3 Assistance Option! HOW DOES IT WORK? If you do not want the hassle of writing the contract and handling all the details of getting to closing day, then all you have to do is: The Seller(s) & Purchaser(s) will Sign the By Owner Closing Assistance (BOCA) Option Agreement & Disclosure of Independent Contractor Status as well as complete the Closing Instructions. The Seller(s) and Purchaser(s) will provide FSBO Services with the necessary information for contract preparation by faxing or ing the BOCA packet to FSBO Services, 2714 Virginia Beach Blvd., Virginia Beach, VA or FAX (757) Upon receipt of the BOCA packet, FSBO Services will arrange a meeting for the purchase agreement/contract to be completed and signed at a designated location. 4 BY OWNER CLOSING ASSISTANCE OPTION AGREEMENT DISCLOSURE of INDEPENDENT CONTRACTOR STATUS THE BELOW SIGNED Seller and Buyer hereby acknowledge disclosure that For Sale By Owner Services will serve in the capacity of INDEPENDENT CONTRACTOR, NOT AS AGENT, in connection with any Purchase Agreement between Seller and Buyer for purchase by Buyer from Seller of real property commonly known as, Virginia. Seller or Buyer or Seller & Buyer hereby agrees to pay the amount of Four Hundred & Seventy Five Dollars ($475.00) to For Sale By Owner Services as payment in full for SERVICES RENDERED as set forth herein below in connection with the above cited Purchase Agreement. SERVICES to be RENDERED The Sales Price and other Terms, Conditions and Considerations having been earlier agreed upon by and between Seller and Buyer, said SERVICES RENDERED by Contractor shall consist of some or all, as determined by Contractor of the following services: 1. To coordinate with Preferred Settlement Attorney the construction and writing of the herein described Purchase Agreement and other documents necessary to bring about the consummation of the above described sale. 2. To assist Seller and Buyer in meeting the requirements of the Purchase Agreement as to inspections, reports, and other such items as may be made a part of the Purchase Agreement. 3. To assist in handling possible complications, problems or concerns that may arise during the closing process. 4. To assist in meeting the requirements of the Settlement Attorney in connection with the closing on behalf of Seller and Buyer. It is understood that For Sale By Owner Services does not attend the actual closing. The Preferred Settlement Attorney will attend and conduct settlement. It is agreed that Contractor shall be paid its fee above at closing and hereby instructs the closing agent to collect said fee on behalf of the Contractor at Closing or Settlement. A $300 Penalty is charged in addition to the ($475 Advertiser or $675 Non-Advertiser fee) if either Party negates this agreement, and decides to use another service. The fee will be immediately due and payable. Parties will be responsible for actual expenses incurred in processing of the transaction (e.g. title abstract, survey). Unless extended in writing through mutual agreement by the parties hereto, this AGREEMENT shall terminate as of 12:01 a.m. on the day of, 200.
