GENERAL INSTRUCTIONS FOR COMPLIANCE The tender documents should be submitted in two envelopes duly sealed and clearly mentioning Part 1 (Pre-qualification) and Part 2 (Financial Bid). On behalf of the President of India, sealed tenders are invited under Two Bid System, i.e., Technical Bid and Financial Bid from reputed, experienced company/companies for providing 'Security Services' at MEA Housing Complex, Room No.C-01, Plot No.1, Sector-2, Dwarka, New Delhi-110075. SCOPE OF WORK The scope of work, terms and conditions would be as follows: The service provider shall deploy nine security guards for round the clock security. Three guard will be deployed in uniforms in each shift of 8 hours The security personnel shall be responsible for the security and safety of the buildings, boundaries, materials, furniture, fixtures, sanitary, electrical and other equipments and also the residents of the premises on round the clock basis. The security personnel will control the access of persons/vehicles into and out of the complex. They will be required to maintain proper record of persons other than bonafied residents, complex personnel moving into and out of the housing complex premises. The service provider will be liable to comply with the relevant local Government's Statutory regulation and labour laws in so far as employing human resources and payment of taxes etc. are concerned and Ministry's liability will be restricted to the agreed contractual payment. The service provider shall ensure that only such security personnel whose antecedents have been verified by the police and/or their concerned agencies, are deployed. It will be the responsibility of service provider to provide operational tools i.e. Batons etc.

ELIGIBILITY CRITERIA Legally valid Entity (1) The Bidder shall necessarily be a legally valid entity in the form of a Limited Company or a Private Limited company registered under the Companies Act, 1956 or Individual/Partnership firm with appropriate authorities for the purpose. Bidding in the form of JV/Consortium is not permitted. (2) The said service provider must be in existence for a minimum period of 5 years as on 31.03.2016 from the date of registration under Shops and Establishments Act/Companies Act 1956/ Appropriate Act. The bidder will provide proof of the date of incorporation/registration. [A certified copy of the date of incorporation/registration is to be attached]. (3) Minimum 03 years experience in providing Security Services as on 31/03/2016. Experience of the bidder must include providing of security services to large and modern Government offices / PSUs/Big Private Organisation or Residential complexes of GoI / PSUs/Big Private Organisation, as defined in 'brief scope of work'. (4) The bidder should have an Average Annual Financial Turnover of Rs.100.00 lakh (One Crore) annually during the past three financial years. The bidder may attach attested copies of annual total turnover for the last three financial years along with copies of audited financial statement for the last three years. The bidder must have solvency of Rs. 2.00 lakh duly certified by the Nationalized Bank. (5) The bidder must have satisfactory arrangements for training of its workers. Confirmation in this regard is to be given. The bidder should have an office in New Delhi or NCR of Delhi. (6) There should be no case pending with the police against the Proprietor/ Company/Partner or the Company (Agency). (7) The bidder should be ready to give performance guarantee of 10% of annual contract amount. (8) The employees of the bidder deployed at MEA Housing Complex-Dwarka should have bank accounts and the company should be ready to provide proof of payment of salary to each employee. The bidder will have to ensure compliance with all mandatory labour laws/regulations laid down by Government of NCT of Delhi. This will include payment of minimum wages, EPF/ESI (Employees' State Insurance). Providing other benefits like bonus, leave, Labour Welfare Fund, cost of uniform etc. to bidder's each employee will solely be the liability of the bidder only.
(9) The bidder must have appropriate licenses from Service/Sales Tax Department, Income Tax Department [TIN/TAN/PAN] and Private Security Agency Regulation Act [PSARA]. The bidder must possess all the licenses in their own name including license under Private Security Agency Regulation Act 2005 [PSARA]. The bidder must also provide also the proof of registration, with copies of PF/ESI challans, along with the list of staff with their individual PF/ESI numbers at the time of submitting their monthly invoices. Bidder should also have conducted the police verification of their staff deployed at the Housing Complex of Ministry of External Affairs. Copies of all relevant registrations document are to be submitted with the pre-qualification bid. security guards at a time. TERMS AND CONDITIONS The Service Provider will provide security services round the clock with 03 Shift Time Time Security Guard First Shift 0600 hrs to 1400 hrs 3 Nos. Second Shift 1400 hrs to 2200 hrs 3 Nos. Third Shift 2200 hrs to 0600 hrs 3 Nos Note: (i) Estimated number of Guards is subject to reasonable change at the discretion of the competent authority in the Ministry. (ii) However, the above number and arrangement of deployment of the Security personnel is without prejudice to the right of the complex to deploy the security personnel in any other number or manner considered to more suitable in the interest of the complex. 2. The agency shall ensure deployment of suitable Security Personnel employed on long term basis from proper background after getting their antecedents, character and conduct verified from local/state Police Authorities and withdraw such employees, not found suitable by the office for any reasons immediately on receipt of such request. 3. The full particulars of the personnel to be deployed by the agency including their names addresses, details of Bank Accounts in which their monthly salary transferred by companies, ESI, EPF details etc shall be furnished to authority of HCD along with testimonials before they are actually deployed for the job. 4. The persons deployed shall not claim Master & Servant relationship against this office. The workers would not have any claim for regularization of their services at a later stage or enhancement of wages with the Ministry of External Affairs, except the increase in minimum wages subject to notification issued by Govt./Govt of NCT from time to time, which shall be absorbed by MEA. Sworn affidavits from the workers to this effect are to be submitted. The agency shall ensure proper conduct of its personnel deployed in the premises and enforce prohibition of consumption of alcoholic drinks, paan, smoking and abusive language & action etc.
