It might be that you have been exposed to a chemical or substance that has made you ill, or that the work your employer has expected you to do has had a harmful effect on your physical health. Prevention 09 There are a number of precautions that you can take to avoid a work related illness or injury. Basic precautions 1. Ask either your employer or your health and safety representatives for a copy of the company s COSHH assessment. They are legally required to carry out a full survey of all hazards at work and you are within your rights as an employee to ask to see this. It should give you an idea of what steps your employer is taking to protect your health. 2. Ask for the data sheets or any other information your employer may have about any hazardous chemicals you are using. They should be able to provide this for you. 3. Report any worries or concerns you may have to your employer. It is better if you can do this in writing, and this is signed and dated. You should also send a copy to your health and safety representative and keep a copy for yourself too. 4. If your concerns are serious, report them to the Health and Safety Executive and/or the Environmental health Department. 5. Speak to your employer directly. If you are not comfortable doing this then prepare a lit of questions and ask your health and safety representative to speak to your employer instead. You should ask things like: What protective equipment or clothing will your employer provide you with to keep you safe? Have they considered using alternative, less hazardous substances? Can the way in which you work be changed in order to reduce any exposure to hazardous substances? How are they going to medically supervise employees involved with the substance or process in question? Will they be monitoring your working atmosphere for dust and/or fumes, and will the results of any monitoring be made available for employees?

Take action 11 If you are suffering due to a work related illness or have been injured in an accident at work it is important to seek legal advice as soon as possible. In many personal injury cases there are strict time limits on when you have to start court proceedings for your claim. For this reason it is vital that you seek advice from one of our specialist advisors immediately. Time limits Under English law, in most cases, the time limit for starting a personal injury claim is three years from the date of the accident or incident giving rise to your injury or within three years from the date that you realise or suspect that your illness is a result of your employment, or three years from the onset of your symptoms. However that limit can vary and may be shorter or extended depending on the circumstances of your case. In the vast majority of accidents at work that result in injury, the time limit for claims will be three years from the date of the injury. In some very limited cases, such as where the person injured was under the age of 18 you can start Court proceedings at any time up until their 21st birthday. For work related illness this doesn t mean that an illness triggered several years ago cannot be claimed for now. In the vast majority of mesothelioma cases, the time limit for pursuing a claim will be three years from the date of diagnosis. It is important, however, to understand that, if this time limit is exceeded or even if the mesothelioma sufferer has already died, it may still be possible to pursue a claim. In posthumous claims, if the deceased died within the three year time limit the period is usually three years from their death.

Make contact 13 The sooner you contact us the better we are able to prepare your claim, but in any case we will give you clear advice about the time limits that apply to your particular circumstances. Do I have a case? If you are unsure whether you have a claim, you must always call us to talk it over. We ll assess your case free of charge, tell you what we think and then you can decide if you want to go ahead. How much compensation will I receive? 15 The amount of compensation you receive will depend on many factors, and your circumstances, including the seriousness of your illness or injury and how this illness has affected your life, how much money you are considered to have lost and will lose as a consequence and the extra support you may need in the future. Individually assessed From the outset, our team will advise you on how the Courts approach the assessment of compensation and how this fits with your circumstances. The fact is that we are all different and, therefore, the consequences of a similar illness or injury will vary from person to person. The Courts will always assess your claim on an individual basis and award compensation according to its findings. If your claim is progressed under Irwin Mitchell s No Cost to You scheme, you will receive 100% of any compensation* awarded to you Keeping you informed As we learn more about you and your illness or injury, and obtain further evidence such as medical reports, we will be able to provide a more accurate idea of what the Court is likely to award to you. You can be assured that we will do everything we can to recover the maximum amount of compensation available to you and organise payment terms to suit your immediate and ongoing needs. How will my claim progress? We will investigate your case thoroughly by gathering witness statements, accident reports, medical reports and other relevant details about your ongoing requirements. All this information will be collated and presented to the Courts. Insurance A claim will then be made against the relevant person or body, and it is likely that their insurance company will get involved. We will then wait for a response from the insurance company you are claiming against. This can go one of two ways; either they will decide to meet your claim, or they will not. Don t panic if an insurance company turns down your claim at first as this often happens it does not mean that your claim will fail. Out of Court The vast majority of cases are settled before they go to Court, however, some will progress to Court. It can take time to prepare a claim for Court so you will need to be prepared for this. Don t worry, this is normal and we will keep you informed of the progress and what is happening all the way through.
