What can I sell? Roadside vending is only permitted for the sale of food. City of St. Petersburg Regulations for Have you ever thought about selling goods on the side of the road? This type of business activity is permitted in St. Petersburg, however, there are certain rules that apply. The purpose of this document is to provide you with answers to the most frequently asked questions. Can I sell items that I cook and package in my own kitchen? No. Only food items that are prepackaged, prepared in a restaurant kitchen approved by the State Division of Hotel and Restaurants (DHR), or prepared in a licensed mobile unit approved by the DHR can be sold under roadside vending. Open air cooking and mobile open air barbeque barrel pit cookers are strictly prohibited. If you are selling any item other than prepackaged products (soda pop in cans, small close d bags of potato chips, etc.), you must get a license from the DHR. For additional questions regarding the state licensing, you can contact the Division of Hotels and Restaurants, Florida Department of Business and Professional Regulation at 1-800-880-7753. Where can I do roadside vending? Roadside vending is only permitted on private property which is not solely used for housing. Vending is only permitted at certain intersections within the City, and only one roadside vending business is permitted on any block face within 200 of the allowed intersections. The approved intersections are: 4 th Street North with Central, 1 st, 5 th (except the northeast corner), and 9 th (except the two easterly corners) Avenues. 4 th Street South with Central, 1 st, 5 th, 18 th, and 22 nd Avenues. 9 th Street North with 1 st, 5 th, and 9 th Avenues. 9 th Street South with Central, 1 st, 5 th, 18 th, 22 nd, and 26 th Avenues. 16 th Street North with Central, 1 st and 5 th (except the northwest corner of the westerly half of the southwest corner) Avenues 16 th Street South with Central, 1 st, 5 th, 18 th, and 22 nd Avenues 22 nd Street South with 5 th, 18 th, and 22 nd Avenues 28 th Street North with Central, 1 st (except the northwest corner), and 5 th (except the two northerly and westerly corners) Avenues 28 th Street South with Central, 1 st, 5 th, 18 th, and 22 nd Avenues 34th Street South with Central (except the two easterly corners and the north corner) and 1 st (except the two easterly corners) Avenues. Once I find an intersection I like, what next? Roadside vending is allowed on private property within 200 feet of one of the approved intersections. The proposed location must be in the parking lot on the side or rear of an existing building which is not used for residential purposes. The area for the vending and equipment must not exceed 200 square feet, which is approximately the size of one parking space. No more than two parking spaces can be blocked off as a result of the roadside vending operation. Can I sell to a passing car or do customers have to stop to buy my goods? NO. Customers must pull into the parking lot to conduct business. No business is permitted to take place in the rightof-way and vehicles are not permitted to stop in the roadway to purchase goods.

Regulations for (continued) Are there design requirements for my vending equipment? The only restriction is that the roadside vending market or operation cannot exceed 200 square feet in area. If you are preparing food by the roadside, you will need approval from the Division of Hotels and Restaurants to be sure that your equipment and food meets health and safety standards. No electrical or water service can be extended to the roadside market. Are there restrictions when I can operate my roadside market? Roadside vending is permitted only during daylight hours. No vending markets or equipment are allowed to remain on the property overnight. Do I need a permit? A Market Certificate is required by the City. The certificate is issued once the location has been approved and the applicant has submitted copies of the required Division of Hotels and Restaurants license/permit and the City s occupational license. The City s occupational license can be obtained on the first floor of the Municipal Services Center on the northeast corner of Central Avenue and 4 th Street North. The fee for the occupational license is $65.00 per location plus $12.00 per employee. There are no other City fees that are required. How long is my permit good for? The market certificate must be renewed annually in person at the Municipal Services Center. If you fail to renew your permit by September 30th of each year, another vendor could secure your location. As locations are allocated on a firstcome/first-served basis, it is important to renew permits early. Questions? Approval Procedures BACKGROUND On July 2, 1998, the St. Petersburg City Council adopted an ordinance defining and permitting Roadside Vending Markets in portions of the City, with conditions. Markets may only be located on private property, not in rights of way, and may only sell food. They are allowed at or near certain specified intersections in the City s Enterprise Zone. The following procedures are to be used to review applications for these uses. DEVELOPMENT REVIEW SERVICES APPROVAL Application intake personnel will review the application form to determine if the site plan meets the requirements of the ordinance in terms of both location and design. Regarding location, there are two requirements: Acceptable locations must be both within the Enterprise Zone and within 200 feet of a listed intersection (see attached copy of the ordinance). BOTH locational criteria must be met or the use CANNOT be approved. Regarding site design, it is understood that the site plan will usually not be drawn by a design professional and will seldom be to- scale; its purpose is to demonstrate compliance with the ordinance requirements, not to substitute for an engineered, scaled site plan. Staff will typically need to review the site plan using aerial photos to determine key site features. An approval letter is required indicating approval of the property owner or tenant. A sample letter to be copied and distributed for applicant use is attached, although use of this form letter is NOT mandatory; the applicant is free to submit another type of approval letter that meets the same purpose. While the ordinance calls for the issuance of a certificate of occupancy, since no permanent structure is allowed for Markets, no certificate of occupancy can be issued. The intent of the certificate of occupancy requirement is to insure a site plan review, so the application form is designed to serve as a certificate meeting that purpose. The applicant should have the certificate available for inspection during all hours of operation to aid in enforcement. OCCUPATIONAL TAX APPROVAL Application intake personnel will review materials to determine if the following required submissions are included with the occupational tax application: Market Certificate approved by Development Review Services Property owner approval letter Business and Professional Regulation permit (cooked food sales only; Tampa Office number: 272-2200) Appropriate fee ($65.00 per site + $12.00 per employee) Applications containing the above information may be processed. Applicants who do not provide all of these required materials will be directed to the appropriate offices for assistance.
