1 TOWNSHIP OF CRANFORD CRANFORD, NEW JERSEY Ordinance No AN ORDINANCE TO AMEND CHAPTER 136 OF THE CODE OF THE TOWNSHIP OF CRANFORD TO AMEND THE PRINCIPALLY PERMITTED AND CONDITIONAL USES AND PARKING REGULATIONS WITHIN CERTAIN BUSINESS DISTRICTS WHEREAS, the Township of Cranford desires to promote a business-friendly environment within its business districts; and WHEREAS, the Township Committee of the Township of Cranford, New Jersey desires to reduce red tape for new businesses seeking to locate and existing businesses seeking to expand in the Township of Cranford by revising the permitted and conditional uses and the parking requirementsan within the B-1, B-2, B-3 and B-1-O zoning districts to better serve the needs of the Cranford community and encourage economic development and a strong and vital retail and commercial business district within the Township of Cranford; NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Cranford, New Jersey, as follows: Section 1. Section Section 136-1, Chapter 136, is amended as follows: Purposes, Definitions, [Section 136-1(B)(2) shall add the following definitions:] (B)(2) Auto Repair Garage: Establishments primarily engaged in the repair and servicing of automobiles. Industrial truck repair is not included in this definition. Beauty and Barber Shops: Establishments that are primarily engaged in furnishing beauty and hairdressing services including manicure, pedicure, and facial salons. Convenience Store: Establishments that sell a range of everyday items such as groceries, prepared food for off site consumption, toiletries, alcoholic and soft drinks, tobacco products, newspapers and may offer money order and wire transfer services. Grocery Stores: Stores commonly known as supermarkets, food stores, grocery stores, and delicatessens primarily engaged in the retail sale of all sorts of canned food, dry goods, fresh fruits and vegetables, and fresh meets, fish, and poultry, except that convenience stores are not included in this definition. Office Supply and Support Stores: Establishments primary engaged in supplying reproducing, shipping, and selling of miscellaneous supplies in support of office uses. Pet Stores: Establishments primarily engaged in the retail sale of pets including dogs, cats, fish, and exotic animals. Veterinarian Office: Establishments primarily engaged in the practice of veterinary medicine, dentistry, or surgery and which is staffed by a veterinarian licensed by the New Jersey Board of Veterinary Examiners. Section 2. Section Section , Chapter 136, is amended as follows: Design Standards, Specific

2 [Section (G)(3) shall be revised as follows:] (G)(3) Off Street Parking In all zones off-street parking shall be provided for all uses in accordance with the following schedule. All principal permitted uses in the B-1 zone shall not be required to provide off-street parking spaces. These are Central Business District blocks for which public parking shall be provided by the Township. [Section (G)(3)(a) shall be amended to include the following:] (a) Required number of off-street parking spaces by specific use shall be as follows: Uses Advertising Agencies Air Conditioning and Heating Service and Repair Shops Antique Stores Apparel and Accessory Stores Auto Repair Garages Banks and Financial Institutions Banks and Financial Institutions with Drive- Through Services Beauty and Barber Shops Building Supply Stores Camera and Photo Supply Stores Child Care Centers Computer Repair and Sales Convenience Stores Dance and Theatrical Studios Dwellings Educational Services Electronic and Computer Repair and Supply Stores Electronic Appliance Repair Shops Essential Services Florists Fruit and Vegetable Stores Funeral Homes Garden Supply and Hardware Stores Gasoline Service Stations Gift, Card, and Novelty Shops Grocery Stores Hobby and Game Shops Home Furnishing Stores Hotels and Motels Institutional and Public Uses Insurance Agents and Brokers Jewelry Stores Laundry and Dry Cleaning Services Luggage and Leather Goods Stores Martial Arts Instruction Museums and Art Galleries Musical Instrument Sales, Rentals, and Repair Shops New and Used Automobile Dealers Required Parking 3 for each bay, plus not less than 1 per each service vehicle None as per NJSA 40:55D-66.6 One for each three seats 1.5 per dwelling unit 1 for each 400 square feet of net floor area. 10, plus 1 for each 50 square feet of net floor area 1 for each rental unit. 1 for each three seats or 1 space per each 25 square feet of assemblage area whichever is greater. 3 for each pump island but not less than 4 total 2

One space for each veterinarian and 200 square feet of net floor area. One space for each 150 square feet of net floor area. Section 3. (no changes).... Section 4. Section , Chapter 136, is amended as follows: Section Conditional Uses. A. General (no changes) B. Specific conditions for conditional uses..... [Replace (3) Drive in uses, including banks and financial institutions in the B-2 and B-3 zones with:] (3) Banks and Financial Institutions with Drive-Through (a) Such uses shall be located a minimum distance of 200 feet from other such uses, theaters and public recreation uses and repair garages and gasoline service stations, as measured from the perimeter of the lot line. (b) Ingress to the site shall not be from the same street as egress. (c) The minimum lot area shall be 15,000 square feet, with a minimum street frontage of at least 100 feet. (d) A bypass lane shall be provided. 5

[Replace (10) Repair garages and service stations with:] (10) Auto Repair Garages (a) Such uses shall be located a minimum distance of 200 feet from other such uses, theaters and public recreation uses and drive-in uses, as measured from the perimeter of the lot line. (b) Repairs and services shall take place within a principal structure. All minor repairs and services are permitted to take place outdoors. (c) The minimum lot area shall be 15,000 square feet, with a minimum street frontage of at least 100 feet. (d) The walls of the principal structure shall be at least 25 feet from the side and rear property lines and at least 40 feet from a street right-of-way line. (e) All exit and entrance drives shall be at least 10 feet from any adjoining property line and 20 feet from the corner of an intersecting public street. (f) Any fuel or air pump and filler pipe shall be located 25 feet from any property line. (g) No sale, leasing or rental of any vehicles shall be permitted. (h) Permitted outdoor storage shall be limited to valid registered light vehicles awaiting repairs; permitted outdoor parking shall be limited to vehicles awaiting repairs, provided that those vehicles shall be parked or stored on surfaced areas, including concrete, asphalt or stone, and shall not hinder or obstruct access to dispensers, bays and other service areas and shall be in accordance with an approved site plan. No vehicle shall be kept overnight on jacks, stands or lifts. (i) Such uses that are located less than 100 feet from a residential zone, as measured from the perimeter of the lot line, shall be closed between the hours of 10:00 p.m. and 6:00 a.m. (j) No other use shall be permitted on the same lot. (k) Such uses shall not be located in any special improvement district. Such uses shall be located a minimum distance of 200 feet from other such uses, drive-in uses, auto repair garages and gasoline service stations, as measured from the perimeter of the lot line. (21) Gasoline Service Stations (a) Such uses shall be located a minimum district of 200 feet from other such uses, theaters and public recreation uses and uses providing drive-in windows, as measured from the perimeter of the lot line. (c) The minimum lot area shall be 15,000 square feet, with a minimum street frontage of not less than 100 feet on a single street.
