The purpose of this inspection was to determine compliance with applicable licensing statutes and administrative rules for Family AND Group Day Care Homes. A. Description of Facility The living room, kitchen, den, bedroom on the main floor, three bedrooms on the second floor and the child care room in the basement are approved for child care. The bathroom for child use is located on the main floor. The basement s two fire exits are the stairway to the main floor and a direct walkout exit. The second floor has two fire exits, the stairway to the main floor and an exit window located in the master bedroom. Ms. Desira has a pet cat and dog. The living room fireplace is not used during child care hours. There is an adequate amount of play equipment available for child use. The outdoor play area behind the house is not fenced and there are no water hazards. The family child care home operates M-F from 7:00 AM to 6:00 PM. Ms. Deisra cares for children ages birth to 12 years. Ms. Desira has not completed the required CPR and First Aid training. P.O. B. Rule/Statutory Violations The violations that were found are: MCL 722.115f Added Operation of family or group day care home; conduct of criminal history check and criminal records check by department of state police; fee; arraignment of registrant or licensee for certain crimes; report required; violation; penalty; deletion of arraignment information from records; notice; criminal history check and criminal records check on current licensees and registrants. (1) Except as provided in subsection (13), when a person applies for or to renew a certificate of registration to operate a family day care home or a license to operate a group day care home under section 5, the department shall request the department of state police to perform both of the following on that person: (a) Conduct a criminal history check on the person. (b) Conduct a criminal records check through the federal bureau of investigation on the person. The required fingerprinting results have not been received. R 400.1905 Training. (1) The caregiver shall complete not less than 10 clock hours of training each year related to child development, program planning, and administrative management for a child care business, not including CPR and first aid training. Ms. Desira did not complete the required 10 hours of training. R 400.1905 Training. (6) CPR and first aid training shall be maintained in the following manner: (a) Each year for CPR. (b) Every 36 months for first aid. The caregiver and assistant caregiver did not have current CPR and First Aid training. 2

R 400.1906 Records of caregiving staff and child care home family; record maintenance. (1) The caregiver shall maintain a file for the caregiver and each assistant caregiver including all of the following: (b) A statement signed by a licensed physician or his or her designee and which attests to the individual's mental and physical health. The assistant caregiver did not have a statement signed by a physician on file at the home. R 400.1920 Outdoor play area and equipment. (5) When swings, climbers, slides, and other similar play equipment with a designated play surface above 30 inches are used, they shall: (a) Not be placed over concrete, asphalt, or a similar surface, such as hard-packed dirt or grass. The swing set was placed over grass with no protective surfacing underneath it. R 400.1932 Home maintenance and safety. (2) All dangerous and hazardous materials or items shall be stored securely and out of the reach of children. One kitchen drawer and the table drawer in the den contained nail clippers, stapler remover, razor blade and batteries that were accessible to children. R 400.1936 Animals and pets. (5) Litter boxes, pet food and dishes, and pet toys shall be inaccessible to children. The pet water and food dishes in the kitchen were accessible to children. R 400.1941 Heat-producing equipment. (3) Combustible materials and equipment shall not be stored within 4 feet of furnaces, other flame or heat-producing equipment, or fuel-fired water heaters. Wooden and padded chairs were within 4 feet of the furnace. 3

R 400.1944 Smoke detectors; fire extinguishers. (4) A home shall have at least 1 functioning multipurpose fire extinguisher, with a rating of 2A-10BC or larger, properly mounted not higher than 5 feet from the floor to the top of the fire extinguisher, on each floor level that is used by children in care. The basement fire extinguisher was mounted higher than 5 feet from the floor. R 400.1945 Fire; tornado; serious accident and injury plans. (3) Fire drills shall be practiced at least once a month and a written record that includes the date and time it takes to evacuate shall be maintained. The fire drills have not been practiced monthly. R400.1934 Heating; ventilation; lighting. (5) All basements approved for child use shall have levels of radon gases not to exceed 4 picocuries per liter of air. Documentation of the results shall be kept on file in the home.
