights and situation is increased! All stakeholders (including the marginalized Mamanwa tribes) are well informed about the indigenous peoples rights! Lessons learnt and best practices from other regions serve for the further strengthening of the alliance. Based on these findings, the Memorandum of Agreement of the alliance members was revisited and an Inter-municipal Cooperation Team (IMCT) established. COSERAM and the Local Government Development Foundation (LOGODEF) have been requested to support the alliance in the capacity development of the IMCT on gender and conflict sensitive planning (Comprehensive Development Plan and Comprehensive Land Use Plan, CLUP). Furthermore, small development measures to strengthen the members cooperation and to increase their confidence in the benefits of inter-local cooperation might be needed. Factsheet Conflict Sensitive Resource and Asset Management (COSERAM) Program Conflict Prone Natural Resource Management in Butuan City/Agusan del Norte Butuan City/Agusan del Norte Conflict Prone Natural Resource Management This Activity Cluster of the COSERAM Program is strengthening the City of Butuan and its partners to improve preconditions for adequate investments in natural resources in conflict prone areas. Context The City of Butuan is the center of Caraga region. The boom of the logging industry from the 1950s to the middle of 1970s made Butuan the "Timber City of the South" with a flourishing logging industry. In 2004, the Department of Environment and Natural Resources (DENR) and Butuan City entered into a co-management agreement for an area covering 10,960 hectares which was formerly used by a timber company, the Nasipit Lumber Company Inc. (NALCO). Since the timber company abandoned the area, settlers entered occupying the land, officially but also illegally. More than 75% of the 3,500 households in the area are living below poverty threshold. Majority of themthe households are subsistence farmers. Indigenous peoples (Higaonons and Manobos) are present in six of the eight Barangays. Certificates of Ancestral Domain Titles (CADT) are expected to be claimed. At the same time, several domestic and international investors have already expressed their interest to invest in the area. The area is also known to be partly under the influence of the New People s Army. This complex situation and the high economic interests increase the potential for violent conflicts, hampering the development of the city. The city itself recognized that fostering a peaceful prosperity and enabling sustainable investments can only be achieved, if adequately considering the needs and rights of settlers and Indigenous People present in the area. Approach The vision of the City of Butuan in the co-management agreement is to jointly allocate, protect, develop and manage the former timber license agreement area for the benefit of the present and future generations of the communities and with due regards to the ancestral rights of the Indigenous Cultural Communities (ICCs). In this context, COSERAM has been asked to support the Technical Working Group (TWG) of the NALCO Co-management area established by the city, DENR and other line agencies. Main objective of this cooperation is strengthening the TWGs capacities to establish and conduct Multi Stakeholder Dialogues (MSDs) for participatory planning and management of the NALCO area. This includes the elaboration of criteria for prioritization and selection of potential investors likely to ensure peaceful and sustainable development. At the same time, the participatory planning approach shall be used for a conflict sensitive formulation of the Comprehensive Land Use Plan (CLUP) of Butuan City with integrated Forest Land Use Plan (FLUP). Similar challenges as in the NALCO area are faced in a Co-Management Area between the Province of Agusan del Norte and DENR as well as in the main watershed of the City of Butuan. Factsheet Conflict Sensitive Resource and Asset Management (COSERAM) Program Integrated Approach to Ancestral Domain Titling and Planning in Agusan del Sur This Activity Cluster of the COSERAM Program seeks to enhance the issuing of titles and the elaboration of development plans for Ancestral Domains of Indigenous Peoples in a fair, conflict and culture sensitive way in order to improve the investment climate in the province Agusan del Sur. Context The region of Caraga in Mindanao is home to an estimated 500,000 Indigenous Peoples (IPs) who are facing several challenges: degradation of natural resources; economic and political marginalization; overlapping claims to their ancestral domains; armed conflict within their domains between state and non-state actors; as well as inter/intra tribal conflicts. Until now, very few titles to Ancestral Domains and even less Ancestral Domain Sustainable Development and Protection Plans (ADSDPPs) have been formally recognized by the State as required by the Indigenous Peoples Rights Act (IPRA) of 1997. These processes are often time-consuming, expensive, not conducted in a conflict-sensitive way, as they e.g. divide the IP communities. Interfaces with other development plans are not sufficiently considered. To ensure land rights of the Indigenous Peoples (Higaonon, Banwaon, and Manobo) in the province, the Provincial Government of Agusan del Sur has committed its technical and financial support to these communities and the National Commission on Indigenous Peoples (NCIP). It created a Technical Working Group and provided it with PHP 5,000,000.00 (85.000 EUR) to support the issuance of Ancestral Domain titles. Approach The TWG renders its assistance to the Provincial Delineation Team of NCIP for the validation of the claims to Ancestral Domain titles. COSERAM has been invited by the province to enhance the capacities of the TWG to ensure the conflict and culture sensitivity of the process. DEL BUTUAN PROSPERIDAD SUR TANDAG BUCAS GRANDE DEL SUR Based on lessons learnt from key organizations with experiences on ancestral domain titling, the TWG and the Provincial Delineation Team of NCIP designed the processing of the claims. Additionally, the TWG participates in the joint efforts of GIZ and the International Labour Organization (ILO) to simplify processes to elaborate development plans for the Ancestral Domains and to strengthen the participation of the IPs therein. The results of these different pilot processes will contribute to an enhancement of the national guidelines of NCIP. This includes defined interfaces with development plans of Local Government Units. Factsheet Conflict Sensitive Resource and Asset Management (COSERAM) Program Capacity Development and Constructive Dialogue on IPRA and other Rights and Regulations Affecting the Use of Natural Resources This Activity Cluster of the COSERAM program aims at strengthening the understanding and dialogue of Indigenous Peoples (IPs) and other stakeholders on IPRA, Free Prior Informed Consent (FPIC), the Mining Act and other important legal regulations affecting access to natural resources. Context Indigenous Cultural Communities in Caraga interact with a variety of stakeholders. Many of them have an interest to utilize natural resources in their ancestral domains. The required Free Prior and Informed Consent (FPIC) as a means of a participatory and conflict-sensitive planning is often not followed. In many cases, it may even be abused to the disadvantage of the IP communities, which are also often internally divided. The Indigenous Peoples Rights Act (IPRA) of 1997 and the Mining Act of 1995 are not available in native languages. Adequate information and education material on these laws and regulations does not exist. Also, awareness and understanding of these legal regulations within Local Government Units (LGUs) needs to be increased. Approach Following a human rights based approach COSERAM addresses the issue from two perspectives, considering the needs of both, the right holders and the duty bearers. On the one hand, it aims at empowering IPs in knowing and claiming their rights. It is envisaged to strengthen their negotiation capacities regarding the use of natural resources by public or private investors within their Ancestral Domain. For that purpose, COSERAM supports collection and development of documents and educative materials regarding IPRA. This entails a proper translation of relevant information into the languages of IPs and their distribution. Additionally, the access to legal and paralegal aid services for IPs shall be promoted. On the other hand, national line agencies, LGUs and the private sector will be assisted in their efforts to understand and respect the IPs rights. To this end, COSERAM assists those agencies to clarify their responsibilities to ensure a coordinated and well-managed governmental response. This includes the mandatory representation of IPs in governmental structures of LGUs. A current assessment on conducted FPICs will lead to the enhancement of the respective national guidelines and processes of the National Commission for Indigenous Peoples (NCIP). The results shall also be used as basis for constructive dialogue amongst the different stakeholders.
