5 Payroll Taxes & Insurance According to the IRS, any Nanny that works in the home of a family is an employee. As such, parent employers are legally liable to withhold Federal Income Tax, State Income Tax, FICA (social security), and Medicare taxes (Plus some small taxes like Disability or Workers Compensation if applicable in your state) from the Nanny s wages. These are called the Employee taxes. In addition to these taxes, the parent employers must pay additional taxes: the other half of FICA, Federal Unemployment and State Unemployment. These are called Employer Taxes. (One exception to this employee rule is a temporary Nanny who does not earn more than $ in one calendar year with one family. They do not have to have any taxes withheld, but they do have to pay them in April) There are a few ways to do Nanny payroll taxes: 1. Solo (with IRS & State forms, see below) 2. Use an accountant 3. Use Nanny Payroll software ( 4. With a Nanny Tax company that will do it all, including timely filings and reports: Breedlove & Associates ( GTM Associates ( Homework Solutions ( IF the family chooses to do the Nanny payroll taxes solo, they will need to do the following: Get Publication 926, Household Employers Tax Guide, which also includes addresses of State Unemployment Offices, and Tax Tables for FICA and Medicare in the back. Get Schedule H, Instructions for Household Employers, which includes instructions for completing the W2 and W3. Get Form SS4, Application for Employer Identification Number (EIN) Get Form I9, Employment Eligibility Form Get a W4 Form, to determine how much Federal withholding is to be deducted from wages Get a State Tax Withholding Exemption form for their state (such as VA4), using the addresses found in Publication 926. Get the new IRS booklet, Publication 15-T, which includes the newest tax tables available. There is a great deal of reporting involved in being an employer, but there are benefits for all involved: 5
6 Nannies will have a salary history, so they will be able to establish credit, apply for credit, buy cars and homes. Builds social security for retirement Nannies want to retire eventually! There are tax benefits to being an Employer. There are tax benefits to be taken for the care of children. Often Nannies will need to find Health Insurance on their own. One of the most reputable agencies that specializes in Nanny Insurance is Eisenberg Associates. You can get more information on their website at: 6
7 Nanny/Family Work Agreement (SAMPLE) Family Name: Nanny Name: Childrens Name and DOB: Work Days and Hours Monday Tuesday to to Wednesday to Thursday Friday Saturday Sunday to to to to 7
8 DUTIES: A. Primary: Primary duties of Nanny shall be to: (check all that apply) Plan age appropriate activities Prepare meals Care of the children s room Laundry for the family Laundry for the children only Maintain a daily log of children activities Other We would like the Nanny to answer the phone in the following manner: B. Secondary: Secondary duties shall include being responsible for keeping the home neat and organized. Other housekeeping duties will be: (check all that apply) Run errands for the family as needed Cook evening meal Keep kitchen area clean Vacuum and Dust every week Clean the bathrooms Other C. Other such reasonable duties as may be mutually agreed upon by both employer and nanny/employee. 8
9 SALARY: $ per week (net) to be paid on Fridays. VACATION TIME: days of paid vacation will be given to the Nanny. This vacation time can be taken after months of employment. OVERTIME: Additional childcare will be handled as follows: Per hour at a rate of $ per hour Overnights $ Weekends $ CPR/FIRST AID: CPR/First aid training needs to be completed on or before. We will/will not cover the expense of this class. BENEFITS: Family will contribute toward health insurance on a monthly basis. Other benefits: VEHICLE: We agree to the following: Nanny shall use the family car only for children. Nanny can also use the car for limited personal use. Nanny shall provide her own car and will be reimbursed for gas at a rate of $ per week. 9
10 DAILY SCHEDULE OF NANNY EMERGENCIES: Unless life-threatening conditions warrant immediate transport to a medical facility, Nanny will contact employer for instructions. If a life-threatening condition exists, the child(ren) should be transported to a medical facility, by way of ambulance if Employer is not available for instruction when or if emergency exists. EMERGENCY PHONE NUMBERS: Name of Pediatrician: Phone Number: Name & Phone Number of Emergency contact to call if cannot reach parents: ANTICIPATED NATURE OF THE RELATIONSHIP: While it is understood that it is desirable to have a written working document governing the employment, it is the family's intention that the relationship be as close as possible to incorporating and welcoming the Nanny/Employee into a warm, friendly, close, and helpful business relationship in the household, with each member thereof affording the others respect, affection, personal concern for the welfare of each, sharing the business responsibilities as previously addressed in this contract.
