2 Although asbestos was introduced into the UK in the 19th century, it s only in the last few decades that its true dangers have been recognised. Asbestos fibres can be inhaled or ingested without your knowledge over a period of time and are of a shape and size that can defeat the body s defence mechanisms. There can often be a long delay between the exposure to asbestos and serious symptoms. For instance, in Mesothelioma cases there can be a delay of years and so making a successful claim needs careful preparation. Nelsons have a specialist team of lawyers and qualified nursing personnel who deal with asbestos related disease claims. Combined with a thorough understanding of the legal complexities and experience of the damage asbestos can cause, they will provide support for those affected while the claim is in progress. There are a wide range of asbestos conditions, including: Pleural Plaques Plaques are scar tissue which can be found on the pleura, the lung s outer lining, and can be seen on X-ray. These benign plaques don t usually affect lung function. Pleural fibrosis and thickening The pleura can become thickened and there is actual fibrous damage (fibrosis) to the outer lining of the lung. Unlike pleural plaques, the lung is affected and there can be increasing breathlessness as the condition progresses.
3 Asbestosis This is where the fibrous tissue damage (fibrosis) occurs inside the lung, causing its deterioration and increased breathlessness. Symptoms can include finger clubbing and crackles heard when breathing. Chest x-rays will also show characteristic shadows. Lung Cancer This will involve a tumour of the lung, often a malignant bronchial carcinoma. Mesothelioma This rare malignant tumour is almost always caused by exposure to asbestos. Unfortunately, the prognosis where mesothelioma has been diagnosed is extremely poor despite ongoing research. All personal injury claims depend on showing that someone is at fault, for example, breaching a duty of care or failing to follow statutory regulations. Asbestos claims raise particularly difficult issues in this area. The long time period between exposure and diagnosis can cause difficulties in identifying former employers, their insurers and any witnesses. The medical issues can also be complicated, as it is necessary to establish a link between the diagnosed condition and the former work history. In our initial meeting with you, we will discuss your claims and advise you on the best course of action.
4 The long-term nature of asbestos related diseases means that the three-year time limit for bringing a claim normally applies not from the time of exposure but from the time when an illness was diagnosed or when the sufferer became aware that they had this kind of disease. Even where three years have elapsed before advice is sought, courts can be persuaded to allow a claim to continue. This very much depends on the particular circumstances of the claim. However, like all injury claims, the sooner you start the process the better. More than one way to pay The first interview which can be at your home or in hospital, is completely free. As well as getting a full understanding of the claim, we ll discuss the best method of funding your case. Legal aid Legal aid is no longer available for these type of personal injury claims. Conditional and deferred fees We can also offer no-win, no-fee arrangements in many cases where if we don t win your case, we won t be paid, and if we do win, we ll be paid a success fee. Insurance You may already have cover for the legal costs you may incur in pursuing your claim under your household, motor or some other forms of insurance. We will explore these options with you.
5 Benefits and Compensation The disabling nature of an asbestos related disease may well entitle you to social security payments and assistance while the claim is progressing.
