CITY OF MONTRÉAL BY-LAW 94-036 BY-LAW AUTHORIZING THE CONSTRUCTION, ALTERATION AND OCCUPANCY OF IMMOVABLES ON A SITE WITHIN THE CITÉ INTERNATIONALE BOUNDED BY VIGER AVENUE, UNIVERSITY AND SAINT- ANTOINE STREETS AND SQUARE VICTORIA, FOR COMMERCIAL AND OFFICE PURPOSES, AND INCLUDING, IN PARTICULAR, THE HEADQUARTERS OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION (ICAO) At the Montréal city council meeting of June 20, 1994, it was ordained: SECTION I TERRITORY 1. This by-law applies to the site bounded by Saint-Antoine and University streets, Viger Avenue and the proposed extension of Beaver Hall Hill, having an area of about 16 140 m², as shown on Plan 1 entitled "Territoire d'application - (approx. area 16 140 m 2 )", prepared by Ken London, architects - Provencher Roy, architects, stamped by the Service de l'habitation et du développement urbain on March 31, 1994, and attached to Schedule A. SECTION II INTERPRETATIVE PROVISIONS 2. In this by-law, the following expressions mean: "landing stage": stop area for motor vehicles escorting users of and visitors to the building governed by the security standards of the International Civil Aviation Organization, hereinafter referred to as ICAO; "service equipment": electrical devices and conduits used for plumbing, heating and air conditioning purposes; "plan of Cité internationale": document of the Service de l'habitation et du développement urbain dated September 1991, and approved by the executive committee (CE 9100355) on October 9, 1991. SECTION III AUTHORIZATION 3. Despite urban planning by-laws that apply to the site referred to in article 1, the construction, alteration and occupancy for commercial and office purposes are also authorized under the conditions specified in this by-law. A departure from articles 51, 481 and 494 and from the building lines plan attached as Schedule H to the By-law concerning the urban planning of Ville-Marie district (9534) is authorized for that purpose. All other by-law provisions consistent with those specified in this by-law continue to apply. SECTION IV LAND COVERAGE 94-036 / 1

4. The land coverage of buildings must conform to Plan 2 entitled "Implantation et phases de développement", prepared by Ken London, architects - Provencher, Roy, architects, stamped by the Service de l'habitation et du développement urbain on March 31, 1994, and attached to Schedule B. SECTION V DENSITY 5. The maximum floor area index of the site referred to in article 1 is 8. SECTION VI DEVELOPMENT PHASES 6. The completion of Phase 1 on Plan 2 of Schedule B must include the following developments, in accordance with Plan 3 of that schedule: (1) the development of a landing stage and a landscaped area, both temporary, on the present parking lot; (2) the enhancement of the architectural features of the existing building identified as "control and ventilation", as well as the parking adjacent to it, in accordance with the criteria specified in section IX; (3) the redevelopment of the space between Viger Avenue and the existing building identified as "control and ventilation" and the maneuver area between that building and the building to be erected at the intersection of Viger Avenue and University Street, marked on the plans of Schedule B; (4) the completion of part of the sheltered and glassed pedestrian link referred to in article 16, between the two buildings to be erected on University Street; (5) the development of an interior underground parking area of 80 units accessible from Saint-Antoine Street; (6) the redevelopment of the existing parking area next to the existing building identified as "control and ventilation", in order to increase the number of units to no more than 72. For the purposes of paragraph 1 of the first paragraph, the word "temporary" means up to the completion of Phase 2 specified on Plan 4 of Schedule B. SECTION VII VOLUMETRY, ACCESS AND EXTERIOR DEVELOPMENT 7. The volumetry of buildings, the exterior developments and accesses to parking units, loading units and the landing stage must be in accordance with Plan 3 entitled "Phase I. Volumétrie, accès et aménagement extérieur", prepared by Ken London, architects - Provencher Roy, architects, stamped by the Service de l'habitation et du développement urbain on March 31, 1994 and attached to Schedule B. 8. The maximum overall height of the parts of construction provided for in Phase 1 must conform to the heights in metres and in storeys specified on Plan 3 of Schedule B. 9. The heights in metres specified on Plan 3 as well as on Plan 4, entitled "Phase II. Hauteurs maximums et minimums", prepared by Ken London, architects - Provencher Roy, architects, stamped by the Service de l'habitation et du développement urbain on March 31, 1994, and attached to Schedule B, are calculated from 94-036 / 2

