The relevant facts are: CATSA is licensed by the CNSC (licence number 134-2-14.4) to store electron capture detection units (hereinafter, devices ); which are radiation devices that contain a quantity of a nuclear substance that requires a licence under the Nuclear Safety and Control Act and its regulations. The specific locations where CATSA is permitted to store these devices are listed on the CNSC licence. On or about March 27, 214, CATSA purchased 239 of these devices (specifically, IonScan 5DT model units) from a CNSC licensed supplier. E-Docs# 448489 Page 1 of/de 6

On or about March 27, 214, CATSA arranged for the 239 devices to be stored at a location in Mississauga, Ontario. This location was not listed as one of the permitted storage locations on the CNSC licence issued to CATSA. Between March 27 and April 22, 214, CATSA stored 17 of these devices at a location in Vancouver, BC. This location was not listed as one of the permitted storage locations on the CNSC licence issued to CATSA. Between March 27 and April 22, 214, CATSA stored 32 of these devices at a location in Halifax, NS. This location was not listed as one of the permitted storage locations on the CNSC licence issued to CATSA. CATSA did not notify the CNSC of the above storage activities until the CNSC notified CATSA of the potential non-compliance on or about April 22, 214 CATSA confirmed on April 24, 214 that the location in Mississauga, Ontario was not under CATSA s care and control and that CATSA was aware that the location was not listed on the CNSC licence issued to CATSA. On April 24, CATSA acknowledged that neither the Vancouver, BC nor the Halifax, NS locations were listed on their CNSC licence at the time of the storage of devices at those locations. Based on my review of this matter and a consideration of the seven factors in section 5 of the Administrative Monetary Penalties Regulations, the amount of the penalty was determined by having regard to the following: 1. Compliance History: A review of CATSA s compliance history revealed no common elements of noncompliance related to this incident. 2. Intention or negligence: On CATSA s request, the CNSC previously (April 8, 213) amended the licence issued to CATSA to add new locations where radiation devices (such as the devices mentioned above) were to be stored or used. Therefore, CATSA was aware that the devices mentioned above cannot be stored or used at locations not listed on their licence. CATSA is also fully aware that they must request an amendment to their licence prior to storing these devices at a new location. CATSA stored large numbers of radiation devices at three unlicensed locations. Furthermore, there was no request received by the CNSC from CATSA to have the CNSC amend their licence to add the Mississauga, Vancouver and Halifax locations until CNSC staff identified the non-compliance to the licensee in April 214. 3. Actual or potential harm: As CATSA did not have the above-mentioned locations listed on their CNSC licence prior to moving the devices to those locations, CATSA did not implement its radiation protection program under their CNSC licence in respect of the devices at these locations. Therefore, CATSA demonstrated a lack of control for nuclear substances in their possession but in consideration of the low risk nature of the devices, CATSA s actions constitute a low potential for harm to workers and the general public. 4. Competitive or economic benefit: There does not appear to be any competitive or economic benefit as a result of this violation. 5. Efforts to mitigate or reverse effects: The violation did not result in effects requiring mitigation. 6. Assistance to Commission: As a result of the investigation carried out by the CNSC, CATSA promptly and properly began to take corrective actions to bring all of the above devices under CNSC regulatory control as per the CNSC licence issued to CATSA. CATSA addressed the causes of the non-compliance and cooperated with the CNSC during the investigation and provided all requested information. 7. Attention of Commission: Once the initial non-compliance was identified by the CNSC, CATSA requested an amendment to their CNSC licence to add the locations in Vancouver, BC and Halifax, NS after the E-docs# 448489 Page 2 of/de 6

devices had been in storage at those locations. CATSA also arranged to properly store the devices, in a location already on the CATSA licence that had been stored in Mississauga. Therefore, the licensee was forthright in identifying the remaining outstanding issues to CNSC staff. E-docs# 448489 Page 3 of/de 6
