TERMS & CONDITIONS PERFECT 10 CAMPAIGN ( CAMPAIGN ) Introduction This Campaign is held by Celcom Mobile Sdn Bhd (Company No. 27910-A) ( Celcom ). By participating in the Campaign, the Customer (as herein defined) hereby agrees to be bound by this terms and conditions ( Terms and Conditions ), which form an integral part and to be read together with terms and conditions of Customer Registration Form (CRF) as published at https://www.celcom.com.my/legal/terms-and-conditions In the event of a conflict or inconsistency between these Terms and Conditions, and CRF, such inconsistency shall be resolved by giving precedence in the following decreasing order (i) this Terms and Conditions (ii) Terms and Conditions of CRF. In the event of any inconsistency between the English version and the Bahasa Malaysia version of these Terms and Conditions, the English version shall prevail. Duration of the Promotion This Campaign shall commence from 02/06/2020 to 31/05/2021 ( Campaign Period ). Any extension thereof shall be subject to the sole discretion of Celcom. Eligibility This Campaign shall be applicable to all new and existing Celcom s pre-paid and post-paid customers who must keep an active MSISDN (mobile number) during the Campaign Period until the prize-giving date ( Customers ). Customers are required to maintain an active Celcom's line throughout the Campaign Period. For clarity, active means Customers will be able to make and return calls. The Campaign shall not be applicable to the following persons: 1. Customers below eighteen (18) years of age 2. Corporate Customers which means the organization at which Customers are employed as reflected in the CRF. For avoidance of doubt, the Customers can participate in the Campaign using their personal mobile number ; 3. Celcom employees (including its related corporation) ( Employee ) and their immediate family members; 4. Representatives, employees and/or agents of Celcom s dealers and distributors; 5. Blacklisted Customers of Celcom or any other telecommunication service providers. Blacklisted shall mean the Customers that have outstanding bills ; and 6. All employees of Numbase Malaysia Sdn Bhd (including its related corporation) ( Employee ) and their immediate family members of the companies which cooperate with Celcom for this Campaign. For clarity, immediate family members shall be the Employee s spouse(s), and/or parents, sibling(s) and children. Promotion Mechanics 1. Customers will receive SMS notification from Celcom or in any other form as Celcom deems fit with regards to the promotion of this Campaign. 2. To participate in the Campaign, the Customers shall subscribe to the Perfect 10 game ( Perfect 10 game ) by performing the following via: a. Perfect 10 s website https://celcom-p10.com ( Platform ); or b. USSD - command *365*682#. (Herein after referred to as Subscription ) 3. Upon successful Subscription of Perfect 10 game, the Customers shall receive SMS confirmation of the Customer s Subscription from Celcom. 4. From 04/08/2020, as part of the Merdeka Sales. The new service customers will be entitled to receive free three (3) days subscription of the Service ( Free Subscription Period ). For clarity purposes, the free trial is not applicable to the existing service customers who have been subscribing to the Service.
During the Free Subscription Period, the Customer will receive an SMS reminder from Celcom notifying the Customer of the option to opt out from the Service ( Opt Out ). 5. During free trail period, on daily bases customer will receive: a. One (1) content daily including one (1) daily tips; b. One (1) game token for the Perfect 10 web game; c. Plus fifty (50) points than previous day 6. The Customer will only be charged RM 1.00 ( Daily Perfect 10 Subscription Charge ) on the fourth (4th) day of the Perfect 10 Subscription in the event that the Customer did not perform the Opt Out option. To avoid being charged with the Daily Perfect 10 Subscription Charge, Customers can Opt Out from the Campaign before the Free Subscription Period ends. 7. Upon success renewal the Customers will receive: a. One (1) content daily including one (1) daily tips; b. One (1) game token for the Perfect 10 web game; c. Plus fifty (50) points than last successful renewal. 8. For illustration purpose, once Customer upon opt-in to the Perfect 10 game, the said Customer will get fifty (50) points (day 1 of free period). On next day (day 2 of free period) the Customer will get hundred (100) points. On next day (day 3 of free period) the Customer will get hundred and fifty (150) points. Then if next day service is successfully renewed will get two hundred (200) points, on next success renewal two hundred and fifty point (250) and so on. 9. Any messages sent or received from shortcode 26888 are free of charge, except for the Daily Perfect 10 Subscription Charge. 10. If the Customer s mobile account has insufficient credit, the auto renewal shall be made available upon credit availability. For avoidance of doubt, the accumulated points collected by the Customers will remain as it is despite the insufficient credit. The Customers can resume the Perfect 10 game with the existing accumulated points once their mobile credit is available. 11. The Customers may opt out from the Subscription at any time during the Campaign Period by sending STOP or BATAL to 26888 or by dialling *365*682# via USSD and selecting the respective unsubscription option. When Customers un-subscribe of the Campaign before the end of the Campaign Period, they are no longer subscribed to the Campaign and they shall not receive any further content or game tokens. Pursuant to this clause, the Customers are no longer entitled for the Prizes offered once they have successfully un-subscribe. 12. In addition to the content, the Customers may purchase additional game tokens at the rate of RM1.00 per game via the Platform. 13. The maximum amount of on-demand game tokens that a Customer can purchase per day is forty-nine (49). On-demand purchases will be available to customer during free period at cost of RM 1.00 14. Upon successful purchase of the game token, as prescribed in Clause 8 above, the Customers shall receive: a. One (1) game token for Perfect 10 game; and b. One hundred (100) points for the Monthly Prize. 15. The Customers may play the Perfect 10 game via the Platform. 16. Based on Perfect 10 game results, the number of correct answers given, Customers are awarded with additional points, as following: Number of correct answers Points Awarded at the end of the game 0 correct answers : No points 1 correct answer : 5 points 2 correct answers : 10 points 3 correct answers : 30 points 4 correct answers: : 50 points