the geodesic level at the southwest end of the site referred to in article 1 and shown on those plans. 10. The difference between the height in metres of the highest part of a construction for which a number of storeys is also specified and the parts of a construction where no number of storeys appears, corresponds to the height of service equipment and other roof-top enclosures, except for part (L), which corresponds to the atrium, as shown on Plan 3 of Schedule B. 11. Access to the upper level of the parking area referred to in paragraph 6 of article 6 must be from Viger Avenue, as shown on Plan 3 of Schedule B. Access to the lower level of that parking area must be from the maneuver area referred to in article 12. 12. The building to be erected at the intersection of Viger Avenue and University Street must include 5 loading units accessible from the common truck maneuver area, which must be accessible from Viger Avenue, as shown on Plan 3 of Schedule B. 13. The development of the landing stage area must conform to Plan 3 of Schedule B. 14. The height of constructions provided for in Phase 2 must conform to the minimums and maximums in metres and in storeys of the height sectors shown on Plan 4 of Schedule B. 15. The building to be erected at the intersection of Viger Avenue and the street bordering on the east end of the site referred to in article 1 must include a small loading unit. 16. The building to be erected at the intersection of Saint-Antoine Street and the street bordering on the east end of the site referred to in article 1 must include one small and 2 large loading units. 17. For the purposes of articles 15 and 16: (1) a small loading unit must have: (a) a minimum width of 2.7 m; (b) a minimum length of 6.1 m; (c) a minimum clearance of 2.6 m; (2) a large loading unit must have: (a) a minimum width of 3.5 m; (b) a minimum length of 9.1 m; (c) a minimum clearance of 4.3 m. 18. The accesses to parking areas and loading docks of constructions in Phase II must be developed and located so as to ensure that vehicles enter and exit in forward drive. SECTION VIII PEDESTRIAN TRAFFIC 19. A sheltered and glassed pedestrian link must cross the site from east to west according to the location and height specified on plans 3 and 4 of Schedule B. 94-036 / 3

20. Any underground link between a building authorized under this by-law and the Square Victoria metro station must be covered by a servitude granted at no charge to the city of Montréal, for a width of 6 m. SECTION IX LAYOUT, ARCHITECTURAL AND DESIGN CRITERIA 21. For the purposes of the issue of a building permit relating to buildings authorized under this by-law, as well as the criteria specified in article 29 of the By-law concerning the procedure for the approval of construction, alteration and occupancy projects, and concerning the Commission Jacques-Viger (R.B.C.M., chapter P-7), the following criteria apply: (1) all construction or development work must take into account that the street bordering on the east end of the site referred to in article 1, Viger Avenue and Saint-Antoine Street constitute the major elements of the sector and that their development must conform to the massive character of the area, and be in accordance with the orientations of the plan of Cité internationale; (2) along Viger Avenue and Saint-Antoine Street: (a) any new construction must contribute to the restructuring of those major thoroughfares, and in particular by the treatment of ground floors, create an urban and human environment; (b) the work relating to the existing building referred to in paragraph 2 of article 6 must contribute to the improvement of pedestrian comfort, in particular by reducing the effect of blind walls; (c) the development of the landing stage and landscaped area referred to in paragraph 1 of article 6 must make it possible to determine the identity of occupants and must impart an air of prestige to the area, consistent, however, with the temporary nature of the landing stage which can only be developed at the end of Phase II; (d) the distance between the access to a loading unit and the intersection of two public thoroughfares, measured from the end of the curve of the street or sidewalk, must tend to reach 25 m; (e) the development of the constructions provided for in Phase II must tend to minimize the number of accesses to parking or loading units; (f) the accesses to parking or loading units must be located and developed so as to create favorable conditions for pedestrian traffic; (3) along the street bordering on the eastern end of the site: (a) SECTION X TIME LIMIT the architecture of new buildings must be inspired by the architectural features of existing buildings with a view to homogeneity and coherence between new and existing façades, and must tend to conform to the proportions on the sketch attached as Schedule C. 22. The construction work must begin within 120 months of the coming into force of this by-law. If that time limit is not observed, the authorization under this by-law is null and void.
