QUALIFICATIONS All qualifications will be verified by ENOC Energy Team. Applicants will be notified if you are not eligible for this program. Funding is limited. The property must be owner occupied. Priority will be given to families who earn 80% or less of the average median income (see chart for guidelines). Also, special consideration will be given for new homeowner s that will sign up for Viridian Energy upon award. For homeowners above the 80% of median income a 10% fee applies towards your energy audit and improvements. GRANT AGREEMENT This agreement is dated, between the Eagle s Nest Outreach Center, a non-profit organization and the undersigned Homeowner ( Owner ). Eagle s Nest Outreach Center is the recipient of grant funds from the Maryland Energy Administration s EmPOWER Clean Energy Communities Low-to-Moderate Income Grant Program. These funds are to be used for an energy audit for homeowners and performance measures based on the results of the audit. Priority will be given to families who earn 80% or less of the average median income. The energy saving improvements to be installed for owners will be any eligible activities that are a direct result from an energy audit. In consideration of the Eagle s Nest Outreach Center s agreement to apply the Energy grant funding and the installation of the improvements above, Owner agrees to the following: Owner shall use the Eagle s Nest Outreach Center selected contractors as the Contractor to install improvements and shall execute documents as necessary to document the hiring of the contractor and the installation of the improvements. Owner shall receive in Owner s name any and all warranties related to the installation of the improvements. The Eagle s Nest Outreach Center shall process any contractor payments and assure that the work is performed according to the contract. 7
GRANT AGREEMENT The Eagle s Nest Outreach Center shall process any contractor payments and assure that the work is performed according to the contract. Owner agrees that once the improvements are installed in the home that they shall become permanent fixtures attached to the real estate. If Owner sells the home within one year of installation, the homeowner will make a 50% donation of the award received back to the Eagle s Nest Outreach Center. The Eagles Nest Outreach Center shall use the proceeds from any rebate, tax credit or other benefits for the purpose of replenishing funds for staff and expanding the Energy program for additional homeowners. Owner hereby waives any and all claims, which Owner may have against the Eagle s Nest Outreach Center, arising out of, or in connection with, the installation, maintenance or existence of the above-described improvements to the property. Owner covenants and agrees not to sue the Eagle s Nest Outreach Center or consultants. In Witness, the parties hereto have executed this document. HOLD HARMLESS AGREEMENT AND RIGHT OF ENTRY I/We, take complete responsibility for the energy performing measures performed at my address and hereby hold the Eagle s Nest Outreach Center and its officers, agents, consultants and staff harmless from and against any loss, liability, claim, or damage that may arise or result from the activities of weatherization, energy audit and. I/We shall at my own cost, expense and risk defend any legal proceedings that may be brought against the Eagle s Nest Outreach Center, its officers, consultants, or staff for any liability claims or demand and or satisfy and judgment that may be rendered against any of them arising or resulting from energy performance measures. MARKETING DISCLAIMER I/We further understand the right of entry when necessary will be allowed to the Eagle s Nest Outreach Center personnel in order to take before and after photographs, inspect any ongoing or completed work as part of the Eagle s Nest Outreach Center s Energy program. Photographs will be used in newsletters, website or any marketing materials for the Eagle s Nest Outreach Center or consultant to illustrate future marketing as it relates to our Healthy Living focus. I will also promote the program by allowing any marketing signs to be on my lawn during the installation duration and an after marketing signage to be displayed. FREQUENTLY ASKED QUESTIONS Why is it necessary to have a energy audit for my home? An energy audit is the blue-print for your home for energy efficiency. It spells out your entire home and the steps necessary to make it more energy efficient. ENOC is going to conduct pre energy audits. This will assess the energy consumption for your home. We feel it is important to see the improvements after your energy improvements are made to your home. Why is it necessary to supply one year record of my BGE bills? With one year of your energy records from BGE we are able to measure your usage after all of the energy measures are applied and any energy star appliances are installed. This is good also for you to see the savings after these performance measures are applied. What happens when the funding is depleted? We will take applications to begin a waitwaiting list for the next funding award. If you meet all of the qualifications then you will be placed on the waiting list. If my family makes above the income restrictions should I still apply? Yes, we have set a priority for the incomes below 80 % of median income. However, a 10% fee will be assessed for energy audit and any applicable appliances for homeowners above 80% median income. Due to restricted funding we will be awarding a limited number of awards above the income requirements. 11