For Instant Prize, the Customer who has answered correctly all questions at the end of each game, automatically wins RM 2,000. 3. For Monthly Prize, at the end of each Campaign month, the Platform will automatically create a ranking list of all Customers based on total points collected. The Customer with the most points, 1st place in the ranking, will be declared as a winner of the Monthly Prize. 4. If two (2) or more Customers have the same amount of most points, winner is declared based on the Customer who collected those points first. 5. The Customers who are between the 2nd and the 11th place of the ranking, based on collected points, are declared as runner-up s, as to sequentially fill-in the winner place in case the 1st winner, for any reason, fails to receive the prize. 6. For a Customer to be eligible to add all his/her points on the monthly top-scorer ranking needs: a. Be active in Perfect 10 game. 7. Winners declaration will be published automatically by the Platform without any external or human inference. 8. Celcom shall notify the winners of their entitlement to the Prizes via phone as the final announcement of the winners. 9. Celcom reserves the right to use any other method or medium it deems fit at its sole and absolute discretion for the purpose of notifying the winners. Celcom reserves the right to forfeit the Prizes and select another Monthly Prize winner upon three (3) failed attempts to contact any of the selected winners or failure to keep an active MSISDN. 11. For Monthly Prize, each winner shall only be entitled to receive one (1) Prize per MSISDN and per identification number only. For the avoidance of doubt, each winner is entitled to win only 1 prize per category type, meaning 1 instant prize and 1 monthly prize during the Campaign Period. 12. By accepting the Prize, the Customers agreed to publish his/her full name and participation number in partially hidden form on winners section of the Platform. 13. Winners will receive their respective Prizes no later than one-hundred and twenty (120) calendar days from the day all relevant documents per clause 15 below are received by Celcom. 14. In order to receive the Prize, the winner must provide the following documents ( Documents ): a. copy of NRIC; and b. copy of personal bank account number registered under the winner s name. 15. The Documents must be sent to Celcom as scanned copies via e-mail, which will be informed through the phone call in clause 8 above, within five (5) business days from the day of first contact with winner. General Terms and Conditions 1. Celcom reserves the sole and absolute right to withdraw, amend, omit and/or vary any part or the whole of the terms and conditions of this Campaign with prior notice to the Customers. 2. Celcom s decisions in any matter in relation to the Campaign shall be final and conclusive. Any request for appeal and review shall not be entertained. 3. Celcom shall not be liable for any claim by the Customers or third-party claims or loses of any nature, including but not limited to direct damages or other damages resulting from or in connection with this Campaign. 4. Celcom disclaims any liability for loss or damage to property or any personal injury or loss of life resulting from or in connection with this Campaign. 5. The Customers acknowledges and agrees that Celcom reserves the rights to disqualify any participation if the Customers is in breach of its obligations or any terms and conditions of this Campaign. Notwithstanding the above, Celcom reserves the right to reject any participation or the Customers at its sole and absolute discretion without assigning any reasons whatsoever. 6. Celcom does not take any responsibility in the event Customers are prevented from participating in the Campaign, as a result of certain technical restrictions or other limitations or force majeure which including but not limited to regulatory and/or government directive, act of God etc.
7. All photographs, personal information and names submitted in the Campaign, service marks, trade names, trademarks are the property of Celcom. 8. Celcom reserves the right, at its absolute discretion, to use the names, photographs, voice or video recordings and entries of the Customers for publicity, advertising, trade or Campaign purposes in any media, without first obtaining any consent nor making any payment whatsoever to the Customers. 9. Except as expressly mentioned herein, Celcom shall not be responsible for any expenses and cost including out-of-pocket expenses related to or as a consequence of participating in this Campaign. 10. The content for the Campaign is provided by a third party. Celcom does not filter or edit such content. The Customers acknowledges that Celcom is under no obligation to censor the content or information provided. Celcom disclaims all liability in relation to the content provided. 11. In the event any of the provision in these terms and conditions is invalid, illegal and unenforceable under any applicable law or by any reasons whatsoever, the legality and enforceability of the remaining provisions shall not be affected. 12. No delay or indulgence by Celcom in enforcing any terms or conditions herein shall constitute waiver by Celcom of the Customer s breach of these terms and conditions. 13. In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Terms and Conditions, the English version shall prevail.
