2. REQUIREMENTS FOR EXPERIENCE AND QUALIFICATIONS I. Education & Experience: Master s degree in Political Science, Sociology or any other relevant field. Bachelor Degree in Law with relevant electoral experience is also considered. At least seven years of experience in election management or democratic governance II. Language Requirement: Have excellent presentation and communication skills in both Nepali and English. Prior working experience with the Election Commission in drafting of election code of conduct and other electoral laws 3. DOCUMENTS TO BE INCLUDED WHEN SUBMITTING THE PROPOSAL Interested individual consultants must submit the following documents/information to demonstrate their qualifications: Offeror s Letter to UNDP Confirming Interest and Availability for the Individual or (IC) Assignment along with the completed financial proposal and P11 template annexed to this letter. Financial proposal indicating daily rate. DSA and travel cost will be borne by UNDP for field missions, if any. A cover letter with a brief presentation of your consultancy explaining your suitability for the work; A brief methodology on how you will approach and conduct the work (limit to under 1500 words); Note: a. Applicants of 62 years or more require full medical examination and statement of fitness to work to engage in the consultancy b. EVALUATION Individual consultants will be evaluated based on the following methodologies: Cumulative analysis When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as: a) responsive/compliant/acceptable, and b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation. * Technical Criteria weight; 70% * Financial Criteria weight; 30% Only candidates obtaining a minimum of 49 points in the technical evaluation would be considered for the Financial Evaluation. II. Background Information The Electoral Support Project (ESP) is a technical assistance initiative, commencing upon the completion of the CA elections in 2008 and covering support to upcoming set of elections after the promulgation of the new constitution. Without the immediate political and operational pressure for the ECN to deliver a specific electoral event and following the electoral cycle approach, the support provided by the Project in the interelections period (2008-2011) has had a strong emphasis on building a sustainable and enduring institutional and professional capacity within the ECN that could be easily and effectively re-employed in future elections. Through the provision of on-site technical advisory service and specialized electoral support, the Project has sought to enhance and
further consolidate the institutional and professional capacities of the ECN, its Secretariat and the its subsidiary district offices to meet the numerous priorities that need to be addressed to further enhance the credibility and the adequacy of Nepal s future electoral processes. The current objective of the Electoral Support Project is to continue strengthen the professional capacities and institutional organization of the ECN at central and regional levels, after the successful conduct of the 2013 CA elections. ECN, with support of ESP, enacted a Election Code of Conduct based on wider consultation with key electoral stakeholders across the country. The Code of Conduct is already published in Nepal s Gazette on 11 Sharawan 2072. Election Commission has constituted a high-level Election Code of Conduct Drafting Committee meeting under convenorship of Election Commissioner and a Sub-Committee led by the the Commission s Joint Secretary to initiate drafting of the model code of conduct in line with the international best practices and the lessons learnt from the past elections and recent CA Election held in Nov, 2013. ECN has organized a series of consultation programme across the country to disseminate and collect the electoral stakeholders feedback. ESP has provided necessary technical and logistical arrangements including deployment of a National Consultant in drafting, nation-wide consultation and finalization of the Election Code of Conduct. ESP continues to provide support to ECN in publication, wider dissemination and effective implementation of the code of conduct. ECN, with continued support of ESP, further intends to develop a monitoring mechanism to ensure effective implementation of Election Code of Conduct 2015. III. Objectives of Assignment The objective of the assignment is to support ECN in development of a monitoring mechanism to ensure effective implementation of Election Code of Conduct 2015. The consult is required to submit a report to the Election Commission outlining provision of monitoring mechanism with its role, responsibilities, power and as well as recommendations for compliance by the concerned stakeholders towards a free, fair, impartial, transparent and reliable manner. Scope of work and Deliverables Scope of work The consultant is required to work under direction of ESP and Legal Division of the ECN and perform following tasks: Support ECN in development of a monitoring mechanism to ensure effective implementation of Election Code of Conduct 2015 Drafting of a monitoring mechanism for effective implementation of Election Code of Conduct based on lessons learnt of last two CA Elections (2008 and 2013), international best practices and comparative study of SAARC regions with regard to monitoring of election code of conduct Submit a report to the Election Commission outlining provision of monitoring mechanism with its role, responsibilities, power and as well as recommendations
for compliance by the concerned stakeholders towards a free, fair, impartial, transparent and reliable manner Any other support request by the Election Commission/ESP during course of the assignment in the field of Election Code of Conduct implementation and dissemination. Final Delivery Submission of report on monitoring mechanism of Election Code of Conduct 2015 to the Election Commission, Nepal V.