5. The agency shall deploy security guards trained in all facets of security work, including fire fighting. The Agency shall provide necessary undertaking and documentary evidence of training of guards from recognized security training institutes in this regard. 6. A senior level representative of the Agency shall visit housing complex premises at least once a-week and review the service performance of its personnel. During the weekly visit, Agency's representative will also meet the authority of HCD for mutual feedback regarding the work performed by its personnel and removal of deficiencies, if any, observed in their working. 7. The Agency shall ensure that any replacement of the personnel, as required by the authority of HCD for any reason specified or otherwise, shall be effected promptly without any additional cost. If the agency wishes to replace any of the personnel, the same shall be done with prior concurrence of the authority of HCD at Agency's own cost. 8. The agency shall provide reasonably good uniform with name, badges to its personnel deployed at Housing Complex at its own cost and ensure that they are used by the personnel deployed and are maintained in good condition. The incidentals, such as, belts, shoes, socks, caps, torch with cell, cane stick, etc., shall be borne /supplied by the Agency at its cost. The transportation, food and other statutory requirements in respect of each personnel of agency will be the responsibility of the service provider/agency. 9. The agency shall ensure that the personnel deployed by it are disciplined and do not participate in any activity prejudicial to interest of the Housing Complex/Govt. Of India/any State or any Union Territory. They shall not divulge or disclose to any person, any details of office, operation process, technical know-how, security arrangement/administrative/organizational matters as all are of Confidential/Secret in nature. 10. Proposals for efficient functioning of the security systems shall be discussed/considered and implemented from time to time by the agency with approval of authority of HCD. 11. The agency shall be solely responsible for compliance to the provisions of various labour and industrial laws, such as, wages, allowances, compensations, EPF, Bonus, Gratuity, ESI etc., relating to personnel deployed by it at Housing Complex or for any accident caused to them, the Ministry shall not be liable to bear any expenses in this regard. The Agency shall also be responsible for the insurance of its personnel. The security agency shall specifically ensure compliance of various Laws/Acts, including but not limited to with the
following and their re-enactments/amendments/modifications and will be required to submit documentary proof to ensure compliance on regular basis: I. The payment of wages Act 1936 II. The employees Provident Fund Act, 1952 III. The Factory Act, 1948 IV. The contract Labour (Regulation) Act, 1970 V. The payment of Bonus Act, 1965 VI. The Payment of Gratuity Act, 1972 VII. The Employees State Insurance Act, 1948 VIII. The Employment of Children Act, 1938 IX. The Motor Vehicle Act, 1988 X. Minimum Wages Act, 1948 12. In case of any theft or pilferages, loss or other offences, the agency will investigate and submit a report to authority of HCD and maintain liaison with the Police whenever required. 13. In case of any loss that might be caused to the Housing Complex due to lapse on the part of the security personnel discharging security responsibilities will be borne by the Agency and in this connection, the authority of HCD shall have the right to deduct appropriate amount from the bill of contracting agency to make good such loss to the Housing Complex besides imposition of penalty. In case of frequent lapses on the part of the security personnel deployed by the agency/company, Ministry shall be within its right to terminate the contract forthwith or take any other action without assigning any reason whatsoever. 14. In the event of any security personnel being on leave/absent, the agency shall ensure suitable alternative arrangement to make up for such absence. To meet such eventualities the agency shall make provision for leave reserve. 15. As and when the Housing Complex requires additional security strength on temporary or emergent basis, the agency will depute such security personnel under the same terms and conditions. For the same, a notice of two days will be given by the authority of HCD. Similarly, if the security personnel deployed by the agency any time are found absent from duty or sleeping or found engaged in irregular activities, authority of HCD shall deduct the requisite amount at the pro-rata rates from the bill of the agency besides imposition of penalty for nonobservance of the terms of contract.
16. The agency shall arrange to maintain at the security desk/booth, the daily shift-wise attendance record of the security personnel deployed by it showing their arrival and departure time. The Agency shall submit to the authority of HCD an attested photocopy of the attendance record and enclose the same with the monthly bill. 17. The ministry shall pay the agreed amount on the basis of monthly bills submitted by the Agency. No other charges of any kind shall be payable. 18. There would be no increase in rates payable to the Agency during the Contract period except reimbursement of the statutory wages revised by the Government, from time to time such as Minimum Wages Act, Service Tax & other taxes, if any, levied by Govt./Govt. of NCT. 19. The income-tax as applicable shall be deducted from the bill unless exempted by the Income-Tax Department. 20. The Security personnel deployed by the Agency shall be 10 th class pass. 21. The Agency shall be solely liable for all payment/dues of the workers employed and deployed by it. The Agency shall fully indemnify the Ministry against all the payments, claims, and liabilities what-so-ever incidental or directly arising out of or for compliance with or enforcement of the provisions of any of the labour or other laws to the extent they are applicable to establishment/work in the Housing Complex premises/facility. 22. The decision of the Ministry in regard to interpretation of the Terms & Conditions of the Agreement shall be final and binding on the Agency/company. 23. Any violation of instructions/contract conditions or suppression of facts will attract cancellation of contract without any reference. Note: These terms and conditions are part of the Contract/Agreement as indicated in between the Ministry and the Agency and any non-compliance shall be deemed as breach of the Contract/Agreement. No provision for submission of late bids Bidders are advised in their own interest to ensure that the Tender document reaches the specified office well before the closing date and time of the bid submission. Any bid received after the dead line for submission shall be rejected and returned unopened. Modification and withdrawals No documents may be modified after submission. In case of any changes the bidder may write the corrections and send the same and it is at the discretion of the tender inviting authority to accept the same or reject it, and no changes shall be accepted once the bids are opened. In the case of withdrawal, the bidder will lose his Earnest Money Deposit and will be blacklisted. Bid Security/Earnest Money Deposit All prospective bidders are required to submit an Earnest Money deposit for an amount equal to Rs.1,00,000.00 (Rupees One Lakh only), valid for at-least 3 months along with the tender.
This EMD shall be in the form of a Demand Draft/Banker s Cheque payable at NEW DELHI and drawn in favour of Pay & Accounts officer, Ministry of External Affairs, New Delhi from any nationalized bank. Tenders, which are not accompanied by the Earnest Money Deposit and tender fee (in case of download) are liable for rejection. The Earnest Money of the unsuccessful bidders will be returned within 30 days after the expiration of the period of bid validity. The Earnest money will be forfeited on account of one or more of the following reasons: The bidder withdraws his bid during the period of bid validity. In case of a successful bidder, the selected bidder fails to sign the agreement in time and furnish performance guarantee. The successful bidder would be required to sign the agreement and furnish the Performance/Service guarantee. The EMD of the successful bidder may be adjusted in the Service Guarantee by depositing the difference in amount of Service Guarantee or alternatively EMD could be refunded by taking a fresh Security Deposit/Service Guarantee. Any wrong information furnished in the tender document will also liable to forfeit of EMD. Validation of contract The contract shall be valid initially for one year after the issue of letter of intent, but extendable up to a maximum of three years subject to satisfactory performance on the same terms and conditions. If the performance is found to be satisfactory on completion of one year, the contract period will be extended by another year. Similarly, if the performance is found to be satisfactory even on completion of two years, the contract period will be extended to the third year. However, Ministry will have the right to review or cancel contract at any stage of execution with 60 days of advance notice. Performance/Service Guarantee This amount has to be submitted before the commencement order is given and within 10 days of signing the final agreement with the successful bidder and it shall remain valid during the tenure of contract period. The value of the service guarantee will be an amount equal to 10% of annual invoice value by the successful bidder. This Service guarantee deposit money shall be refunded within 60 days after the expiry of contract provided there is no breach of contract during the period of the contract. No interest shall be paid on the Service guarantee.
Forfeiture of Performance/Service Guarantee The guarantee amount in full or part may be forfeited in the following cases:- When the terms & conditions of the contract are breached. When the Service Provider fails to comply with minimum service levels agreed upon. Failure of the Service Provider to comply with statutory requirements shall constitute sufficient grounds for the annulment of the award and forfeiture of the Service Guarantee. Notice of reasonable time will be given in case of forfeiture of security deposit. Release of Performance/Service Guarantee The Performance/Service guarantee will be returned after successful completion of contract period provided there is no claim for liquidated damages from MEA side.

Taxes and Duties The bidder must include in their bids all duties, royalties and sales/service taxes or any other taxes as applicable. The tender inviting authority will entertain no extra claim on this account at any stage of execution of work.
